the real answer, it depends on the guy with the badge and ticket book
........like this nice bruin that was claiming his deer carcass last Sunday?
had this discussion with 2 different GW's so far, one being as soon as yesterday, both said the same thing I assumed,-- if you shoot a bear that HAPPENS to be over or near a gut pile then its coincidental and luck-- if you are AWARE of a gut pile and you hunt it, watch it, return to it with a gun, looking to shoot a bear, then its 100% baiting and you will be busted. There is your answer, its a risk not worth taking. and to be twice as clear, we have Game officers on this board, they are reading here daily just like you, keeping tabs and also because they are hunters, and I was shocked to meet one yesterday who already knew who I was, and why I was where I was heck of a cool guy too

I have spoke to different wardens about this same subject, all have gave me different answers, sitting on a gutpile is baiting, isnt baiting, etc...[/quotI guess it is D bait able.
It's legal. Really.Even if one game warden's interpretation is that it's not legal, what are the chances that that particular warden is going to be watching you at just the moment that you pull the trigger? Pretty astronomical odds, I'd say.
