just need some legal advice and where to take it from here ....Just send me a PM .... THANKS ( 90 days in jail or 1000dollar fine for a juvenile holding a fish out of the water ) Whatever !!!!!!!!!!!!!!!

I would suggest calling an attorney yourself. One call can be made in a matter of minutes verses days or weeks of a thread with a bunch of drama or who knows what.

All the judge did was say the maximum penalty. He would've said the same thing for any other misdemeanor. Doesn't mean your son is looking at anything close to that, he just had to inform him of the maximum penalty.

Yeah thats the legal word :chuckle: I not starting drama ...I am not afraid to talk about stuff like this ...I call it all BS ...Yeah I know I can not reflect on the day my boys were fishing there was 5 nets strung across the river killing everything that swims by ..So I guess I should just hide in the corner and not fight back ...well we all know thats not happening here ...Yeah I am sure if we decide to represent ourselves I will get stuck paying $500 ...But what peeses me off is now I am hearing something about no punch card ... :bdid: Never heard of this until today AND I JUST SENT ALL 3 PUNCH OFF THEY REQUEST WE DO !!! Now I do not have that to show the dang judge :bash: :bash: I am not saying he done right or wrong but I am not buying their crap !!!! :sry:

I think they will push this pretty far. We know about your special relationship with them and being a steelhead they will probably make this as costly and difficult for you as possible. Sadly, I think this is more about them and you then Teddy.

Direct quote from the Regs:
SALMON and TROUT HANDLING RULES
FRESHWATER: “It is unlawful to totally remove salmon, steelhead, or Dolly Varden/Bull Trout from the water if it is unlawful to
retain those fish, or if the angler subsequently releases the salmon, steelhead, Dolly Varden/Bull Trout.”
MARINE AREAS 5 through 13: “It is unlawful to bring wild salmon or a species of salmon aboard a vessel if it is unlawful to
retain that salmon” (“aboard” means inside the gunwale of a vessel).
MARINE AREA 2-2: “It is unlawful to totally remove salmon from the water if it is illegal to retain those fish, except anglers fishing
from boats 30 feet or longer as listed on either their state or Coast Guard registration, are exempt.”

Sucks you have to deal with this, Bowhunter45. If you do have that "special relationship" with the WDFW that H20 mentions, I'd lawyer the heck up right away. For the most part, guys in black robes don't have any respect for people in front of them without a highly paid mouthpiece. It ain't right, but that's the way it is. I bet paying some kind of fine is a foregone conclusion, but if you're really concerned about your kid not spending time in the clink, pay a lawyer to mitigate damages.

:yeah: I understand protecting the steelhead, but it seems very excessive for a first offense by a kid, if their was a history of the same offense I could see after 3 times you pay big time. I doubt the kid even knew that it was illegal or he wouldn't have facebooked it. This is a good example of unrealistic laws.

My comment isn't just directed at this specific case, but also at the WAC and the penalties under the RCWs. Again, we are at a point in society when it is possible/acceptable to be jailed for 90 days for holding a fish out of the water.

And not to thread drift too much, but there's a case in Florida where a guy released some helium balloons on Valentine's Day for his girlfriend and is being charged with a felony and could face up to five years, due to some environmental laws.

All the judge was doing was advising of the maximum penalty that could be faced. Makes no difference age, how many offenses, existing knowledge, etc.
A misdemeanor is a misdemeanor and the penalty range is the same for all.

I believe that the 90 days 1k fine is the standard MAXIMUM penalty for a misdemeanor. :twocents: They don't want anyone in jail that they don't have to put there. BTW the only thing the Skagit jail is currently taking are felons, DUI or Underinfluence druggies... It is quite likely that a $2-300 tax will be imposed on your kid.
FYI it seems that you fall into a special place with law enforcement. I have known a few people that have suffered what you are going through. As long as you make waves and call attention to yourself they will pay extra attention to you and your family. Not saying its right, but if you don't want extra drama don't make any additional drama. :twocents:

I am pretty tired of hearing this crap ..maybe you 2 might want to come over here on the 23rd and go to court with me and ted so you can come back here and let everyone BH45 is not full of sheet ...hell I will even give you gas money :dunno: ;) I can post at least 3 pictures of people who work for the dept ..HOLDING WILD STEELHEAD OUT OF THE WATER DOWN SOUTH ...Does this make it right to make a law and because your working for the dept makes it o.k for you to hold steelhead out of the water and then mention you caught it on a plug ! WTH I am not buying there BS !!!!!!!!!

If I'm mistaken, correct me. Didn't they only give your boy 1 ticket instead of a few? In other words didn't they let him off easy? I thought I remembered you posting that.

BH45 admitted to all of us that the internet was causing him too much trouble and that he needed to take a time out. He was going to quit posting for a while. He started a whole thread and everything saying how he was going to try and stay away.

I have known many people who have tried to push back at BS like what your Going through. If you REALLY want to do something about it it going to involve a great deal of $ and a really good lawyer. I don't disagree with the fact that it is a BS law. I just think that if you want to fight back at "the man" you'll have to think this through a lot better. Good luck

What's stupid about this is:
1) The law, to some degree. But it is a law whether we like it or not.
2) A kid making a somewhat unknowing mistake by gift wrapping the evidence of a law breaking incident courtesy of social networking.
3) The WDFW utilizing said social networking to generate revenue.
4) BH45's wandering into WDFW's watch list just often enough to be "watched".
5) BH45 starting the prior thread pointing even more attention to this incident of his kid.
6) BH45 starting this thread looking to lawyer up.
7) That the WDFW probably has knowledge of #5 and #6 since they lurk around here. Given your past "relationships" with the WDFW, they want your kid as a trophy on their wall, at your expense and anguish.
BH45, my unprofessional advice to you is to go clam on this. Ask that this thread be deleted. Try to find an attorney in the greater Mount Vernon area, via networking other than the internet. Get a consult from said attorney and move on based on that legal advice.
AND QUIT POSTING ABOUT YOUR WDFW LEGAL ISSUES, FOREVER MOVING FORWARD. YOU ARE ONLY FUELING THEIR CASE BY OPENING YOUR YAP.
And I mean this in the nicest way possible BH. I think your kid is getting railroaded for a BS situation. My gawd, he's just a kid. Slap on the hand and move on should have been the result of this.

This is ridiculous what they are doing to a youth, got to have better things to do. I turned a guy in for shooting at night with 3 letters from neighbors stating what happened and the 20+ year old never even got a ticket, did I mention it was on private property and within 100yrds of a house. They also had a spot light the kid hid and left behind. NOT EVEN A TICKET, at least make it a pain in his butt and make him go to court. My point I guess, they must just be going after him because it's an easy ticket for them, but I think they are going way over board. Good luck

There is only 2 things that make me do things like this ...1 is they are so worried about our native steelhead but the indians continue to net the rivers ..2 is they are telling me that they are worried about the slim on the fish and how it wears off if the fish is handled out of the water .... O.K Then , why are you So worried about how a fish in handled when a GILL NET KILLS THEM INSTANTLY ...and you are worried about a kid catching one (and releasing it ) and taken a picture to show his friends on facebook ...this is why I get so fired up about their endless BS....thats why posted this in our RIGHTS section ....Our rights are being peesed on ... :pee:

This is exactly correct. The judge is required to tell you what you are facing. If you get busted for no fishing license the judge will say the exact same thing, doesn't mean you are getting anything close to that. If you get busted for underage drinking the judge has to say $5K and 364 days in jail, because that is the max.

I have never been in trouble with the law.
This thread makes me pay even more attention to the details when out fishing or hunting so I am not on the wrong side of the law.
