Title: Sportsmans Warehouse in Portland Not Selling Semi Autos to WA Residents

Today I overheard the store manager at the the Johnson Creek store gun counter tell a gentlemen that they could not sell any semiauto firearms classified under WA new law to him, he was trying to buy a 10/22. After the guy left I asked the manager why he could not sell it and he said "WA new law restricts other states from selling them to WA residents" and that info came down from their corporate heads.

The new law is confusing as heck but is this correct?

Doesnt sound right to me.  Seems like a washington resident could be in violation of our laws by going out of state to purchase a semi auto, but how could wa laws dictate what other states can do?  Im no legal expert by any means, just saying it doesnt seem legit.

That is correct, you have to buy them in wa or have a wa dealer do the transfer from out of state just like a handgun now.

Yes, other states must abide by WA laws at time of purchase in those states, and vice versa, per federal law. 


Here's the exact interpretation for rifles (handguns you simply just can't buy out of state):
"Under federal law, individuals can lawfully obtain a long gun from a seller or transferor in another state, provided that:
Both parties meet in person to conduct the sale or transfer.
The sale or transfer is conducted by, or through, a licensed dealer, pursuant to a background check and other requirements.
The sale, delivery, and receipt of the long gun fully comply with state law in both parties’ states of residence."


That was even before I1639.  Granted, stipulations in that new law make it rather difficult for an out of state Sportsmans store to follow the WA law for the specific background check for WA, so yes as carpsniperg2 points out, has to be via WA FFL.


Just waiting for the lawsuit challenging I1639 to work it's way through to the US Supreme Court.  The ban on selling a gun to an out of state resident  seems like the part of the law that should at least get overturned, as that falls under interstate commerce laws as well (ie an arbitrary restriction of trade).

All one needs to understand about ALL of this is, YOU keep voting for any Demoncrat YOU are going to get the same and worse then this as time progress's!!

I wouldn't hold my breath on the SC changing anything,  remember they couldn't even get the Hound/bait/trapping initiative correct! :bash:

Even weirder...

Was thinking of buying this AK kit to build an AK at some point:

Went to check out at midway and it would not allow this to be shipped to Wa.

So there is no serialized lower (no lower at all actually).  How can this not be legal for a Wa Resident?  (But an AR15 parts kit is??)
