Just say you weren't hunting with the spear. You were just going for a walk and the bear attacked. Luckily you had a spear to defend yourself. Same excuse I think my brother was going to use if he got caught shooting grouse with a slingshot.

Oh I loved all the stories from there when my wife was a park ranger.
I think you can. You just have to use a really big 'arrow' to spear the bear. It has to have the minimum weight and cutting edge. I would say you probably need a bow with you that has min draw weight/etc. Then just spear it with your 'arrow'. I don't know that it says the 'arrow' actually has to be shot from the bow.

Like others have said, it is illegal in WA. Several years ago someone posted a youtube video of them doing it in Pierce County. Didn't end up well for them...
