Title: Trespasser On Cam
Post by: Bango skank on December 06, 2016, 04:55:23 PM
Ill keep this brief.  Last year this guy shot a buck on my land, ran away when i tried to confront him, then refused to return my call for 2 days, at which point i sicced wdfw on him.  After wdfws visit he called me, and i told him everything would have been fine if he just would have returned my call, even after running away when i tried to confront in person.  Fast forward to today, i arrowed a buck that ran across the property line, so i called this dudes inlaw who actually owns that land, and i was told to pound sand.  So now im putting this guy on blast.  His name is chris anderson, and he thinks he can hunt other peoples property, and not even be honest enough to call them back after the fact.  Im not naming his father in law, cause the old man only heard one slanted side of the story from a sneaky rat.  Cant blame him for standing with family, but chris anderson, from colville/addy area is a disrespectful sneaky rat with no respect for private property, and obviously no respect for basic laws like hunter orange, which he got ticketed for.  Hi chris, you on here?  Lets have a public conversation.  Theres a dead buck on your wifes dads property now thats going to waste because you told him a b.s. story.  Chris is the entitled *censored*bag on the right.

Id like to add that when i ran up the hill and caught tgem running down the property line, they didnt know i was there, and i heard chris say to his companion that "i guess this is where we need to put our stands."  He was discussing intentionally hunting my property, or at the very least the property line.  This guy is a sht heel.

No idea what edge is, but i made a call pretty high up the lical wdfw chain and explained the situation, and was told that deer is coyote food and my tag is still valid.  So i guess ill put on triple layers and get back to my publuc land hunt, cause im sure as hell not putting an arrow in another buck here.  What burns ny ass is that i saw the arrow go in the money spot, it passed through and is sticking out of a stump covered in blood.  The deer is certainly dead less than 100 yrds from the property line, but theres nothing i can do about it without lowering myself to CHRIS ANDERSONs level.

I would hang his ass. This day and age you should have the GPS program that tells you property lines. If you catch him once maybe let him go< tell him and catch him twice BIG FINES

The wasting deer sucks,The neighbors disrespecting each others boundaries sucks.I too would go after him every way i could if he was caught on my property again. All that being said,It is never a good idea to hunt so close to private property that access has not been secured.I'm sure that wasn't a wanted reply but facts are facts.

I didnt post my property line, being the new guy in the neighborhood, i wanted to give them the benefit of the doubt and not come off like an ass.  Big mistake.  Despite the fact they had their land flagged with surveyor ribbon, i couldnt prosecute for trespassibg since i wasnt posted, hence CHRIS ANDERSON getting a ticket for no hunter orange in the pic.  This year you can see the line of yellow signs from space.

I have 21 acres and shot the buck in the center of my property.  I guarantee its dead within 100 yards of the line.  What minimum acreage would you recommend a guy own to legally hunt?  Lets make a law that you cant hunt on a property under 100 acres?

I was going off what you said to have been a great shot lots of blood all the way thru into a stump and no more than 100 yards into neighbors property.now your saying that the deer went 5.0 acres to the property line plus maybe another 100 yards no more.lmao which is it?

My property is longer than wide.  I left the bloody arrow in the stump.  If you doubt me youre welcome to come and ill show you the arrow, still in the stump, and walk you to the property line.

350 yards plus is the line of travel to cross the property line from the center of the property assuming 5 acres on square.  But this isn't the thread for this.  I think you would get more mileage out of this Chris Anderson witch hunt as a separate thread in addition to this one.

is there a deer rotting on the ground? yes
              is it your fault?yes
why are you on here trying to get people to see your way?the fact is you shot a deer that in most hunters mind was to close to property line, because you didn't kill it in a location far enough from that line and the deer crossed it and laid to waste.you took a shot that you ethically should not have taken for the simple reason that the job did not get done and the deer is wasting.accept it!

WRONG...a 5 acre square is 467 ft. x 467 ft. ( actually 5.01 ac.) That makes it 155.67 yards wide....From the center of the property it would be 77.84 yards to the line. Typically a 20 ac. parcel is 1320 ft. x 660 ft. (not all 20 ac. pieces measure this ) If it is a "typical" 20 ac. parcel from the middle it would be 330 ft. or 110 yards to the property line. Correct me if my math is wrong. And I CAN'T STAND Trespassing pieces of schit. I've heard every excuse.   Bango---is Chris Anderson related to Dan Anderson the retired Game Warden from Chewelah??

