What are the well numbers, depth, GPM, size pump? Elevation of property.

There is a road maint. agreement , water agreement , and CCR's. Yearly fee for the water and maintenance agreement but no Home Owners Association.

What are the well numbers, depth, GPM, size pump? Elevation of property.

The well is shared between 8 lots. It is a Washington State Class B Water System.  Well is 480 ft. deep and 100 + gallons per min. The pump is a Berkeley 30 GPM model. Elevation I believe is around 2200 ft.

What you are describing is by definition a HOA. It may not be active, and may be functioning by fiat from a self selected few, but there must be an HOA in place.

The HOA is probably still under declarant control, and the water supply is probably a stand-alone entity.

Correct, but.

If there is a CC&R there is almost certainly a HOA.  At that point the HOA could be under declarant (developer) control, inactive, active but under the thumb of some members with the rest of the community apathetically acquiescing, or a full and proper HOA operating as per the CC&Rs.

If the middle two alternatives are in place, then a situation where individuals enforce the CC&Rs via the courts could result.  The only thing worse than a HOA is none when there should be one.
