Us westsiders politly asked him to go east... and he abliged be cause we dictate were he guides. :sry:
-
Out of curiosity, may I ask what he did to leave the sour flavor with you guys?
-
There may be some older threads on here....do a quick search maybe....
-
is this the same that bearpaw asked the forum to not talk about due to legal threat?
-
Same person yes. There is, was, a thread. Let's say his reputation is not the best.
-
-
Air it out......

:yeah:
-
dumb question, why did all the post's get edited?
-
Wait a second why did my title get censored

I can't seem to find much info about this guy. Found a webpage that makes it seem like he goes through a lot of effort to keep negative reviews buried deep. I'd sure like to know the negative aspects of a "known expert/guide". Goes to show you never know who you share the outdoors with.

Looks like the mods have struck, without giving explanation :chuckle:
-
i think it was explained last time it came up.the outfit in question made it clear with their intent to sue the forum or members for slander. Bearpaw asked that their names did not come up.he is still a member on the forum i think.
-
How is it slander by just bringing up the outfitters name. I didnt say anything bad about them i just said keep him over on the west side
Sent from my SM-G935V using Tapatalk
-
They're simply staying out of it in my opinion. These days everyone is sue happy and no one wants to end up in a long drawn out case.
Sent from my iPhone using Tapatalk
-
If they are staying out of it why did the change the title of it
Sent from my SM-G935V using Tapatalk

Really?Because you put a name in it that's why.
-
Emac has said absolutely nothing against the outfitter. He's concerned with more land getting swallowed up.
-
Sorry to mix chemicals guys, being new to the forum I didn't know I was striking a nerve :sry:
-
Really?Because you put a name in it that's why.
And whats wrong with putting a name. People do it all the time. The name has been put on this forum numerous times.

Completely surrounded by private ground. Actually land locked by other land owners. Will have to get an easement

I dont need to buy the land and i wouldnt pay what he is paying for it.

Heres how I see it - if this guy goes to such lengths to keep negative reviews under wraps he is no one that I want to do business with, nor will I suggest him to someone else. If it was only one or two guys, well not everyones going to have a great experience OR going to have the same definition of 'great experience' as everyone else... but when a ton of people are trashing you, well, theres usually a reason for it.

You don't want to buy the land ,but don't want him too, well your just gonna have to deal with it,eastsider deal with westsiders all the time,
Your SOL that's how it is ,keep a eye on property lines, along nobody's tresspassing then he can do what he wants.Ranting here is not gonna help you.

To cover there 6. The guy has already tried to go after a forum creator and threaten lawsuits

I could care less who buys the land. But when someone with his reputation buys it, thats a different story. Pretty sure he has worn out his welcome in one place so he is moving on to another. This is no secret.

you're ranting and raving about someone who can do what you can't and i'm stirring stuff up?Wow,Why isn't this in the off topics so people can tell him how it really is?It doesn't really matter why what matters is DALE AKA BEARPAW DOESN'T WANT IT AND THAT'S THAT.
-

I just think BP would prefer to not having to hire a lawyer and head off to Superior Court, likely in a differnt county than his own, to defend what he asked posters not to do.
-
The name of the outfitter was *censored* out of the title from all the first few posts. That is the only thing that was change. Lawsuits have been threatened in the past and many threads were cleansed of the outfitters name. Before this new thread could get out of hand and new threats of lawsuit could get underway I proactively censored the name out.

Just monitor your property. Signs, cams etc. If you catch him doing something wrong then have good evidence and turn him in. Advise your neighbors to do the same. Make sure he knows you guys are watching him.

So in other words.....
If we see an outfitters business or personal name on this forum, that's a good thing but no name ever mentioned is bad?
-
Looks like the mods have struck, without giving explanation :chuckle:

From what I understand, he bought or leased the property directly across the canyon from my inlaws.

