I went down to the gun shop today and paid off my lay away and once again I was delayed in getting the clearance of taking it home. I have been delayed with every new gun I have purchased. I don't buy a lot of guns but every few years or so I treat myself.
There must be some dirt bag out there with the same name as me or something. :chuckle:
Anyone else get delayed every time?

I had a buddy that was delayed all the time. Really suck, sorry to hear that.

i actually got denied a rifle one time, this was a bout a month after i had just bought 2 new handguns. there system is so freakin screwed. they destroy there info after i think 48 hours of approval (have to by law) but save a delay or denial even if its a mistake. one of the reasons i don't buy new guns any more (main reason being paranoia)

This is just something I was told at a gun counter and not sure if its true but it sounds good.
One you've been denied or delayed its in the computer system and from then on, when you do the App. a red flag is going to pop up, becuse of the past delay and delay it again.

You would think it would be the other way around. Once you have been delayed they should pretty much know who you are the next time. What can you expect from a government bureaucracy though. :dunno:
The last time I bought a gun it was a shot gun and they never did call the store back. I went down there after the 3 days and picked it up.

Guys, delay at the counter is an inconveniece, but a good thing. If your name and DOB match exactly that of a felon....they will delay you. Not saying you do, but if you have a criminal record, with a conviction in your past, a conviction which could possibly deny you gun rights....you will be delayed. The reason for the delay is so that CJIS has time for a trained NICS staffer to review your search and determine if you can possess a firearm. This is the law, and a good thing, it keeps guns out of the hands of criminals.
If you continually get delayed because some buttsmear has used your name, or your name matches....there is a way to get into a database to help you cruise thru the process next time, this system is called VAF (Volunteer Appeal File)...

Voluntary Appeal File (VAF)
Under this new process, potential purchasers may apply to be considered for entry into the VAF by signing an applicant statement which authorizes the NICS Section to retain information that would otherwise be destroyed upon the approval of the firearm transaction. This retained information includes, but is not limited to: a fingerprint card, court documentation, correspondence, and information contained in the applicant’s appeal file if one exists. A complete NICS check is still required for future purchases and will result in a denial if additional prohibitive information is discovered. The NICS Section is required to destroy any records submitted to the VAF upon written request of the individual.

That's obviously not true because I have been delayed once and never again after.

No federal record of a gun search is retained when they run a "brady" check on you. No record. Nothing to hit against the second try...

i agree with iceman but not 100% you don't have to have the same date of birth to get delayed i know because i went to school with a guy named richard reed you know the guy who tried to light c4 with a match and got busted the guy i know had the same name first middle and last and he said he got red flaged every time have not talk to him in awhile but i am sure its still the same way. my father was the same way got delayed allot no background what so ever must be someone with the same name. sucked every time he went to get a new gun for the family when i was younger we would drive a few hours pick out a gun and have to drive back up there a few days later because it took a few days to clear. i have never had to wait more than about 10 seconds so i am lucky i guess.
and huntbear my father had his concealed permit and that did not help him at all.

Don't get me wrong, I'm not complaining. I was just wondering if others get delayed every time like I do. The dealer told me you can get a pin # that allows them to identify you immediately. He says it take a couple months to process and you have to send in a bunch of info. I only buy a gin once every few years or so and it doesn't bother me to have to wait a few days to pick it up so I don't think I need to go through the trouble. He also told me concealed permit would make no difference.
I did get arrested once 25 years ago for minor in consumption of alcohol so maybe thats it. :dunno: :chuckle:

shame shame :chuckle: i agree i don't think it would be worth it for you but for those of us who buy guns like some buy scratch tickets :chuckle: it would be a good thing to do if you had that problem. i am going to work on getting my ffl and maybe see about then stepping up to the next class full auto and silencers love them shot a few in my day already would love to won them in new zealand anyone can own them :bash:

