Well since I am such an insane person  :dunno: :chuckle: I will conclude my issues with wardens !!! It is obvious when you keep posting things like photos and bad mouthing the law that most likely they will come knocking at your door  :dunno: :dunno: Yep last night at dinner time I was eating dinner while I heard someone knocking on my door  :yike: Thats right ....search warrant in hand and the Swat team   :o  its all good  :tup:

I was going to let you sit on it for awhile  :dunno: This maybe the best thing that could of happened  :dunno: All over a picture of my SON posting a picture on facebook  :o :rolleyes: He was holding a Native steelhead out of the water  :bdid: According to them you can not take a Native fish out of the water if it is closed for keeping them ...no matter if you turn it loose or not ..You have to either cut your line or keep the fish in the water at all times without handling it ...Thats fine since not everyone knows how to handle a fish ..But wetting yours hands is how I handle a fish I want to cut loose ...I can understand what they are saying ...They came because they thought that Teddy was clubbing fish in the head !!! They searched the freezers to find many fish  :dunno: 8) BUT NO STEELHEAD !!! They were doing their job and thats fine ...After a 2 hour deal I hope we settled our differences and this will be the end of it ...I told them how I felt and they done the same ...they need to understand where I am coming from too ! I buy every tag this state has to offer and I am not sitting home and doing nothen when I pay for what I do ...that is what it is all about ...I am tired of all the laws they come up with and I have a right to beach about what I believe in ... I am not braking the law like they may think I am ... and now they seen what is in my house ...lots of fish and dead animals that are legally taken and reported I hope they can leave me alone now ...and I will do the same !!

Sounds like your boy got a tough lesson regarding the regs and posting things on public forums. Sounds like they may have taken it a little far but since you guys have a special relationship it doesn't surprise me.

Glad to hear it worked out ok. I'm always amazed at how many people post pictures of themselves hold native steelhead. It doesn't bother me a bit, I know the fish was released unharmed in most cases, but even the pros do it... I constantly see them posting pics of big natives out of the water. Wonder if the law comes knocking on their door?

Hope your boy didn't catch too much guff about the pics... By the sounds of it I'm guessing he did.

Sounds to me like you got a good lesson.  That law was put in place because people don't know how to handle fish and don't do it responsibly.  Many people who claim to know how to handle fish still hold them out of the water too long.  Just yesterday someone posted a "funny" comment about kicking pinks back into the water.  While there are plenty of pinks around, it still isn't proper fish handling, still is harmful to the fish, and still shouldn't be done.  I've never understood why hunters feel it is OK to mistreat fish but not OK to mistreat animals?  And, I've seen plenty of steelhead mishandled and even some kicked back down the gravel bar to be released "unharmed."  Personally, I hope you got a ticket and learned your lesson (which it doesn't sound like occurred on either count).

I'm sure Teddy learned some things.  Hopefully he learned the proper way to handle wild steelhead, but also, hopefully he learned that if he posts something on the internet that he will get a visit if it looks like something illegal has occurred.

Should be a good lesson for some people on here too............Big Brother is watching (especially if you bitch about them on the internet and piss them off). :)

If I understand this correctly, this guy's son took a picture of a fish before he released it. Then I believe that you think it is justified for LEO to come and raid his home and go through his personal stuff because of his son's picture? That really scares me, what about a person that gets pulled over for doing ten miles an hour over the speed limit. Should the police raid his home because maybe he was speeding because of drugs. Really seems over the top to me.

:yeah: I would like to see the final report, assuming it is final, and what the cost was. That's mind boggling that they would execute a multi agency raid over a mishandled fish.

Like most of BH45's posts regarding the WDFW there are most likely selective details being left out and others exaggerated. The SWAT team? really? Pretty sure that was an exaggeration. Just another drama filled BH45 thread. We should all chip in, by him a crown, and officially announce the first ever official HuntWA Drama Queen!

So seriously Bowhunter, do you really think they showed up just because of this pic or might it have something to do with you practicing taxidermy etc.   Not to put you on the spot or anything but it has been my experience with these type of threads that alot of information is left out and law enforcement is painted in a real ugly way.  I am glad everything turned out good.

I'd like to touch on this a bit more. So....I read the regs and they say it is illegal to hold a native out of the water. I say okay....this is a rule....it is published and enforcable. Now...because I agree that this rule exists I would have a problem with you?