I am not sure if I would say that is 100% correct.
I think it's up to each individual to decide what their opinion of an outfitter is. I doubt that there is any outfitter in the state that has made every customer and individual they encounter in the field 100% happy. Does that make them a bad outfitter? Not necessarily. If there tends to be more bad interaction than good or pattern of bad behavior starts to show then you have to decide for yourself if you think they are a good or bad outfitter.
Everyone can have a bad day, when it becomes the norm, that is when buyer should beware.
-
It seems the best way to get honest information on any particular outfitter, would be to post on the forum asking for opinions, and request that people send those via private message. I don't know, it does make it rather difficult to get information though, when you're not even allowed to post the name of the outfitter. :dunno:

:yeah:
I started on this forum looking for information about a certain area. It is frustrating that because of threats of lawsuits what I think is valuable information can't be shared openly. As a business owner I can also see the other side of not wanting information out there that would paint my business in a poor light.
Of course I would work to improve my appearance versus threaten lawsuits but everyone has a different way of doing things.
FYI the private message option is a great solution to all kinds of things on this forum, hunting spots, outfitters and taxidermists.
I surfed around looking for information and then a member a pm saying "I see you are located in "x" and have some knowledge of GMU "y". I am thinking of taking my kids there any tips of locations to start poking around?"
The same could be done for outfitters and taxidermists.
Like I said above it is frustrating that it has come to that but with the threats of lawsuits the PM is a viable way around it.

Just prolonging the inevitable. Look at when everyone tried to keep the Michelle Nelson Taxidermy stuff hush hush. Threads were deleted, people were told not to mention the negative stuff, etc... It probably resulted in other members getting screwed over by her. Eventually the truth surfaced and HW stopped trying to protect her. I can see the similarities with this outfitter and everyone tippy toeing around the subject.

We're not trying to protect anyone. The forum has been threatened by lawsuits from this guy multiple times. Unless you want to fire up a savings account to assist with lawyer costs, please try and understand. We don't have the budget to be dealing with that so this is the best we can do.

Sounds like you are trying to protect something. That being the forum and its members. I'm not saying what you guys are doing is wrong, but it certainly isn't helping with the potential truths and experiences surrounding this outfitter. By all means do what Is needed to ensure you CYA.

Ya, I guess you could say we're protecting the forum. Until this place takes off and we all become millionaires off the proceeds, we'll do what we have to do.
It's weird to me that the Michelle Nelson thing comes up and not other topics that actually did bring threats of lawsuits.

Keep the money flowing in and you admin will be the next millionaires of WA. ;)
I just brought up MNT because it was an example of a poorly run business not getting the proper publicity to prevent future customers from getting screwed. I am unaware of the HW inner circle lawsuit threats.
-
I agree Miles. There's probably a way to wordsmith the review of the outfitter in question to keep any legal claim baseless and give other members a heads up.

The business my relative founded bought up a chain of shops that after the founder passed away the sons, actually one son, had, over a decade ruined the reputation on. They ran it under the old name long enough to clean up the image before rebadging them and bringing them under the corporate umbrella.
-

I am sure there is and in reality this thread didn't take off like others in the past. I think we are a little gun shy right now and want to make sure nothing flares up. Because of that I would be very careful of how anything about said *censored* guide service gets presented.
There are two big problems with threads about this particular outfitter. Number one and most important is it puts the site owner in a position, right or wrong, of having to possibly defend himself legally.
Number two is threads like this have to watched by the mod team more than other threads so that a tight leash can be kept on comments to prevent the number one problem, a lawsuit, from happening.
It then becomes a risk versus reward. Is it worth having the chance of a lawsuit and the extra mod time on one particular thread or is it easier to just lock it or delete it?
-
What exactly is the threat of lawsuit by saying X outfitter is buying land in NE WA? There is nothing to sue for. Nothing bad was said, no accusations, no opinions, nothing that potentially can harm the outfitters name or reputation in any way :dunno:

It's the spinoff from his name being mentioned that would result if names were mentioned. It's not worth the time Dale or the other mods would have to spend or the potential financial risk to him. We're not taking that chance, so let it rest.

