Ok so wife and I are taking about getting pistols she wants one for protection for when she is alone at a park or somewhere with all 3 of our girls but we keep trying to look up info on the concealed permit do u need the permit to buy a pistol and what is the purpose of the permit any Info would be nice thanks for your time
-
Get a CPL. $55 for 5 years.
-
You do not need a permit "cpl" to purchase pistol. You will have to wait for the background check to clear without one though. If you have cpl first you can take it home the same day you purchase the pistol.
-
You don't need a permit to purchase or own a pistol. In most instances you do need one to carry it concealed.
The RCWs are found here, especially the RCWs from 9.41.50 through 9.41.75 for concealed carry: http://apps.leg.wa.gov/rcw/default.aspx?cite=9.41&full=true
-
Ok but what is its purpose tho and do u need it to be able to buy a pistol
-
And the purpose is to conceal carry the weapon. In the waist band, purse ect. I would recommend getting one either way you decide to purchase. I'm LE and even though I'm not required a cpl to conceal carry I still have mine.
-
Ok I see so pretty much it helps make background checks faster to take home same day and if u have the concealed it make u have the right to have it hidden under ur coat ect... And to make it clear if u don't have the cpl you have to carry the pistol in open sight right
-
Correct
-
Ok but what is its purpose tho and do u need it to be able to buy a pistol
It's purpose is to be able to conceal your weapon. Your wife could not put her gun in her purse, nor wear it on her hip under her wasteband, it must be visible at all times (most cases like Bob said). Also, cannot have it loaded in her vehicle.
No, you do not need it to buy a pistol but I would highly recommend it.
-
Ok thanks everybody
-
Ok one more thought without the cpl can u have it loaded when it's in visible sight like if wife went for a jog but I know u can't have it loaded in the rig
-

Yes it can be loaded when in plain sight attached to your wife.
You really should get a CPL.....it just makes life easier and takes out all the questions. You should also probably take a basic pistol class that will answer this and a lot more questions that you are bound to have.

RCW 9.41.060 Exceptions to restrictions on carrying firearms
The provisions of RCW 9.41.050 do not apply to:
(8.) Any person engaging in a lawful outdoor recreational activity such as hunting, fishing, camping, hiking, or horseback riding, only if, considering all of the attendant circumstances, including but not limited to whether the person has a valid hunting or fishing license, it is reasonable to conclude that the person is participating in lawful outdoor activities or is traveling to or from a legitimate outdoor recreation area
I don't know if going to the park qualifies, but it is an outdoor activity in my book. I doubt if many Law Enforcement or Wildlife Officers are even aware of this law. Go butterfly watching, carry loaded and concealed from time you leave house, in your vehicle and until you return home. Jogging would qualify.
-
Just get the permit and be safe, don't listen to any of these "gray" area legal tips being thrown around on here. It takes about 30 days and it's just a quick application and fingerprints.
-
:yeah: just get it. You will both be happier with it. Now what carry guns are you two looking at?
-
I agree that the CPL is the way to go but there is nothing "gray" about the law I quoted and I have talked to the WDFW attorney regarding it. Dumb law but there are others just like it on the books.
-
The only problem is that outside of DNR/DFW and some Parks Officers, lots of conventional LE don't know or understand the exceptions. And few like a good argument, even when you are right. A CPL makes everything easier.
-
Yup just easier to pay the tax and submit to criminal-like treatment from the government before you exercise your right.
-
Concealed Pistol License (CPL) allows you to carry a loaded pistol concealed under clothing or in a purse. Pretty sure it allows a loaded pistol in your vehicle. No seven day waiting period when purchasing a pistol.
Without a CPL you can open carry, pistol in your vehicle if unloaded and heading to the "outdoors".
I have a CPL but still don't carry just to make things easier, don't even carry loaded pistol in the truck. Just takes the gray area out of the equation if I do get stopped and my pistol is in the truck. Also got it because I get a few jobs in some shady parts of town and was reading about a lot of shootings, still think about it now and then.
-
I highly recomend this pamphlet however im not sure where you can purchase a current one.
http://www.amazon.com/Washington-State-Gun-Rights-Responsibilities/dp/0967231329/ref=sr_1_3?s=books&ie=UTF8&qid=1461735139&sr=1-3&keywords=washington+rights+Dave
I have a copy floating around some where and its great on ALL use of force in this state.
-
The cost of the permit comes out to $11 a year, cheap to avoid any problems down the road, plus you get to take your handgun home with you right after you get a "PROCEED"on the back ground check.
After you get your Washington State concealed pistol permit, get a non-resident Utah pistol permit. I covers you to carry in about 26 different states if you travel.

