Title: Wolves Regain Federal ESA Listing, Judge Tosses Trump Admin Ruling
Post by: bigtex on February 10, 2022, 02:36:53 PM
A US District Court Judge in Oakland stated that "U.S. Fish and Wildlife Service had failed to show wolf populations could be sustained in the Midwest and portions of the West without protection under the Endangered Species Act." Wolves were de-listed by the Trump Administration prior to him leaving office.

In WA this will have no impact on the eastern third of the state since that area had already been de-listed. However, this will impact the western two-thirds of the state that were previously de-listed under the Trump Admin.

Are we talking about a judge in California, why would anybody In there right mind believe anything coming out of California.
I'm not saying it isn't true ,I'm sure a judge there did rule that.
They need to make California no longer a US state in my mind, that place is a joke.

Not that it matters but I'm sure someone will ask. It was a GW Bush appointed judge.

So, you're saying that the whole state of WA had been delisted? I didn't realize that. I thought just the eastern third had been.

Yes. Under the Trump Admin decision in January 2021 wolves were delisted in all of WA, OR, and CA.

The state of Washington still has them as endangered so regardless of them being delisted statewide Federally, they were protected by the state and there was no hunting season in place for them.

“Biden administration attorney’s argued FOR the trump rule delisting wolves “ rough quote from the article but that’s surprising in a good way. How do these things always end up being decided in California or on 1 specific judges desk in Missoula? Serious question

In a matter that effects multiple states you can sue the federal government in any of those states. Within states there may be one or more than one federal court district (WA has two districts, OR, ID, MT have one, CA has 4.)

In this case they chose to sue the federal government in the Northern Dist of California which actually just encompasses the northern coastal counties in CA and actually where there are no wolves. Why did they choose this district? Likely because all of the active judges in this district are Obama appointees. Cases are assigned at random to Judges, you pick the district but a software program randomly assigns the judge in thay district to the case.

Had they sued in the Eastern Dist of CA (where CA wolves are) they would face a mix of liberal and conservative judges. But despite this, the case actually got assigned to a Senior Judge (basically former full-time Judge who has partially retired) who was appointed by GW Bush.