Lowedog...that pin number is the VAF number I was talking about. You should give it a try, get signed up.....then this will give you a reason to buy another gun!!!! To test your number!!!

i feel the exact opposite of this. i will not ask permission to buy/own or carry a fire arm. i was born with permission. and one more reason i don't buy new guns antmore. and as far as keeping guns out of the wrong hands, you don't really believe that do you ice? worked pretty well in lakewood :dunno:

I dont have a real problem with the way the check is now if it keeps a few guns out of the wrong hands. It just seems to me that a check could be done off a SS number or something like that, without having to fill out a whole background check form every time.
I wonder how many guys get delayed becuse of a misspelled word or some other mistake they make filling out that form. I know the guys working behind a gun counter are supposed to double check but I've seen how busy Cabelas or other gun counters get.

That's not true either. You can be delayed by the federal check regardless if you have a concealed permit.

Littlebuf, the NICS program keeps thousands of individuals from purchasing weapons each year. Remember, there are many different categories of prohibited individuals like mental defectives, drug addicts, individuals with Warrants, illegal aliens and your normal run of the mill felon. The system does work, it is not perfect. Just like guys poaching big game, some folks try to cheat the system, when they get denied, the steal or purchase guns from shady individuals.
Jamieb, most law enforcement search parameters have stopped using any SSN's because of Identity thieves stealing legitimate SSN's from folks like you and I, that there are so many SSN's on criminals alias records, that a search by SSN usually hits on many many individuals. Hence, most agencies do not search by SSN anymore, it was unreliable. Name and DOB, verified against current, valid photo identification is far more accurate. Mistakes made on your Federal purchase form are your fault. Mistakes over the phone to NICS are the Sellers fault.
You guys that don't like the system, please share with me a better system for keeping guns out of the hands of criminal? This has been studied and studied to death. No system is going to keep any single person happy each time they use it, and no system is going to keep guns out of bad guys hands each and every time. The average wait time for someone at the counter, during the call is under one minute or something like that...... Be patient.

Okay then what can those of us do that get delayed everytime? I have a Concealed permit and I got delayed three days getting my baby eagle 40. I get sick of having to go back to get my firearms. I am ex military and no convictions on my record. So what can we honest people do? I think criminals get their guns faster than I do!!!

Correct. One of the major problems with NICS is that it denies your liberties until you pass a federal check. Last time I checked - I shouldn't need a government to tell me if I should be able to buy a gun to defend myself. Give it another 40 years and you'll need a rectal exam to get your guns.

As stated earlier, apply for the VAF (Voluntary Appeal File), once NICS verifies why you continually get delayed, with your permission to retain data on you, they can add you to the VAF and each time thereafter, when you apply and provide your VAF number, the delay is eliminated.... (Unless you have a recent arrest or similar...they still check you against the prohibited databases.)

There is no system that is going to keep guns away from criminals. They can just buy from a private party or steal them. I'm really surprised to hear that you are a proponent of gun control. All they are doing now is making it more difficult for law abiding citizens to purchase guns. Why do they also not have to go through the same procedure for people buying baseball bats, knives, etc. ?

bingo, emphasis on the "control" in gun control because that's what it is about. you want a better system require everybody to have a gun, after it settled down the slime would be weeded out. obviously not a realistic option but that's my line of thinking. the government isn't there to control me its there for me to control.

i've been delayed 3 out of the 4 times i've shipped my own guns here from back home in NY.
the last time, 6 months ago, no delay.

Yeah, you guys are right, all illegal aliens, felons and mental defectives should be able to walk into any gun store and just walk up and buy as many assault rifles as they want.
Don't get me wrong, I don't like gun control very much, but I can accept this current level of inconvenience. I know you guys feel that every single gun sale halted by NICS is simply overridden by other means, but I do not feel that they are.

no true, i have mine and was delayed due to a holiday rule. the Cocealed doesnt garantee you to walk out with your new firearm.
