the guy has stolen yachts and high value cars and deals drugs.... he wants me to hold onto his 2 firearms... a winchester 30/30 and a stevens shotgun...... what do i do? we dont aprove of him or like him and he deserves his fate.... he is in his early 20s and my group of friends doesnt trust him.... the shotgun is a mantle piece, but the 30/30 is quality... i dont want to be a thief myself.... but it doesnt feel right knowing he [being a felon] has guns and we know he doesnt have any intention to hunt... they were his before he became a felon so they were legally obtained, but he cant legally own them.... its illegal for him to have them, but i am not a thief... his familly also has legal problems and cant own firearms... but after all he is an obscure boyfriend of a sister-like friend... so... technicaly its not theft...
what do it do? i have no problem telling him to take a hike and keeping the 2 guns for myself. i guess this is an issue of morality...
they were probably passed down to him.... but a felon lost his rights to guns....
and my ""sister"" might as well toss em off the bridge.

He cant own them so if i was you I would just keep them and use them. What would he do with them besides sell them which he cant really because he cant be in any possession of them. offer him a few buck for them if nothing else. :twocents:

Give the guns to your sister and explain why you do not want any part of them- 1.First and foremost. She should respect you so no broken family ties. 2.You wouldn't be breaking the law by giving them back to the felon. 3.You don't know for sure how much of a whack job this guy is or his friends and you probably don't want to deal with any unfriendly visits from anyone.
I know, I know- my third point may be far fetched and you can probably defend yourself just fine but wether someone knocks your head or you knock theirs the situation could be avoided all together by just staying out of this one.

Talk to your local police. I myself would like to just keep them, but you should protect yourself from being labelled a thief and maybe in trouble yourself. Take pictures and document serial numbers, too.

Stay away from this situation bail on the guns.. If you think this guy is a POS then you want to stay as far away from him as possible.... If you contact the cops with the serial numbers and they are stolen, you will have to tell them the story to keep yourself out of trouble and will likely have to testify against him... if you want to put him in the poky then tell a cop and they will... STAY AWAY FROM STUPID PEOPLE! They will drag you into all kinds of problems that are not your own... Are those 2 guns worth getting wrapped up in this dirt bags issues problems? HELL NO!

As long as the firearms are not stolen and since he gave them to you to hold on to, then I would keep them, maybe they belong to his uncle or another friend of a friend who knows, in any case, there is nothing illegal about that . When and if he gets out of lock up ( I'm assuming that is where he is ) and he wants them back, tell him he can meet you at the local police precinct and once he is cleared to own firearms, he can have them back.
If you turn them in for confiscation, depending on what that particular police agency does with confiscated firearms, they will either be destroyed or sold to a gun store for new firearms for that police agency.
As long as they are not stolen and it is certainly easy to have them checked. Just be vague with the info when the police ask you where you got them. Just tell them you got them from a guy that was going through some tough times and wanted to make sure they were not stolen. If they turn out to be stolen, provide the LEO with all the info on the chitbird that gave them to you. That way the LEO can confirm the guys name and current living residence, The Grey Bar Motel.
Bottom line though, it boils down to your own personal morals, if it makes you feel uncomfortable then turn them in. If you can sleep at night, then.................. :dunno:

Lets think about this for a second. Lets say these guns were used in the commission of a crime? Your in possession of these guns, guess what YOUR GOING TO JAIL! DA! Lets say these guns are stolen, YOUR GOING TO JAIL!, lets say you just hold onto them for a goodness sake, keep them away from this felon guy. You know, do the right thing. Tell that to a Cop when he asks, YOUR GOING TO JAIL! Ok, lets not doing anything at all, let the Felon hold onto them himself or better yet let him deal with his own problems. You find out later he killed someone or used the guns in the commission of another crime. Can you live with yourself at this point. Tell the cops this and guess what YOU GO TO JAIL!
Take the flipping guns, call the flippin Cops and turn them over. Dont be an idiot, dont give gun control lobbyist more reasons to take away your legal guns, dont put your family at risk, be part of the solution, turn the guns over to the authorities!

Ballisticnut is right. I've been in a similar situation givethe guns to the authorities .. There is a good chance this person will never get there rights back. And you could go to jail for withholding evidence, if they happened to be seen with this person during or after a crime that person might of committed.

