Title: Current "watch list" to keep track of firearm legislation- updated 25 Feb

              Intention of this thread is to provide updated information to keep track of pending legislation
                                        A  "watch list"  with basic overview and link to each bill .

         At this point, (1 March) still in info gathering mode  - awaiting pertinent info from those in-the-know and will update status of all bills as soon as possible.   
       
         Disposition of Bills as of 25 Feb, from what I have ascertained so far:

Dead Bills
House Bill 1147 Modifying unlawful possession of a firearm. 
House Bill 1729 Prohibiting the possession of firearms by a criminal street gang associate or member.
House Bill 1730 Drive-by shootings.
House Bill 1732 Gangs/sentence enhancement.

Alive Bills
House Bill 1612 Concerning information on firearm offenders.

An unlicensed person is prohibited from selling a firearm to another unlicensed person unless:
 The purchaser has undergone a background check and the background check indicates the person is eligible to possess a firearm under state and federal law; or
 The purchaser produces a valid Washington concealed pistol license (CPL).

SB 5625  Requiring universal background checks for firearms transfers.

SB 5625 is dead as a doornail, bottled up in Senate Law & Justice Committee.
After tomorrow, that diagnosis will be final. It has no chance to become law.

Mental health exam within 24 hours.
*Not included are those involved in a convention, showing, demonstration, lecture, or firearms safety course authorized by school authorities.
*participating in a firearms or air gun competition
*person in possession of a pistol with CPL while picking up or dropping off a student
*18yr or older in lawful possession of an unloaded firearm, secured in a vehicle while conducting legitimate business at the school
*"GUN-FREE ZONE" signs shall be posted around school

AN ACT Relating to safe storage of firearms; amending RCW 9A.36.050; adding a new section to chapter 9.41 RCW; and prescribing penalties.
"IT IS UNLAWFUL TO STORE OR LEAVE AN UNSECURED, LOADED FIREARM WHERE A CHILD CAN AND DOES OBTAIN POSSESSION."
 (1) A person is guilty of reckless endangerment when he or she recklessly engages in conduct not amounting to drive-by shooting but that creates a substantial risk of death or serious physical injury to another person.
 (2) Except as otherwise provided in this section, a person is guilty of reckless endangerment if the person stores or leaves a loaded firearm in a location where the person knows, or reasonably should know, that a child is likely to gain access, and a child obtains possession of the loaded firearm.
 (3) Subsection (2) of this section does not apply if:
    (a) The firearm is secured in a locked box, gun safe, other secure locked storage space, or secured with a lock or any device that prevents the firearm from discharging;
    (b) The child's access to the firearm is supervised by an adult;
    (c) The child's access to the firearm was obtained as a result of an unlawful entry; or
    (d) The child's access to the firearm was in accordance with RCW 9.41.042.
 (4) If a death or serious injury occurs as a result of an alleged violation of subsection (2) of this section, the prosecuting attorney may decline to prosecute, even though technically sufficient evidence to prosecute exists, in situations where prosecution would serve no public purpose, would defeat the purpose of the law in question, or would result in decreased respect for the law.
 (5) For the purposes of this section:
   (a) "Child" means a person under the age of sixteen years; and (b) The definitions in RCW 9.41.010 apply throughout this section.
 (6) Nothing in this section mandates how or where a firearm must be stored.
 (7) Reckless endangermentis a gross misdemeanor.