Do you see how that statment shows your intent to disregard laws/rules you disagree with? If so, like I and others have mentioned, I believe you are making your own problems. If you are teaching these boys to do the same they will continue to have problems with the local authority as well.

As long you are not selling it you are ok.   Encompassed in that is doing it for friends (taking a 100 to cover costs or buy beer).  That sort of thing.   Better be careful with migratory stuff and records too these days.  I think you can get into trouble really fast.

My kids were born with a pole in their hands and Teddy loves to fish ..But he knows he is not to brake the law...I do not teach my kids to brake the law ..I CAN NOT BABY SIT THEM EVERY MINUTE OF THE DAY...Kids are kids ..we all were kids at one time and if you never done nothen wrong in your life then good for you ...Teddy learned a lesson over this ...if these kids could be fishing legally they would not be doing other things to get them in trouble ..unfortunately he was doing something he loves but still was doing something illegal by holding a fish out of water  :bash: :bash: they thought he was killing them and thats why they showed up ...they took nothen ...they left on a good note ..well at least they said so but who knows until I hear back ..I agree I get alittle fired up but I am who I am ...and I am not going to hide in a corner and  :'(    If I was braking the law do you think I would share my issues ... Do not think So ! We all need to be aware of what is going on with our rights to hunt and fish and we should all learn from each other what is right and wrong ...I try to help people on this site as much as I can and I will continue to do ...another thing ...there was 4 or 5 nets out one day they were fishing ...its o.k to net Native steelhead but its illegal for a kid to take a picture of a fish he caught by holding it out of the water ....this is O.K ...By law yes ..but I do not have to agree with it !

Just curious, do you really think that taking a picture of a fish before releasing it rises to the level of having his home invaded and gone through because of it? How many people have done this, maybe I am missing the severity of that pic. I realize that his son was wrong for doing it, but to invade his home because his son took a picture of a fish that he caught and released? I truly am struggling with this one.

No. They use other agencies.  When the raided my neighbors barn to take a peek at his two legally taken and tagged elk they brought two state patrol cars, one sheriff's and fish and feathers with the lights going.  Allot of man power for nothing. Wish I had a state job!!

I had fish and feathers come over on a similar deal last spring. They went through the freezers looking for a Nat. found nothing. My wife told them on the way out door that I had buried it in the garden! Next thing I know they have crime seine tape around the vegi garden and a bit latter a truck load of uniforms show up with shovels. After they spent all day digging up the vegi garden I thanked them and put the rototiller back in the barn!

Nope.....I wouldn't even expect the boy(s) to get cited for the infraction. A reminder should be good enough if it is clear that the intentions were to simply get a picture and the fish was handled responsibly.

My comment was directed to the cadence created by BH beating his chest and stating that if you agree that this is illegal you are "gonna have a problem" with him. As stated before there is much much more to his relationship with the local departments than just his kid taking a fish out of the water for a photo.

I'm curious though, what would they do if they found fillets?  How do they tell if its steelhead or salmon (short of taking a sample for DNA testing) if it isn't a whole fish?  (and even if it was steelhead, they wouldn't know if it was native or hatchery if it was processed).

That's the crux here I think.  How on earth could they get a warrant, and even if they did,  how could any seized evidence be admissible.

1) Prove that the photo was taken in Washington.

2) Prove that any (hypothetical) steelhead were taken in Washington.

3) Prove that any (hypothetical) steelhead found in the OP's  freezer were not taken 1, 2 10 or 20 years ago.

I'm curious though, what would they do if they found fillets?  How do they tell if its steelhead or salmon (short of taking a sample for DNA testing) if it isn't a whole fish?  (and even if it was steelhead, they wouldn't know if it was native or hatchery if it was processed).

Agreed.  I highly doubt they would have given the kid a ticket even if they caught him in the act (assuming he was just holding the fish up gently for a picture).

I disagree. Like I said it may have been over the top a bit, but was justified. Would they do that to you or I probably not, but there is a contentious history there between them.

I personally like the law.  It doesn't hamper my fishing at all and it protects fish.  Why do people need to remove a fish from the water that isn't legal to retain in the first place?  Net it with a CnR net or tail it, remove the hooks, snap photo, and release.  Seems pretty damn simple to me, and thousands of anglers have managed to figure it out.

