Title: NICS Going Away in WA State
Post by: h2ofowlr on September 06, 2023, 12:33:25 PM
I heard that WA state was going to do away with NICS checks and require each new firearm to be ran through the state patrol data base.  10 day wait on all firearm purchases and an additional fee of $18 per gun.  They are creating a data base of gun purchases.

It was part of I-1639.  I just looked it up, what actually changes is instead for the FFL running a check through NICS, the FFL will submit forms to State Police.  Then the state police will run a check through multiple organizations to include a NICS check.  It just added a middle man and more hoops.  The link does a quick breakdown.

Hmm, article doesn't say when this goes into effect. I'd like a Ruger 10/22 before it does...

Law went into effect in 2020, State patrol has been on the hook to set up a system, which they have yet to do.

Right, I'm wondering if they've set a date that it will be ready to swap over to this new system.

Yes sad to see.  Was passed in the 2020 law without details of how to setup/fund/execute the support system. Looks like NY is dealing with a parallel issue according to this article I'd just read: https://www.thedailynewsonline.com/top_story/new-gun-ammo-checks-to-start-next-week/article_a5a144d5-4ac3-52a1-8368-0f303f946c1f.html

Couldnt they create a database through the NICS checks?

From what I have been told, technically they are not supposed to....  The records of each NICS background check are supposed to be destroyed after 88 days.  The FFL is required to keep the records of each transaction.

It's just another law that gets passed but goes no where. The State Patrol doesn't have the funding or resources to do that, also most law enforcement people are gun people and think it is dumb. It will just be another law on the books that never gets enforced because law makers are about headlines and making people happy, not with making the state actually safer/better/improving. All kinds of laws get passed and go no where because they didn't work out the logistics or funding for it.  Just my 2 cents.

If you get a cleared BG check in 59min do you still have to wait 10 days to get the gun?

The sponsorship and votes for this change were bipartisan. The FBI informed Washington they would no longer conduct some checks and Washington needed to do these checks. The opposition to this bill was also bipartisan.