Without a cpl, you can legally conceal carry while loaded in your vehicle while heading to the outdoors (because of the exception in the RCW ).

Get the permit and sign up for some tactical training with your wife, she will enjoy the time with you and everyone (myself included) could use more training.
-
sign up for some tactical training with your wife
:yeah: Proper training IS as important as legally carrying :twocents:

Training and regular practice is the most important thing. Too many people have way too much confidence in their ability to safely use a firearm. IMO, you have no business carrying if you haven't taken a basic firearms class and practice regularly with the weapon you are carrying.
This post should be moved out of the classifieds though...

The "considering all of the attendant circumstances, including but not limited to whether the person has a valid hunting or fishing license" makes it read as though it's not black and white. Does the wife have a hunting or fishing license? Does she want to risk arguing with a cop her intent while driving on whether or not she's going to a lawful outdoor recreational activity? Jogging and going to the park aren't listed. I wouldn't risk that when it comes to a loaded firearm in my possession and dealing with law enforcement.

I also think the definition is vauge and is asking to go to the court house to explainyourself to try and get your pistol back.
I think partly the way its worded is for some kind of circumstantial evidence. You have the proper gear and attire for hiking or mushrooming. Where you say your coming from/going to is associated with the outdoor activity your explanation gives.
If you know your laws you wont have trouble in most places e wa. You would likely have a tougher time in snoho king pierce counties. 2c
-
Well, it definitely could be left up to an officer's discretion especially in determining if the person is traveling to an outdoor activity, and like pointed out before most officers probably don't know about the exception so you could set yourself up for scrutiny.
But I still think I know what it means how it's written and I do carry concealed while traveling to or from outdoor activities (scouting, hunting, fishing, and hiking).
-
The law clearly states..."not limited to whether the person has a valid hunting or fishing license".

This is one of the worse places to get advice about carry laws in Wa.
These guys walk the walk every day. And there is a ton of good info here.
The sticky topic at top of page will answer all your questions with the correct answers.

This is why folks get confused.
If you have a CPL, your firearm may be any where in your vehicle loaded as long as you are present.
If you leave your car and your gun loaded in your car,the car must be locked and the gun out of veiw from the out side.
As noted in the law below.
2)(a) A person shall not carry or place a loaded pistol in any vehicle unless the person has a license to carry a concealed pistol and: (i) The pistol is on the licensee's person, (ii) the licensee is within the vehicle at all times that the pistol is there, or (iii) the licensee is away from the vehicle and the pistol is locked within the vehicle and concealed from view from outside the vehicle.
The Attorney General of the State of Washington ruled on this several years ago.
i=or ii= or iii= or
The loaded gun does not have to be on you. If you are in the car. :bash:

Apparently I need to review the laws again.
Something else confusing, isn't having a loaded firearm in your vehicle while hunting illegal? Or is it just a loaded rifle, loaded pistol okay with a CPL?

That is a game law.
Which states loaded rifle or shotgun.
I have never had a game agent ask about a loaded pistol.
They don't ask because they are checking your compliance with Game Laws. CPL isn't any part of it because by checking you they are confirming they believe you are involved in Out Door Activity. Which exccempts you from needing a CPL.
Don't confuse Game Laws with Firearm Laws. :twocents:

Here is a good book by a member of this forum.
The book was printed before 594.

I wasn't looking to stir up an argument, even though the laws you stated are valid it is much easier to avoid this confusion if you are confronted by an officer that doesn't know all the laws (which happens quite often it seems like).

Carry around the Constitution. That's the real law of the land. The 2A.
-
I agree with what others have said. Both you and your wife should obtain your carry permits. It's relatively cheap, easy and eliminates any future problems. After that find her a gun that fits her and works for her needs. Don't just go buy her any small "girly" gun. My wife shoots my Glock 19 better than any other handgun she's tried. Smaller isn't always better. Once you have the permit and the gun SHOOT it and often. Just like anything else practice makes perfect. When it's life or death you want to be as close to perfect as you can.

Quoting, by definition, is selective. :)

If your a lawyer, and have plenty of time to hang out in court (a place where you can't have any firearm) than by all means don't get the CCL. however if your not, it will cost you more than the firearm that your trying to get back is worth. You can interpret the law anyway you want, but in the end the cops don't care and most judges don't either. Get the CCL's and be done with it.
IT'S NOT THAT HARD TO FIGURE OUT!
-
Yep. Or move to a state like Arizona where the gun laws make sense and they don't require a concealed carry license.