I hear you can tell them apart, no two are the same. Wait a minute, I think that only applies to snowflakes, no two snowflakes are the same. Snowflake crap I am not sure about. Hopefully someone with some knowledge of the subject can chime in. Since this is an informational site and we can't get information on a certain outfitter maybe we can get educated on snowflake crap. :chuckle:

A bit about Snow Flake crap.
Snow flake crap is real. The reason nobody sees it is because the flakes defecate at the beginning of their fall. Since the crap is heavier than the flake, it falls faster. Lightening the load of the flake allows it to drift downward more slowly, thus covering the flake crap prior to people seeing it. The moisture from the first flakes that cover the crap dissolve the crap. This happens continually through the snow fall so no crap is seen. And by the way, snow flake crap is white. And there you have it.
Now, the "people" referred to as snow flakes spew crap that I don't understand.

Well, I won't sue you for calling me names.

The reason why they call those angry bombs is because that combo is a hangover maker. I had 1 last summer on a hot day... and I mean just 1. I woke up the next morning with my head hurting more than a weekend bender!

OK enough is enough!
Some of you people just have to make things hard. I get threats of lawsuit just about every month by someone who claims their business is being harmed by members who post damaging remarks on this forum. I don't have the money to layer up on all these threats! So we have removed topics when lawsuits seem likely. The person who was the subject of this topic has a lot of history and I have received lawsuit threats from a hired attorney. As a result I removed topics or censored out his name to avoid having to go to court.
Sometimes these negative claims are truly valid claims, the business might have been unfair to the customer, but sometimes the problem is an unrealistic customer just looking to cause a reputable business as much trouble as they can because they didn't get their way, it might be totally unfair but by golly they want to cost the business owner as much as they can. Another common issue is heresay, sometimes people spout off in a negative manner without even knowing all the facts. Other times what you read is a truthful review and it's a good thing you heard about the shady character.
How much do the untruthful statements cost honest businesses? How many people are ripped off by dishonest characters or businesses? How do you know what's true and not true? This is the world we live in today, especially with social media.
I have tried to avoid getting mixed up in a lawsuit but you all want to be able to post comments so here is the fairest way to deal with this:
ALL MEMBERS
Going forward you are welcome to post negative comments and reviews about this person or any others if you put your name in your post. That way you can receive the lawsuit letters! Let's face it, if you post on facebook your name is there, so man up and put your name with your negative review.

I have already been threatened by Shane on Facebook. Told him to bring it on, and I've never seen or heard another word from him ever since.
I'm told by people that were close to him that he has a draft letter all written up that he sends out to people and threaten lawsuit of slander, It's a letter that he wrote up himself to scare people from saying anything negative about him.
I don't give a rat's behind what that guy thinks, he has crossed and screwed over plenty of people that have posted clearly on public forums, and Facebook with names and dates.
I personally know of a gun that he borrowed from somebody and would not give it back, had it for over a year and as soon as the person posted on Facebook about the situation he returned it the next day.
So yes this guy is scum.

You are welcome to edit your first post and put the name back on the title, if you add your name to the post. If you don't know how to edit it yourself, reply back that you want the name put back on and you accept all responsibility for your remarks, and I'll add your name and his name!
The same scenario applies to everyone, add your name to your post and feel free to say what you want. If you need help, reply back in this topic with your name and that you accept full responsibility and we'll add whatever you post to your original post.
I don't post anything about anyone I wouldn't say to their face. Therefore I am who I am and I am not that hard to find.

For all future posts where I state my opinions, my name is Russ. Moderators take note and don't even think about touching that ban button, I will be exempt from everything except lawsuits. Lol
No sorry you can't use that name. To confusing now :chuckle: :chuckle:
If you get any letters from lawyers that are for me, please shred them immediately.

Shane is not the guy in question on this thread. Different guy.