SB 5737 Banning the sale of assault weapons

AN ACT Relating to banning the sale of assault weapons; reenacting and amending RCW 9.41.010 and 9.94A.515; adding a new section to chapter 9.41 RCW; and prescribing penalties.
(20) "Assault weapon" means:
    (a) Any semiautomatic pistol or semiautomatic or pump-action rifle or shotgun that is capable of accepting a detachable magazine, with a capacity to accept more then ten rounds of ammunition and that also possesses any of the following:
         (i) If the firearm is a rifle or shotgun, a pistol grip located rear of the trigger;
         (ii) If the firearm is a rifle or shotgun, a stock in any configuration, including but not limited to a thumbhole stock, a folding stock or a telescoping stock, that allows the bearer of the firearm to grasp the firearm with the trigger hand such that the web of the trigger hand, between the thumb and forefinger, can be placed below the top of the external portion of the trigger during firing;
        (iii) If the firearm is a pistol, a shoulder stock of any type or configuration, including but not limited to a folding stock or a telescoping stock;
        (iv) A barrel shroud;
        (v) A muzzle brake or muzzle compensator;
        (vi) Any feature capable of functioning as a protruding grip that can be held by the hand that is not the trigger hand;
     (b) Any pistol that is capable of accepting a detachable magazine at any location outside of the pistol grip;
     (c) Any semiautomatic pistol, any semiautomatic, center-fire rifle, or any shotgun with a fixed magazine that has the capacity to accept more than ten rounds of ammunition;
     (d) Any firearm with a threaded barrel designed to accommodate a flash suppression or noise suppression device;
     (e) Any shotgun capable of accepting a detachable magazine;
     (f) Any shotgun with a revolving cylinder;
     (g) Any conversion kit or other combination of parts from which an assault weapon can be assembled if the parts are in the possession or under the control of any person.
 NEW SECTION. Sec. 2. A new section is added to chapter 9.41 RCW to read as follows:
 (1) No person in this state shall manufacture, possess, purchase, sell, or otherwise transfer any assault weapon, or any assault weapon conversion kit, except as authorized by subsection (3) of this section. Any assault weapon or assault weapon conversion kit the manufacture, possession, purchase, sale, or other transfer of which is prohibited under this section is a public nuisance.
 (2) No person in this state shall possess or have under his or her control at one time both of the following:
   (a) A semiautomatic or pump-action rifle, semiautomatic pistol, or shotgun capable of accepting a detachable magazine; and
   (b) Any magazine capable of use with that firearm that contains more than ten rounds of ammunition.
(3) Subsection (1) of this section shall not apply to any of the following:
   (a) The possession of an unloaded assault weapon for the purpose of permanently relinquishing it to a law enforcement agency in this state. Any assault weapon relinquished pursuant to this subsection shall be destroyed;

I appreciate you taking the time to write about your concerns regarding gun rights in this state and House Bill 1588, which would require universal background checks. Following the tragic events at Newtown, Connecticut and the long list of killings prior to that, I strongly believe we must do more in this country to protect our children and society as a whole. We cannot continue postponing this issue, and I hope to see substantial reforms during this legislative session.
 
I have received many e-mails and phone calls from constituents on both sides of House Bill 1588, and I greatly appreciate hearing your opinion.  But after much consideration, I have come to the conclusion that we should require background checks for anyone purchasing a gun and eliminate the gun show loophole, because it will help our state become an even safer place to live.
 
Thank you again for your e-mail. I hope you will continue to let me know your concerns, so that I can better represent you.

kind of surprised the anti gang bills didn't get a hearing.

HB1612 is AN ACT Relating to firearm offenders.
All of the firearm offenses listed in HB1612 are felonies except those related to RCW 77.15.460 (Loaded rifle or shotgun in vehicle …), which many times are hunting violations or honest mistakes.  I believe this is a misdemeanor.  Minor violations should not end up on a central registry of firearm offenders.

We should be concerned about the potential abuse of a central registry such as this.  Although it is not supposed to be available to the public, one successful Freedom of Information Act lawsuit could quickly change that.  Please remember the vicious media abuse of law-abiding gun permit holders that had their names and addresses published on the internet in maps by the Journal News in New York.  I believe there is an issue with  HB1612 because of the inclusion of non-felony violations and that there is too much risk of abuse of such a central registry.

During the public hearings, it was explained that a judge would decide who would go on the list based on three criteria: previous criminal history, previously found guilty, or evidence of propensity for violence.  A concern expressed during the public meeting was that there are judges that are definitely anti-gun, so there would be the likelihood of inconsistent application of the law regarding who goes on the list.

