Title: West side bull down 6x6
Post by: cougkilr on November 11, 2012, 06:52:27 PM
I shot this bull first thing Saturday morning, about 7:10.  I drove around a corner on a logging road and two bulls were running up a clearcut and hit the road about 500 yards in front of us.  It looked like they may have went up the steep hill above the road so we headed up the road and got to the location where they had hit the road and I jumped out and headed up the road.  I glassed the steep clearcut above the road but didn't see anything so I kept on the road and as soon as I made it around the corner they were both running down the road just about into the timber. I stopped on the landing and only had a shot at the back bull, 125 yard shot on the run, died right on the side of the road, it couldn't have worked out any better.  It all happened so fast I'm not sure which one was bigger, but it Doesn't matter, I'm happy with this one!  I boiled the head out last night and will have him bleached and ready for the wall by the end of the week.

I'm thinking the internet police will get more on the shooting from the road, then where the tag is......just saying

Great bull man! Bitchin'.          Was under the impression that as long as it wasn't a gov'mnt maintained road, that it was legal to shoot from.  Maybe I'm wrong.

Umm, not a road hunter and have never shot anything from the road, but I am with this guy ^, and then I read the rules.

PG. 76 #6; Prohibited hunting methods, discharging a firearm from, across, or along the maintained portion of any public highway, regardless of surface, is prohibited, except for hunters with disabilities.... "Public Highway: Any road, regardless of surface, maintained by public funds." (PG 16, Definitions)

So, I am guessing that state and federal timberlands falls into this category? So, like most all blacktailed deer shot from a landing were illegal? Hancock is not public, one can shoot away there, I guess.

What if the road is grown up and not graded or brushed any longer? Still illegal?

I have heard of a ton of deer and elk shot from or in the road, it is really illegal? I know a guy who killed a big blacktail in the road with a bow. That must be illegal, as well.

So, if a guy walks behind a Forest Service gate 5 miles and gets to the very end of the road and is standing on the the last landing which is gravel and shoots a deer up in the clearcut, it is illegal?

Learn something everyday, I guess I will stick to hunting the timber.

It really is threads that take off like this with people nit-picking the guys photo to death that keep people from posting on this site! It is none of YOUR business where he was standing when he shot. Most people on here are law abiding citizens who take the appropriate precautions to be legal. As far as where the tag is placed. It was on the horns in the picture, doesn't mean it was there when they packed the animal out. I don't see a quartered out animal there either? If they got it out whole, then the tag on the horns is fine folks, firmly attached to the largest portion of meat known as the entire animal. STOP BITCHIN!  :bash:

Great animal bud. Its a beautiful bull and a clean shot/quick death. Can't ask for anymore.

I hope this isn't meant towards me. I am on OP's side. I just want to disagree with not being able to shoot one in or from a logging road (not saying he did, I don't care). Maybe my post was taken wrong or not articulated well, but, I cannot consider a logging road a "Public Highway", sorry.

If I were driving in or out and seen an animal in the road it would not stop me from loading up and popping it.

Publicly maintained roads can be any DNR or Forest Service road as the guys who cut and build the roads are paid by the tax payer. However, I'd argue that with some DNR roads (which are often built by loggers who are working a contract) that SOME logging roads on public land should not be considered a 'road' by the definition of our regs. A spot I've been hunting lately HAD access from the highway via a gated road, but recently had the last 500' dug up and covered with slash piles. I believe the loggers do this to stay under a certain number of road miles they can take up in our forests. To make more roads elsewhere (which they currently are on the other side of the mountain) they have to eliminate some roads that they don't need. They argue that tearing up the last 500' of a road qualifies as eliminating the entire road which makes sense since you can't drive there from anywhere.

One member asked about roads that are overgrown. I'd argue that the fact that they aren't maintained would mean they're not 'publicly maintained' which would rule them out of the classification in my book. SO...if a road can be reached in your truck it's probably maintained...if it's on DNR land, odds are it's publicly maintained...grey area I suppose. When I hunt (rather unsuccessfully I should say) I try my best to go above and beyond in grey areas. In the case of this guy's story I'd say give him a break, he got his elk and didn't hurt anyone, which I believe is the goal of the law in the first place. He says it was legal and none of us were there to say otherwise. Thanks for posting the pic man and good job! Hope to join you in the public scourging section on or around the 21st!

I know there is a lot of web police on this site but I think this is getting blown up bigger than it really has. A lot of guys are congratulating on here from what I've read. I think some people just want to point stuff out in case he didn't know so in the future nobody gets in any sort of trouble, guys are just looking out for each other in my opinion. I love seeing success on here as much as all of us, so please don't stop posting and if someone gives you advise, don't take it the wrong way.  I mentioned the tag because it was on the antlers while it was getting boiled and I'm pretty sure the meat was hanging somewhere already. I just wanted to let you know to keep the tag with the meat, that was all. So if people take it the wrong way....what the hell, I'll keep it to myself next time. Again, nice bull and congrats!!!!

Nope, I do believe the animal was cut in half and I've pack a few elk out with my head and antlers on my back but never half an elk on my back. I wasn't trying to internet police, like I said earlier, just passing on good info.  If your largest part of elk are the head and antlers I wanna hunt were your hunting, cause that's what I'm after the most anyway!!

From what I read if the road isn't publicly maintained it's legal. Publicly is tax dollars. BTW, nice bull.
6. Discharging a firearm from, across, or along
the maintained portion of any public highway,
regardless of surface, is prohibited, except for
hunters with disabilities in compliance with
WAC 232-12-828.

WAC 232-12-828
(i)"Public highway" means the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel as defined in RCW 46.04.197.

RCW 46.04.197
Highway.
Highway means the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