I only included my name for a laugh. Does me asking the guys name require I post my full name? Don't punch me in the face jack. You'd get a stern letter. :chuckle:

Boy, Dale really derailed this thread. :chuckle:

Ya I may have been a problem, but sometimes they have bid sheets for jobs and nobody will sign them,so we just fill them with fake names so our supervisor get a laugh.that was as dirty as it gets I got a lot of clean ones too.

You'll have to ask Dale. I'm pretty sure he's not kidding. If you plan to slander a business or a person, be prepared to take responsibility for it. Why would Dale or the forum be responsible for your actions?

I think he means how would you be sure people are providing their true name. I could be wrong though.
Horrible example:
Bearpaw outfitters promised me a 300" mule deer and I only saw one spike.

Out of ignorance, it's easy (speaking for myself) to not understand what the risks and or consequences could be of what we would call fun. I'm not talking of slandering a business for "fun", I mean to dance around the guidelines of what has been laid out. I for one really appreciate this forum and this "community". I apologize for any unneeded BS. It would be interesting to know what the real rules and risks are with the owner of a forum. Does the owner of Google or Facebook have risk for what is posted? Also, in the event that a lawsuit came up for something as dumb as people voicing their comments on a person and Bearpaw was sued....... in all seriousness, I'll donate the first hour billed by an attorney.

From what I have been reading,If you are a real customer ,with a negative or positive review there's not much legal right a bussiness can do about your review of service. But when you give false reviews or just don't like them,so give negative reviews of a bussiness, without being a customer, then u can get in trouble.so I can see bearpaw concern for the legal rights of the forum.

My guess is when someone decides to step up to the plate and name this outfitter again and make claims about him there will be another lawsuit threat. At that time Dale can provide the lawyer the name of the individual making the claims, the screen name, the email address and the IP address. The lawyer can take it from there and that individual will then have to respond.
FYI this guy isn't dumb, the law firm that he hired and the lawyer in particular specializes in this type of internet stuff as I recall from my search on them. With the information that you have already given to be a member of this forum they will have no problem tracking you down.
What I still don't get is why people want to talk about this outfitter or the other few that come up from time to time and put the forum at risk of a lawsuit. The owner has asked to let it go and people continue to bring this stuff up. Then when he gives them a way to do it they complain about that and don't want to follow those rules or shoot holes in why that won't work.

The forum already has the right to disclose your info. They don't need permission any further. I say bear paw just makes it known he will disclose info on any posts that attract a formal complaint legal or lawful action. They really don't need to post on the open forum for the mods to send the info to the plaintiff.

It should be noted that all outfitters suck when individuals are in a situation to have to compete with them in the woods.
They do it for a living.
Most others do it for a hobby.
Is the outfitter's name...............................................................HillRwe Clinton?
-
Well now that we got all that out of the way. Back to the original post. I can understand your frustration with someone buying the land, but it was for sale to anyone that wanted to pay the price. I have overpaid for property next to me because I didn't want to have to deal with a problematic neighbor.
My guess is knowing what you know now it may have been better to overpay for this piece of property and control who uses it versus having someone else overpay for it and you have no control.
What did he overpay? $200 an acre/$60,000? Over the next 20 years that is $3,000 too much per year. Is it worth $250 a month to not have to deal with this outfitter? To me it would be.
A piece of land is worth what somebody is willing to pay for it and they aren't making any more land.

For some individuals who fancy themselves a some kind of modern day Sampson by making a habit of beating their chest while hiding in the shadows and sniping at others, I can understand how any threat of losing anonymity in ANY open forum to them would be akin to Sampson losing his hair.
-
Well now that we got all that out of the way.
He paid roughly $1k an acre if he bought it. I don't know for sure if he bought it or leased it.
-
He can sue all he wants, it will never hold in court. Simple.
Speaking in general terms:
A Litigation Bully, uses litigation (or the threat of) to get what they want. It costs a lot of money to defend oneself even if the outcome is all but certain. So no, it won't likely hold in court, but getting to that point is costly and extremely stressful to the victim.
I actually wouldn't mind seeing some law to give victims of litigious bully's some legal means of counter suing. If someone is going to mount a lawsuit to "bully" someone they should have some more skin in the game.