I was finding it difficult to swallow that all the WDFW needs to get a search warrent is a picture of a kid on facebook holding a Natural Steelhead out of the water  :dunno:

If that kid was a convicted felon poacher with a handgun showing in the picture of him holding a nate steely, I could see probable cause to search his house, not just some randon teenager with a nate steely out of the water :o

BTW, what is holding a natural steelhead out of the water? Is it a misdemeanor? Fine?

:yeah: It is pretty easy to net them, keep them in the water, and take a pic without removing them from the water. The law states they cannot be completely removed. This means a fin still in the water, and you are good to go. I think this is meant to keep the idiots from kicking fish back in the river that cannot be kept.  :twocents:

I never said I needed an attorney but if I do ...guess what ? I will dang sure get one and we can run this back 7 yrs with them on my arz and still coming up with nothen .... AND THINK ABOUT THIS WOULD YA ...Remember last year when I had the taxidermy issue ? they send me a ticket in the mail for $1000.00 Thinking I was going to just pay it  :bdid: No I am not going to just pay it when I done nothen wrong ! Its really simple BH, just ask them for a copy of the warrant, no need to wait. ;).  What is the case number on your paperwork?

:yeah: The warrant plainly states this ...Seize the following property specifically described as follows : steelhead and parts thereof.
                                                                       photos,films,videos,cameras,memory cards ,phones,computer hard drive .
                                                                       fishing license and onto some other things I have no clue why ....documents showing domicile at residence,and ownership/use of vehicles,to include,butnot limited to;utility bills.phone bills ect...why they need that I have no idea ... again they did not seize any of the items mentioned ...WHY ???? Yes to both.  Sorry not to clear.  If this is all true like bh45 claims then this is very disturbing they do this based on a picture and no info related to when where etc. etc.  What if somebody photoshopped something, or pranked?  Too far they went IMOP.

I didn't read the whole thread, so.... The wdfw doesn't just raid someone's house because of a fish out of the water violation... They contact because they usually have a pile of violations to chat about... Or they had a tip of active poaching, etc..

You sure that the waters that your son was fishing were even open? I've been steelhead fishing all my life, and because I read and respect the regs, I've never had an issue with the game department.

I'm sure that this is not a direct reflection of yourself through your son, but....respect is taught.

This is now seriously funny ...I was out coyote hunting this morning ...I drive by the river to see a guy sitting on the rock fishing  :yike: I decide to turn around and walk down to him ...I ask him if anything was bitting he says No......I say well If I was you I would get the line out of the water because it is Closed ...he says BS ..I say no BS ...We talk for a few minutes and I drive off ....I make a few laps around for about an hour or so and  :yike: he is still sitting there ...I pull in again and tell him I am serious and he says I just read the regs and it is still open ....maybe he is still sitting there ....Lmao !

BH - You can get all the info from the police.  All you need is to do is disclose what agency was involved and you (or anyone who is interested) can file a public records request.  They will turn it over.  Whether you feel like having people double check your story is up to you, but saying the records are not available is incorrect.

All the info I gathered in the last day would turn this thread upside down but I am sure a few want to believe that I do things wrong and it is peesing me off ! I will tell you why they think I am an outlaw .....It is called being a successful outdoorsmen  :o yeah thats right ...Lets see I am 45 years old I have hunted since I was 6 and have killed a deer every year since then and 11 elk and 21 bear and 50 or so turkeys ...Caught hundereds of steelhead .. I never ever in my life ever kept one HEN STEELHEAD IN MY LIFE even when I could keep one  :bash: But I am such an outlaw!!!!!!!!!!!!
 ...I have tagged every freakin animal my boys and I have killed and they still insist I am an outlaw ...they came to my house and spent 2 1/2 hours of our time visiting and I am to be happy about it ....I was finally getting over there  last issue when here I am again going threw the same sheet and they came up empty handed again ! they needed to come here and clear up there minds about me but truthfully I doubt it ...There is me pulling on one end of the rope and them on the other ....as long as they pull I am pulling back ..Just the way it is ....and if I shared the whole story from the beginning we would still have the same people thinking BH45 is full of ----------- ....whatever ...No one needs to believe me and sure in the heck do not need to feel sorry for me if thats what you are thinking ....I do have a problem by getting on here all the time and maybe I need to be tossed off and then I will not need to worry about it anymore ...they want to keep taking things away from us thats fine ...You can sit on this computer and talk about laws and anything else you want to but I am tired of loosing freedom over the state of Washington and I am not going quietly ....I promise you that !!!!!! I know I almost got tossed off last time over the drama but I need to have someone to unload on !!!!!!!! A few pages ago you said you couldn't get the records until the police (who remain a mystery) file a report, but you now claim you have the records while continuing to ignore requests for you disclose some info.  I'm not sure I can follow your thought process here?