Do you really want to deal with this headache??? Just give the guns back to his parents and tell him not to come around anymore. Going out of your way to try and F*** him over is not right either, It sounds like the kid will end up in prison soon enough anyway without your help.

Does "Possession of Stolen Property" mean anything to you? Lowlifes like him are habitual liars. Turn them over to the police and wash your hands of him and anyone associated with him. If his family has legal trouble too then you need to talk to the police. If you return them to him then you are giving a known felon guns, if his family can't have them either then the only way to protect yourself is to talk to the police.

I too am surprised at the number of ppl who say "just keep them." Some of the worst advice I've ever read on this forum. Aside of the moral issues of theft, you should listen to those who caution against Associating with dirt bags. I wouldn't even have anything to do with this "sister" of yours. As much as I'm a sucker for a good deal, I say give them to a responsible relative of his or to the police and find a good deal elsewhere. I'd be more afraid that he's keeping you as an ace in the hole to rat you out and now you're hiring an attorney just to prove you didn't fo anything. so much for coming out ahead on the deal.
I hope the mods don't delete this thread. it may get heated but its definitely relAted to firearms, hunting rights, and good vs bad advice.

I was in the same situation abou 4yrs ago with the wifes brother, he caught his wife in bed with another man :yike:, :violent1: and it cost him his right to have guns, so he asked me to keep his guns for him, I said that I would buy them from him or sell them for him, but i would not hold onto them for him. so I own a few more guns :chuckle: and he shoots archery now.

Actually I would give them back to him and let him deal with the consequences, you are not any form of law enforcement, and you cannot take the laws into you own hands. Let him take all the risk and stay the hell away. They are his anyways let him take care of his own crap. It sounds like you want to justify keeping his guns for yourself?

Apparently I wasn't clear enough for you... I should have been more clear... So here goes...
Why would you even consider placing yourself in this situation. There is a reason he cannot have firearms anymore. Let's start with, you should not have taken the weapons. You are only giving this loser an opportunity to get into your life and screw it up. Now you need to give them to the authorities. Seems like the PoPo would be happy to take them from a citizen concerned that if he didn't accept them, the bad man would just find a way to keep them unlawfully. While I choose not to believe that you have ill intent in keeping them, you can't.

I had to do this for my mother before. Her old boyfriend had a shotgun & a revolver stashed in her house so I went over made sure they were unloaded, drove them to the PD, LEFT THE GUNS IN THE CAR, went inside got an officer to come outside with me to get them, we went back in the PD with the guns, I left him my info & I went home.
Call the police & tell them you have 2 firearms in your house that you do not want, they do not belong to you or your family & you would like to turn them in.
DO WHAT YOU KNOW IS RIGHT! PROTECT YOURSELF! DO NOT LIVE A LIFE IN FEAR! THE BOYFRIEND WONT BE AROUND LONG ANYWAY!

I agree iceman. Just people saying diffrent things no reason to jump to conclusions. I would get rid of the them, either to someone that can take them "family members etc" or last ditch effort the cops.

I have been in a similar situation, it is as simple as filling out some paperwork with the batf which basically says you will not give the guns back or face charges, the guns are legally transferred to you. No way would I touch it otherwise.

I think if I was in that situation, (assuming he came and talked to you) that I would offer him a price for them and be done.
I don't know all about the legality etc, just saying how I think I'd handle it. I wouldn't consider "holding" unless for a dearly loved blood relative. :twocents:

My bad, I apologize. I was just FLOORED with all the comments relating to a dishonest or decieitful action/suggestion. Got my goat and my blood pressure up. Ill be more careful next time around.
I didn't vote cause I would not touch this. However, sometimes people believe it or not, are charged with stuff, not yet convicted, and are not supposed to have a firearm. So, if I understand the question, if a person charged is not to have a firearm, and wants to give it to you, would you take possession? I say, don't get involved. If YOU choose to get involved, and they are convicted, don't give them back or you can be charged. I think that is the idea of, "would you take them" and the response, don't give them back, (Or you may be talking to :police: )

dude, stay away... There arn't too many ways you holding on to your sisters boyfriends gun can turn out good, and about a bagillion ways it'll turn up bad/being a huge crazy hassle (what happens when/if they break up?).
It's not your problem to solve, maybe offer some "here's what I'd do" advice, but beyond that you're asking for a headache down the road. maybe tell him to donate them to whoever does hunters ed round there, or if they are awesome pieces to a museum of some sort (the winny [if it's old] and the cody museum comes to mind).