What are they going for? I know by me the assessed value is $625 per acre and depending on the land they are selling for $2,000 an acre. Those are 20 acre lots. I would imagine that larger acreage the cost per acre goes down a bit.

It also has to do with it is zoned for.....farmable or scrub.
If this is where I think it is, its not even farmable......
-
From what I remembered of it it looked like bottom of a canyon that the deer hang out in during the day before heading up to the farm fields to eat. I was thinking it was a great spot to put blinds and just wait.

It's one side and part of the bottom of a steep canyon with a small creek in the bottom. It's super steep on the sides. It's definitely not farmable, but I don't think that's why he bought it. Lots of chukars and huns. A fair amount of deer but it's only 300 acres and the bordering landowners are not too friendly about letting a guy on their land. Been there, done that. My wife's family owns the other side of the canyon/creek bottom that borders this piece of land. I haven't hunted this piece of land in years. It's been reasonably productive for legal deer. I've never seen a large buck come out of this area.

No. Different spot a few miles away.

Just a shout out to Bearpaw and the mods.....

I appreciate your response. Yes, most likely all internet service providers (ISP's) are threatened regularly by lawsuits, in most cases I doubt that anyone like Zuckerberg deals with any of it, big companies have lawyers to deal with those issues.
Lawsuit threats come nearly every time someone is defamed on the forum so I've looked into internet defamation quite extensively including an attorney consultation so that I have a very good understanding of the law. Essentially anyone can sue on the basis that damages to their reputation or business have resulted due to slander. The proof of slander is the burden of the accuser, but even if the court rules in favor of the defense (ISP) there are still attorney expenses which can be significant, so I've tried to avoid going to court and I get very tired of having to deal with lawsuit threats caused most often by outspoken internet tough guys who don't have the guts to put their real name with their comments. Thus my new rule, put your full name with your comments and feel free to post away.
There is a significant level of security provided to ISP's by laws enacted by congress. Following that numerous courts have ruled that ISP's (internet service providers) like H-W are not responsible for what publishers (forum members) post on the internet using their service. However, if an ISP is contacted by someone regarding slanderous untruthful comments, and the ISP fails to remove those untruthful comments, and if the plaintiff can prove damages and that the comments are false to the court, there have been lawsuits awarded to the plaintiff.
Reviews are a good thing, I read them too about all kinds of things and they sometimes influence my buying decisions. But, the biggest problem is that too often people throw out comments based on hearsay without knowing the real facts or they purposefully say something untruthful to get even because they thought they were wronged, then the next guy says more and pretty soon the whole topic is pretty defamatory and full of speculative remarks and untruths. I don't want to be responsible for member's comments based on hearsay or rumors and I have no way of knowing who is truthful and who is just being a gossiper or troublemaker.
So if members post negative comments or reviews they can include their full name, that will create accountability. Negative comments without a full name will likely be removed depending on the comment. However, if I am threatened and the comments in question may be untruthful, H-W may still have to remove topics or comments to avoid potential litigation. This policy is intended to keep H-W (myself) out of court!

The last letter I got from an attorney group in Seattle area last month regarding a questionable person. I've seen the police reports and charges, so I asked the attorneys to please specify the specific untruthful remarks and I would remove them. The attorney replied back that they noted my position and I haven't heard back since, the topic is still on the forum. If they send back a list of what they claim is untruthful and I don't see proof otherwise, I will remove or modify the comments in question.
There's nothing wrong with posting truthful reviews or comments, the problem is that some people just blabber heresay with no regard of the actual truth! :twocents:

So let me get this straight...... the original post is about a questionable outfitter, to some people, who legally picked up a good piece of land at a cost that was agreeable to the seller and everyone's loosing their minds?
I don't know about everyone's personal experiences with this guy and don't care. My experience first hand with friends on the site on certain tags and opportunities is they have literally been abused and mistreated by members from hearsay and false accusations and makes me sick.
According to the original post sounds like the guy did nothing wrong in this situation and who knows maybe he's working on getting his clients the best opportunities on animals. Does everyone on here watch the Kardashians or just filling that void for drama?

