It's legal if it's not being used to attract bears to you.

KC, if you use a cover scent that smells like food, like apple or acorn or any smell that a bear would like, it can be considered an attractant and as such a game warden could give you a ticket for baiting. It is up to the game warden to make the call and most people would err on the side of caution. This is what I was told by a local warden that I know.

"bait" means a substance placed, exposed, deposited, distributed, scattered, or otherwise used for the purpose of attracting black bears to an area where one or more persons hunt or intend to hunt them.

If you are using a scent to attract a bear then you are violating the law. If you had some type of scent (such as an apple scent) that was used to attract bears then you are "baiting." Something edible doesn't need to be placed.

Now like all bear baiting cases, the officer needs to prove that you are using the scent to attract bears.
