Title: (update 8/9) Form 1 SBR approvals starting to show up!
Post by: sooperfly on August 06, 2014, 09:55:27 AM
Contrary to what some people have been saying, form 1 SBR's (short barreled rifles ) applications are now showing up as being approved.  There were quite a few people in different forums posting because of the way the wording in the law, a private person was not going to be able to register one on their own with a form 1.
Well, here's proof, at least for these folks, that was not true.

If you read the copy of the form that he is talking about, it was not for an individual:

Would the fact that he set up a trust make a difference between marking corporation instead of individual?

From my understanding, no, it wouldn't make a difference.  One of the reasons to do a trust is to bypass the CLEO sign off requirement that doing it as an "individual" requires.   ( There are  many other reasons people prefer to do it as a trust )

I guess I should have worded my explanation better.  A lot of people were saying nobody ( no individual, trust or corp ) was going to be able to do a "form 1" and make the SBR yourself.  They read the law to say that nobody could "make" the SBR in state.  For instance, they read it to read you could have a dealer bring one in from out of state, and sell it to you on a form 4.

These approvals show that yes, in Washington ( at least for these folks ) a form 1 to "make" an SBR is legal and approved.

Forming a trust is by fare the best way to go.  The Law Enforcement signature route has a lot more restrictions after you get approved.

Ok, more interesting stuff... Good read on ARFCOM.  Some conflicting info with the ATF now.  Either way I think the next legislative session is going to do some house-cleaning and clarification with the SBR bill.   Guess we'll have to wait and see.