Please be specific, you yourself are throwing out blanket statements.
I read the most of your 36 posts, I would like to see where your friends have been mistreated or abused.
-
Well I could be wrong I'm sure I'm wrong but if I'm not mistaken I read through every single post and I don't know if there was one post where anyone had actual first-hand experience with this guy. And maybe my post wasn't clear but the situations I'm talking about have nothing to do with this thread but my point being is you get people behind a computer and start throwing mud it just seems like a negative snowball that is pretty common on this forum. It's all for drama!

The person, outfit, that the OP is referring to has been shown to be less than neighborly. It was clear by legal documents as well as time stamped trail cam pics that the actions were shall we say undesirable. Im sorry if you are not aware of the previous thread but it was neither mud slinging nor false statements.

Usually when someone makes a strong accusation like this:
"My experience first hand with friends on the site on certain tags and opportunities is they have literally been abused and mistreated by members from hearsay and false accusations and makes me sick."
It is wise to have supporting information to back your statement up.
Thank you for your clarification.

Correct me if I'm wrong....
PM's aren't public and therefore not subject to libel or slander lawsuits...
carry on

Wow you don't need hunt wa forum to get your sources. Google it ! It's all over and archived. Do your own homework. Obviously this is a sensitive subject. Call and talk to the guy that the outfitter has pictures of that has a hunting show on tv that's on the outfitters personal Facebook page. I did. There are pools of info out there. The real thing is what can you really do with the knowledge? Not much really other than protect yourself from getting involved personally. So again I will repeat my self what good is the info going to do you if your not personally involved?

Sorry, I can not. The thread, I believe, is no longer available. I can say, as it is my opionion, I would not hunt as a client with a certain outfitter nor would i recommend them.

Good to know except most of us probably don't have any clue what outfitter.

About 10 years ago when we bought our house on 65 acres in NE Washington opening day of rifle deer season I noticed a guy hunting on my property when I approached him he identified himself as a police officer and explained he had permission to hunt the property. What he did not know was the property had sold to me. He knew the previous owners name so, I knew it was legit, he politely apologized and exited my property. Just a reminder to everybody that has permission to hunt private land always check in every year. Not only is it polite but could also save you some trouble

It took place within an hour of Portland OR. Anyone with a well trained BT sniffer outer could unwind the mystery and come to your conclusion and unwind the twisted mystery of who it is who has been around the horn with the law a few times lately. Or maybe just have hunted Tillamook OR in the past and thereby know as fact that with which others may be in the dark on.

I don't know that I have been entertained here on Hunt WA by a thread so much as I was with this one:
http://hunting-washington.com/smf/index.php/topic,186949.0.html
Haven't heard much lately about the guy who fancies himself extremely western, like originally from way out west in BT territory, Tillamook OR, but after how he treated a friend of mine who was set up right next to him at a show... It was great to have fun at his expense.
What I really want to know though is: If it was advertised, and it was, that the only surviving "public land" herds, verified and validated by a BT sniffer, that was within "an hour of downtown Portland," wherein anyone can guarantee "100% opportunity rate for trophy Roosevelt’s bulls in the 300 range and trophy Black Tail Deer" known to exist in huntable numbers east of the Pacific Crest Trail, in Washington, therefore living in pine forests and not a rain forest environment, would be "landlocked" behind this property and therefore all "public land" be only available to the guy who bought this property, how could this property not demand twice the asking price? It just doesn't make sense to me.
