AG Holder: Feds Will Ignore State Laws and Enforce Gun Grab

Attorney General Eric Holder has written to Kansas Governor Sam Brownback (shown), informing him that the Obama administration considers state attempts to protect the Second Amendment “unconstitutional” and that federal agents will “continue to execute their duties,” regardless of state statutes to the contrary.

The letter, dated April 26, specifically references a Kansas statute recently signed into law by Brownback that criminalizes any attempt by federal officers or agents to infringe upon the Second Amendment rights of citizens of the Sunflower State. Section 7 of the new law declares:

It is unlawful for any official, agent or employee of the government of the United States, or employee of a corporation providing services to the government of the United States to enforce or attempt to enforce any act, law, treaty, order, rule or regulation of the government of the United States regarding a firearm, a firearm accessory, or ammunition that is manufactured commercially or privately and owned in the state of Kansas and that remains within the borders of Kansas. Violation of this section is a severity level 10 nonperson felony.

The right of states to refuse to enforce unconstitutional federal acts is known as nullification.

Seems like they are only picking and choosing what and what not to enforce, but are also doing whatever they can to piss off the populace.

Lines are being drawn in the sand... The question is WHO is going to bow and who is going to stand firm and make an issue of this.

IMO this is more than the 2nd admendment issue this a states rights issue at its core. Many states have played along with marginaly legal strongarming by the feds because it wasn't worth fighting over...  I fear that there will be an event where a State takes a stand and so dothe feds to make an example. God help us if no one stands down,it could be the unraveling of society as we know it.  :twocents:

Kansas Responds to Feds: We will Defend State’s Sovereignty & Second Amendment Rights

The State of Kansas has responded to the Attorney General Eric Holder’s threats to take Federal Action within the State of Kansas, after the Feds threatened the State for passing the 2nd Amendment Protection Act, a bill that banned federal authorities from violating State resident’s second amendment rights.

Yesterday we reported on the letter that Attorney General Eric Holder sent to the State of Kansas threatening Federal Action. Today, Kansas Governor Sam Brownback, sent his response to Washington.

It reads, in part:

    The right to keep and bear arms is a right that Kansans hold dear. It is a right enshrined not only in the Second Amendment to the United States Constitution, but also protected by the Kansas Bill of Rights. The people of Kansas have repeatedly and overwhelmingly reaffirmed their commitment to protecting this fundamental right. The people of Kansas are likewise committed to defending the sovereignty of the State of Kansas as guaranteed in the Ninth and Tenth Amendments to the United States Constitution.

Dear Attorney General Holder:

            The State of Kansas is in receipt of your letter in which you place Kansas on notice regarding the view of the Obama Administration concerning the state’s Second Amendment Protection Act. 

 The right to keep and bear arms is a right that Kansans hold dear.  It is a right enshrined not only in the Second Amendment to the United States Constitution, but also protected by the Kansas Bill of Rights.  The people of Kansas have repeatedly and overwhelmingly reaffirmed their commitment to protecting this fundamental right.  The people of Kansas are likewise committed to defending the sovereignty of the State of Kansas as guaranteed in the Ninth and Tenth Amendments to the United States Constitution. 

The state’s Second Amendment Protection Act, which expressly restates our commitment to these rights, was approved by wide, bi-partisan margins in the Kansas Legislature.  The measure was adopted by a vote of 35 to 4 in the Kansas Senate with the Democrat Senate Minority Leader supporting the bill.  The measure was adopted by a vote of 96 to 24 in the Kansas House of Representatives.  Again, the Democrat House Minority Leader voted for the bill.  This is not a partisan issue in Kansas. 

The people of Kansas have clearly expressed their sovereign will.  It is my hope that upon further review, you will see their right to do so.

Kansas Secretary of State Kris Kobach, had strong words for the entire Obama administration and wrote in a separate letter,

    He (Eric holder) was evidently not concerned the ATFE officials be allowed to enforce federal law when his agency oversaw the “Fast and Furious” operation to walk guns into the hands of Mexican cartels. And he is not concerned the Obama administration in ordering ICE officials to violate federal law through the executive amnesty for illegal aliens that DHS Secretary Janet Napolitano launched in June 2012.

    He goes on to say that, the Obama administration has repeatedly violated the United States Constitution for the past four-and-a-half-years. That abuse cannot continue. The State of Kansas is determined to restore the Constitution and to protect the right of its citizens to keep and bear arms.

I would have to agree Nocklehead. ALL  politicians that don't support the constitution need to go. Yess there are republicans and democrats that need the boot.  I think the republicans have slowly been co-opted by a different brand of freedom grabbers. :twocents:
