Waiting period
« on: September 12, 2024, 05:21:19 PM »
A buddy that lives in Washington comes here to North Dakota every October to spend a week bird hunting. He wants to buy a shot gun while he’s here because the selection @ Scheel's dwarfs Sportsman’s Warehouse & Cabelas/Bass Pro. And all the guns are in racks on the floor to pick up & handle. Does your guys’ 10 day waiting period follow you to other states?

I may be wrong.

But I do not think a shop in Dakota will sell to him because.

I think the law says all firearm purchases must go through the WSP. I believe there was a shop in Idaho that would not sell to Washington residents.

I would call you local shop and see what they say. :dunno: :dunno:

Well here ya go.

https://app.leg.wa.gov/rcw/default.aspx?cite=9.41.122#:~:text=Residents%20of%20Washington%20may%20purchase,L.

So based on this I would guess no. Because the only way they confirm he can have a firearm in Washington is through the WSP. Which they probably don’t have access too.

Somebody should try it and if they block it they should sue. Seems like there should be some case law stating that Washington should not be able to regulate commerce in another state.

They can regulate the import of the gun once the resident returns but the store isn’t violating any laws that I am aware of by selling the gun in their state if those laws allow the sale.

Check them out at the store, note the model info of what he wants, search wikiarms and get a better deal on it than in store and ship to a WA FFL.

Yes, it's legal to buy out of state if it's legal to buy in WA. The entire transaction has to take place out of state to keep the state of WA out of it.

You can purchase a wa legal long gun out of state.  I recently purchased a gun in Oregon, was fine.
