Buck:   I concede that I was wrong to assume they were attempting to poach based off just the picture:  thus I apologized and removed the photo.  But that doesn't change that I interpreted the law correctly.  I may have jumped the gun on posting the pic but not on the assumption they were prob up to no good.  Maybe, maybe not. I said I could be wrong.  I presented the belief I had and many of you presented yours.  what I can't believe is how many of you act like these guys couldn't have possibly been up to no good. 

your right they prob were picking mushrooms,  although wait I didn't get that on camera...... maybe they were hunting chipmunks?

In law, it is always about interpretations.  so....whats your point?  Every supreme court decision is almost always 5-4 so even the highest court debating our oldest framework doesn't agree.  I interpreted that you cannot be carrying a call for an animal that isn't in season along with a weapon used to kill such animal.  YOU may have not interpreted that the same, and Im sorry but don't act like I'm crazy for being so black and white with it.  I would expect people to think I was hunting elk with that same scenario.  If you are ok with going through the court proceedings to prove you were not,  fine. But I don't think its worth it and i'll call it like I see it.
I found if you post a picture of someone that you catch poaching on this site your going to you'll be chastised by a few members. I believe you understand that you have no hard evidence these guys were poaching, and should not have posted the picture. I found this out my self when I posted a picture of a man poaching clams, although my picture caught the poacher with evidence in hand.
 I too took a lot of heat, most on here will stand with you , but there are a few on here that even if you have proof you should not post it here.  Now we have to ask ourselves were these guys poaching, maybe but who knows.
That's my one shot.

So if I go scouting for elk right before the season (when most people scout) and take a bugle to locate the elk (never leave home without diaphrams and tube) and I take my rifle because I'm in bear country and have a bear tag, I am unethical and possibly a poacher?  All this time I never knew!!!!!  Lock me up! I plead guilty!

I almost never wade into these discussions but this one is too much to resist.  I take a rifle when I scout for deer and call coyotes if I feel so inclined and often use a fawn distress call so am I also unethical and possibly poaching then too?

Trail cams should be outlawed, unless used on private property. Pretty sad you cant go for a walk down the street without being on camera, now its the same way in the hills.

Again if an archer carries his side arm is he poaching just because he has a gun , the problem is our game laws are so confuted that you need to be a Philadelphia tax lawyer or Bobcat not to be doing some thing wrong . If you don't want to carry your bow or rifle while scouting then don't . just don't assume a guy is a poacher just because he doe's . Aren't we in America where we are inisent  till proven guilty ? ask rt about that bs, plus he did shoot a bear last year while scouting for elk with labs07 so it doe's happen .

That's ridiculous. You think we shouldn't have a call for an animal that isn't in season? When I'm deer hunting I cow call to cover my movements. I use a deer call when predator hunting. My elk diaphragms also make turkey calls. Crow calls make Turkey's shock gobble. As far as the guys on your camera, could they have been upto no good? Yes. But I think the majority of folks on here are like me and would rather give someone the benefit of the doubt until there is more evidence.

I'm with blrman I do the same thing. I have a bugle, coyote calls, cow calls and a few more ,from the time bear starts trough my muzzleloader season. I always have a rifle in hand. Its nice to know were the elk are at before my hunt starts. I am not a poacher, and I'm glad your not a judge.