He said that his property wasn't posted so it would have been hard to convict.  He was the new guy in the neighborhood and wanted to see how things went the first year or something like that so he didn't post it.  The guy was obviously trespassing but the only thing that they could prove for sure was no hunter orange so that is what they did the ticket for.  He says his property is now posted well.

I think it is tougher to get a conviction if it's not posted.  I know it is already tough to get a conviction for wildlife crimes even with an open and shut case.  The ticket for no hunter orange was a no brainer and an easy way to send a message that they were in the wrong.

:yeah:

Many prosecutors do not like to prosecute trespass cases if the land is not posted. If it were up to prosecutors, the law would require posting.

Well, the law actually says it's only considered trespassing if the land is fenced, posted, or cultivated.

The no orange should have been easy to beat in court though, if they are just basing it on that trail cam pic.  That pic was taken after he was done hunting thus no orange is required.  Maybe his hunter orange vest is crammed in a pocket.

Number one, I think everyone knows that he didn't have permission from the new land owner to be there.  He may have said that he had permission from the old land owner, who knows.  For some reason the officer didn't write him up for trespassing.  There could be a lot of reasons for that.  The officer onsite needed to do something to appease the landowner that felt wronged by the trespassing and charged the trespasser with not wearing hunter orange.  My guess is he felt that there was enough evidence to charge and make the charges stick on the hunter orange.

Of course all of this is speculation, none of us were there.

People need to understand that there is what the law says, and then there's what prosecutors want. The law may say you can't do X, but the prosecutor may say "well...is all they did is do X and nothing more??"

I typically patrol a couple counties and I know in each county there are laws that prosecutors will and won't prosecutors. Heck, the Snohomish County Prosecutor has listed on their website which offenses they will not prosecute.

The hunter orange ticket is just that a ticket, trespass is a misdemeanor and not a ticket. Hunter orange is an infraction which is basically between a parking ticket and a traffic ticket on the level of importance or severity.

Did you really expect a "bang flop" after arrowing the deer?  Did you really expect this guy to be the bigger man and let you retrieve "your" deer after last year?  You took a known risk and it didn't pan out and the result is a wasted deer.  It's absurd that going into the hunt, you expected permission to retrieve your deer from a known trespasser that doesn't respect others properties.

Is there a difference in the WAC from just plain trespassing to trespassing while hunting? Don't have time to look it up but I thought that the trespassing while hunting the property didn't need to be posted or anything.

All it takes is a photograph for a ticket to be issued?

How do you prove that it was even taken in Washington?

So with the new law about trespass while hunting is that a separate law or just a separate punishment?

So if a county won't enforce no trespassing then does that mean they won't enforce the wildlife portion of it?

Separate law with virtually the same punishment. Both are misdemeanors. The only difference is that the trespass while hunting law is a wildlife violation which gives officers the ability to seize the gear and game, as well as possible license suspension. Plain old trespass is not a wildlife violation so officers couldn't seize gear and game if trespass was the only offense committed. This is why WDFW pushed for the law. You had people shooting big bucks and bulls on private land without permission, but as long as they didn't violate a wildlife law (season, tag, etc) they would keep the animal.

As far as your county question, that is really up to each individual prosecutors office. Some may take only the wildlife trespass law, others may just want the 'general' trespass one, and others it won't matter.

i couldnt prosecute for trespassibg since i wasnt posted, hence CHRIS ANDERSON getting a ticket for no hunter orange in the pic.

All it takes is a photograph for a ticket to be issued?

How do you prove that it was even taken in Washington?

Cary on.
My guess is when the officer confronted Mr Anderson about trespassing a question was asked about "where was your hunting orange?" and Mr Anderson didn't give the correct information.

Again all speculation.

Or wishful thinking by the OP.

Knocker- The trail camera photo with date and time stamp clearly shows two guys with rifles dragging a buck out.  One with orange, one without.  I don't follow how that is wishful thinking by the OP.

If the guy who killed the deer is the one without orange, then he'd be legal. Notched his tag, he's no longer hunting. Must have been the other way around.

"What if", Anderson could have said he wasn't "deer" hunting but coyote hunting or just exercising his open carry rights? Is there a requirement to wear orange coyote hunting? We know there's no requirement for open carry. He was protecting his friend from having someone try to steal his deer.

If there was a modern firearm deer season open, the answer is "yes."