I believe these are two major issues: possible abuse of a central registry and who goes on the list.  Central registries are NOT good for those who end up on “the list”; remember Nazi Germany.

1612 is backed by both Democrats AND Republicans. Only Rep Shea voted against it in the Judiciary Committee.

Hb1588 is bad, 1612 unneeded and HB 1096 is a good bill but costs money. :twocents:

I care less that both sides support something.
Unconstitutional laws are bad no matter what. Or undeeded laws are bad no matter what. Were heading down the same slope others headed but people thought oh well it's for our own good right?

sorry i didn't add the list here to see but in my email the list was 1588,1612, 5737, and one other 5635.
Dear sirs as a concerned citizen of the United states I write today to encourage you to oppose these listed bills. While some have noted that 1588 does not infringe upon our constitutional rights, those people would be very wrong. Asking a law abiding citizen to jump through hoops in order to exercise a right is in odds with the original intent of that right. Limiting Law abiding citizens with undue and unwanted labor, and time consuming steps to do something that is inherently permission granted: to now having to ask permission is entirely at odd with what our founding father's had envisioned for our country. I have written many times before on these issues and have received nothing more than excuses as to why they feel these steps are important, and undermine mine or anyone else's feelings. We are a Republic not a Democracy, our Forefathers gave us a Republic that was to protect the rights of the minority from the majority. When you vote against those that say no to these bills and vote with what you believe is the majority you ignore the others that have said no to these kind of bills or infringements.
When you ignore the minority you also alienate the ones that also help pay your salaries.
You also tell us/me that your voice is unimportant, and that the majority is to have absolute rule.
This law would not have prevented what happened in Connecticut at all and would bring upon those that say no to this unjust, and undue Burdon when we want to loan a firearm out to a friend when going to the range, out target shooting, or deer hunting. If ignoring us is what you call representing all that have voted for you, then no wonder people have a hard time respecting our elected officials.
I say 1612 is another one of those feel good bills that would bring about a centralized registry and target unjustly some people that have spent years trying to undo one bad decision. Since we have a current anti gun panel of judges, this one would again be used to discriminate those that now have no voice. Yes we can say "Oh well they deserve what they get because they violated a law", but to keep punishing someone for something that may be years in the past is not protecting others, it is in fact alienating one other sect.
5737 Is an outright infringement on our second amendment rights. This bill limits what a person could chose to defend himself with. People keep calling these weapons of war, which in fact is furthest from the truth. I have also noted in this bill that only allows one to keep this type of firearm in transit from their home to range, and back again. I have first hand knowledge this firearm is used to hunt with as well. These firearms are modern firearms, and have as much sporting use as a bolt action rifle does. Again would not have prevented Sandy hook.
5635 is another one of those bills that should not pass. When someone fulfills the needed time and rehabilitation they should not have to jump through more hoops in order to prove they are responsible citizens. Especially in today's anti gun climate there is no guarantee that no bias would occur on this kind of subject.
As it is now, with the prosecutor, and judge being the ones who decide if in fact the person in question validates he/she is responsible or not is fair. This process now is the correct method on deciding these issues and should not be up to those who are politically agenda minded.
Again I ask that you not ignore those that hold the minority, and alienate further those who you serve. For that is what is supposed to be the truth you serve us not the other way around.

Speaking from the heart is very powerful.  I believe the points you made reflect how most people in our ranks are feeling with this onsaught of attacks on our rights and freedoms.

Maybe the Eddie Eagle Bill SJM 8006 is still alive; it may have gone through at the last minute.

The bill is still alive. It was made eligible for a Senate vote on 2/25.

This bill is not a "law" bill but essentially just a memo to be sent to schools....

The bill is still alive. It was made eligible for a Senate vote on 2/25.

This bill is not a "law" bill but essentially just a memo to be sent to schools....

It will send a clear message and is actually promoting education for young children that can help prevent gun related tragedies from occurring.