And, to be clear, I could care less how many critters you have killed.  I understand that your are proud of your hunting and fishing prowess, but I'm not sure the rest of us on here are all that interested in comparing the size of our ....... harvest numbers?

And, to be clear, I could care less how many critters you have killed.  I understand that your are proud of your hunting and fishing prowess, but I'm not sure the rest of us on here are all that interested in comparing the size of our ....... harvest numbers?
I have the warrant ,,,I called to see if I could find out why a judge would sign a warrant over a picture of a kid and a fish ..they told me until the report is filed I would not know that information ....

Yeah this brings up another issue ,,,some do not like you and turn you in because you show yourself with a picture and of course some are always jealous ... Do people really freeze a steelhead whole and shove it in their freezer anyways? If I were to keep a native I'd fillet and release... Not saying I'd do that but at least get rid of the evidence.

Hang in there BH45, these threads where everyone wants to jump on the ish talking train sure get old don't they. Lets just see some pictures of legal steelhead. I'd start but I don't have any, I can't stand fishing for those things in this miserable weather. Call me a fair weather fishermen!

First time reading this thread.   I do everything legal that I know of so I would have not posted any native fish out of the water... 

1.  I would have taken video and pictures.
2.  Had your son post it on Facebook and any place else. 
3.  I would have fired up Facebook and showed him sites like Steelhead Nation, Young Steelheaders, Women steelhead fishing, Northwest Wild Country, Terry West, Joel's Jigs, etc... All pictures with natives out of the water.   Go get them before you come knocking on my door again... 

I would have plastered the video all over Facebook and tagged all those possers with fish out of the water on the pictures and video as well as the Washington Fish and Wildlife.  With some really smart mouth statement. 

I can tell you that somewhere your son made the verbal statement that he tagged that fish to one of his friends.  That is why they came a knocking.  They were looking for that fish...

IMO, the bottom line is BH isn't telling the whole story.  Otherwise, he would simply disclose what agency was involved so the full story could be looked up by anyone who cared to find out.  I don't see any other reason for him to refuse to do so.  And, for the record, I don't think any of the "haters" on here are "hating" because of the fish, but rather disagree with BH's attitude and characterization of the situation.

Man I have worn myself out on this ...I seriously do not understand why no one gets where I am coming from ...you guys sit here day in and day out beaching about Tribal issues ...this is not about me hating the wardens or the tribes ...it is about me getting confronted about things that they are taking away from us ...you can sit here and beach about roads being closed and the tribes should have to stay out of elk wintering grounds ...Really ??? but as soon as I bring up my son fishing in a river with Native Steelhead in it and having wardens beating on my door because my son his holding one out of the water i am the one who is screwed in the head ....My point is that there was 4 or 5 nets below my boys one day and here one is in trouble for holding one out of the water ...No different than you hunting somewhere where you had to walk to get there and a truck full of tribal members drive  past you and laugh as they drive on ...Then they turn around with a huge 6x6 in the back and now you run to the computer to beach about it ... The way I see it is alot of you guys are hypocrits !! Maybe Ted was wrong since it is the law but having 5 nets below you and you still manage to catch one means he knows what he is doing  :dunno: :chuckle: :chuckle: Next time I hear someone complain about tribal issues I will sit here all day long defending them since its their land maybe we should just let them have it back !!!! This is about EQUAL RIGHTS TO ME more than anything ....and if I did not get my point across now I give up ...and as far as Jerome goes ...it is obvious he knows me and knows how I do things and thank you for having the Halls to stick up for me ....I know alot of people on this site that just stay in there hole and do not say sheet ...thats o.k BH45 has always been on his own and that is the way I like it !!!!!