Didn't vote for one of the choices, but if the guns were decent, and I had a use for them, I would probably offer the guy a reasonable amount. And, be sure to get a signed receipt for them after checking to see if they are stolen or have any other flags on them. Sounds like the guy is not in prison and is planning on archery hunting. Maybe he needs some accessories or arrows for his bow, or gas money for his next hunting trip.
Some people have a felony on their record and are not bad people....

I baby sat my freinds firearms for 2 yrs.
If the court confiscated them, he could asign someone to hold them until he is legally allowed to possess them.
If he is in violation of the law now, and gives them to you,you are putting yourself between a rock and a hard palce. if they are stolen, you get receiving stolen goods. if you give them back, he can claim they were yours and you supplied him with them.

See, here is were I am irritated by all this "give them back" stuff. In his topic, he says "my "sisters" boyfriend is a FELON"!. The key word is FELON. It is illegal for anyone convicted of a felony to even have a gun in his possession. So once you have them, you can NOT give them back! Legally. So, why even consider the idea of providing a felon with guns even if he owned them to begin with? Once you take possession of these guns, you take possession of the responsibility of these guns. You can not give them back. You can purchase them from him and legally transfer them if they are legal guns. Even that is doubtful if he is already a convicted felon.
This is why our gun laws are constantly changing and more laws are put in place for "gun control". These types of things, legal gun owners giving guns to felons. You just add fuel to the fire for the gun control lobbyist. Dont play the I didnt know card either, ignorance is not a reason to break the law. Please understand what it is you are suggesting and the implications down the road if this situation goes south or some lobbyist reads these posts. He/She can easily say, "its commonplace for legal gun owners to give felons guns" and site this forum topic as an example.
This may seem like a far fetched example, but these discussions are closer to the norm then you may think. So please THINK before you react!

No person may deliver a firearm to any person whom he or she has reasonable cause to believe is ineligible under RCW 9.41.040 to possess a firearm. Any person violating this section is guilty of a class C felony, punishable under chapter 9A.20 RCW.

Have them checked and buy them. On another note, didn't I read this was a Sister Like persons boyfriend? I'd be thinking about cutting ties with both from what I've read :twocents:

Well i have been in this situation. My lovely wife's piece of crap brother did something really bad. He is a felon and gave me his pistol. I took it put it in my name and sold it to a buddy. I haven't talked to her brother scenes he did what he did. didnt want do deal with him and his stuff.

If you both fill out the batf paperwork, you are getting free guns. Dude gives you any grief down the road and he goes back to the pokey. Like I said earlier.....btdt. I ended up with a bunch of guns that would have gone to confiscation and been destroyed. My liability was simple, under no circumstances could I deliver the guns back to that guy.

Wow. The 'keep' comments had me reeling when I first started reading this. Really? Then I saw people getting on Ballisticsnut for calling them on the carpet. You got to be kidding me. It seems like some would risk a lot to get more guns that do not belong to them, even though there is a virtual guarantee of trouble down the road, one way or another.
Knew a guy hooked on drugs that ended up killing three people by beating them to death. You want that guy to come knocking on your door when you least expect it? Unprepared? And he wants his guns back NOW? Oh, and by the way, there are two other guys with him. They already have their guns back. They are pointed at YOU.
Not to mention the law. Are you willing to risk YOUR right to have firearms taken away for helping this guy?

Wow indeed GWP. Rereading the thread I noticed no one getting on Ballisticsnut, other than maybe me a little. The OP was a little vague on whether he has the guns or the guys wants him to take them. I believe that you, Ballisticsnut, and I are all on the same page. If he doesn't have them yet, don't even consider it. No good can come of it. If he has them, he needs to get rid of them properly. Have your attorney turn them into the PD or whatever. :beatdeadhorse:, Maybe. Don't want to be misunderstood on this...

IMHO a 30-30 and a Stevens shotgun aren't even worth the trouble even if the guy was legit... :dunno: ABSOLUTELY not worth the trouble that this whole situation could bring.
As a recruiter, I hear stories like this all the time. Usually when someone is explaining some f$@#ed up charge that will keep them out of the military:
"so, there was this guy that asked me to hold onto his __________ for him..." (you fill in the blank; pistol, rifle, TV, stereo...etc...)
Get out of the situation as quickly as you can.. :bdid:
