Purchasing a Firearm that's Sold w/a 15 Round Magazine

Hi everyone,

I'm looking to buy the Sig Sauer P320-XTEN 10mm, which has a 15 round magazine. After trying to purchase online and ship to an FFL dealer in WA, I learned that it's illegal in WA to purchase magazines with a capacity over 10 rounds as of July 1, 2022. My understanding is that it's not illegal to possess a 11+ round magazine but rather purchase one in the state of WA. Now, I'm wondering what my options are for purchasing this specific pistol.

Is it possible to purchase a firearm, get it shipped to a state like ID or OR, and pick it up as a WA resident? Does anybody have any other legal recommendations for purchasing a firearm with a default magazine of 11+ rounds?

I would probably buy it without the magazines and then buy legal magazines.  My understanding is that you can't buy or import those mags now, so it wouldn't matter how you bought them, if you import them into WA you would be breaking the law.

You would need to find a magazine that holds ten or fewer rounds. If that particular handgun doesn't have a magazine holding ten or fewer rounds I don't think you could legally get around the new law.

I wonder if a guy could either hammer a dent in the side to limit it (like they were pre AWB expiration) or have a plug of some sort put into the magazine similar in theory to a 2 round plug in a waterfowl shotgun?  There is no mention of it having to be factory 10 rounds or incapable of being modified to > 10 rounds.

The law is pretty unprecise.  The way I read it you could even give a magazine to a person, just not sell it.

Been a while since I read the text of that bill, but I believe a "plug" doesn't satisfy the requirements. The magazine would need to be "permanently" modified to be 10 rounds or less.

I think that would qualify as "distribute".

(7) "Distribute" means to give out, provide, make available, or deliver a firearm or large capacity magazine to any person in this state, with or without consideration, whether the distributor is in-state or out-of-state. "Distribute" includes, but is not limited to, filling orders placed in this state, online or otherwise. "Distribute" also includes causing a firearm or large capacity magazine to be delivered in this state.

That's how I read it.

(16) "Large capacity magazine" means an ammunition feeding device with the capacity to accept more than 10 rounds of ammunition, or any conversion kit, part, or combination of parts, from which such a device can be assembled if those parts are in possession of or under the control of the same person, but shall not be construed to include any of the following:
(a) An ammunition feeding device that has been permanently altered so that it cannot accommodate more than 10 rounds of ammunition;

Guess I should get out my crystal ball to see what guns will be available in the coming years . So I can go back in time and buy the magazines that aren't available yet

I would check to see if a 10 round magazine is available.

I thought that this would be the best option. From what I can tell, they don't sell this specific pistol with a 10 round capacity magazine. But I could be wrong.

I didn't see any language saying that you can't "buy" or possess a larger than 10 round mag, the language is directed at selling. 

You can buy a long gun out of state but not a handgun, so no ID or OR pickup. You could buy the gun in WA with the 10 round mags and pick up a larger capacity in another state, which might conflict with the "import" language.

If you were going on an out-of-state hunt in grizzly country that allowed 10+ rounds, keep the 15 rounder for those trips but avoid carrying in WA.
