Title: Think I 594 won't make you a felon think again.
Post by: csaaphill on August 15, 2014, 10:18:19 PM
I came across this while searching for court decisions against our rights, but thought it interesting all the same.
http://www.supremecourt.gov/opinions/13pdf/12-1493_5468.pdf (http://www.supremecourt.gov/opinions/13pdf/12-1493_5468.pdf)
Too big to really post all the text so please load it and read. I didn't read the whole thing, but read enough to get the gist of it.
Buy a gun and give it away or resell you've just committed a felon.
One case where the Courts could of ruled in this guys favor but didn't because to do so would have unraveled 40 years of infringements!

Some people have a hard time understanding what Shara B. and Obo meant when they said "under the radar" :dunno:

There are only three types of people WE need to educate, The LIV's, Gun owners who vote for Democrats :yike: and THOSE who refuse to vote because they don't think THEIR'S matter!!

This is the reason that for the first time my wife and I are considering moving 20 miles across state lines into Idaho. If this law passes I just don't think I can live in this state anymore.

This state gets tougher and tougher.  Someone asked me about longer term plans the other day, I had to say....I'll get back to you in November.

Our daughter lives in Pullman. I work from home. ID might be an option for us. Winter is a real deterrent, though.

Don't think it will matter if you read the pdf it's a federal law not just state so my point is do all you can to defeat this.
But more importantly to educate you on what is out there. Notice this man was and postence now but was able to pass the background check and so was his uncle but he still has a felony now!
Notice too how much red tape you would have to go through if you put in as no your not the one whos taking possession. No matter what people on the other end say don't buy it.
also notice how much of a database forms 4473 really are.

This has to be a step twords registration. HOW can they prove you didnt aquire a gun privatly BEFORE the law was inacted?. HOW can they prove that my my gun is in my fathers safe because he is storing it for me?

Stupid!  :bash:

I like the winters in Pullman.  Very rarely did you have enough snow that getting around was difficult.  It got cold, but it was also sunny all the time.  I wouldn't let that stop you unless you just hate cold weather and prefer rain.

I would imagine it will be difficult to enforce unless they catch you in the act or there is some record keeping requirement that goes along with the requirement to conduct the background check.

Bingo

This will never work without forever records of transfers.
They want to make it so tuff to own a gun that people will just stop.
This has to be shut down or the door will be forever open for stricter  and stricter gun laws in this state.
Every single one of us has to sit down and take the time to explain to anyone we meet what this means.
Every member of our family and friends need to be on the same page to vote no on this.
Before they are done I bet they throw 10 million at us. If we can kill it that will be a real sting on the anti.
Get to work now.

Part of the "other" real problem with this law is the implied consent of the governing agencies to enact rules covering enforcement. There is currently too much delegation to agencies by the Legislature and is currently acceptable. How much do you thing the gun grabbers will buck the status quo?

If this initiative passes the anti-gunners will be hammering the courts to get their interpretation of the law enforced.

That supreme court case is pretty amazing. I believe i read a story on it a while back. The "Original" buyer was a cop and bought the gun at a LEO discount then sold it to a relative. He screwed himself because he took it to a gun shop to do a transfer and sold the gun to his uncle as i remember... Just and other example of how people trying to do the right thing get hammered and bad guys get away with a bunch more.

Yes exact case this is his appeal all the way to the supreme court!
Notice how they ruled against him even though he made a plausable defence just for the fact it would have undone all the Gun Ctrl since 1968 gun ctrl act!

Curious as to how this would relate to buying a gun for a wife, kid, or other relative or friend as a gift? How about as a raffle prize? Could be some serious implications there for NRA banquets and gun raffles and such.

This case was used to keep people in check. This cop got screwed because he tried to do the right thing. By providing all the documentation against himself. This case shows it's safer to remain anonymous  or silent. Years of bad decisions and case law depend on conformity.

Well were screwed in more than one way if this thing passes and the antis know it.
I'm sure the lawyers and lobbyists for these groups have already looked at these exhisting laws and know how easy it is to make us felons with this law I'm sure!
