I wasn't planning on hunting bear with it, but then I realized......a bear may find this before the kitty.

So I just learned this year that you could hunt bear over a gut pile. I have a deer carcass that I cut the meat off, and such. I am going to throw it out in a clear-cut, and hope that this cougar comes in, or maybe a yote. But........where I am going to throw it out holds a lot of bears so it may draw a bear out before something else. So I am wondering. Since I am moving the carcass, can I still hunt over it for bear :dunno:

no, this question has been beat to death lately. if you see a bear, and kill it, and its over a gut pile then your good. if YOU leave a gut pile, then return and hunt over it, its baiting, and thats illegal.

I believe you are incorrect. As long as the gut pile has not been moved it isn't considered baiting. If the pile has been strategically moved, it then becomes intended bait.

This seems like the answer I have ran into. I have spoke to different wardens about this same subject, all have gave me different answers, sitting on a gutpile is baiting, isnt baiting, etc...

There is your answer, its a risk not worth taking. and to be twice as clear, we have Game officers on this board, they are reading here daily just like you, keeping tabs and also because they are hunters, and I was shocked to meet one yesterday who already knew who I was, and why I was where I was :chuckle: heck of a cool guy too

had this discussion with 2 different GW's so far, one being as soon as yesterday, both said the same thing I assumed,
-- if you shoot a bear that HAPPENS to be over or near a gut pile then its coincidental and luck
-- if you are AWARE of a gut pile and you hunt it, watch it, return to it with a gun, looking to shoot a bear, then its 100% baiting and you will be busted.

:dunno: Not sure how they would consciously know that you were aware a gut pile was there even if you really knew it was there. Alot of speculation and assumption there and I'd say good luck trying to prove anything!

Even if one game warden's interpretation is that it's not legal, what are the chances that that particular warden is going to be watching you at just the moment that you pull the trigger?
Pretty astronomical odds, I'd say.
