Buck:   I concede that I was wrong to assume they were attempting to poach based off just the picture:  thus I apologized and removed the photo.  But that doesn't change that I interpreted the law correctly.  I may have jumped the gun on posting the pic but not on the assumption they were prob up to no good.  Maybe, maybe not. I said I could be wrong.  I presented the belief I had and many of you presented yours.  what I can't believe is how many of you act like these guys couldn't have possibly been up to no good. 

your right they prob were picking mushrooms,  although wait I didn't get that on camera...... maybe they were hunting chipmunks?

In law, it is always about interpretations.  so....whats your point?  Every supreme court decision is almost always 5-4 so even the highest court debating our oldest framework doesn't agree.  I interpreted that you cannot be carrying a call for an animal that isn't in season along with a weapon used to kill such animal.  YOU may have not interpreted that the same, and Im sorry but don't act like I'm crazy for being so black and white with it.  I would expect people to think I was hunting elk with that same scenario.  If you are ok with going through the court proceedings to prove you were not,  fine. But I don't think its worth it and i'll call it like I see it.

That's ridiculous. You think we shouldn't have a call for an animal that isn't in season? When I'm deer hunting I cow call to cover my movements. I use a deer call when predator hunting. My elk diaphragms also make turkey calls. Crow calls make Turkey's shock gobble. As far as the guys on your camera, could they have been upto no good? Yes. But I think the majority of folks on here are like me and would rather give someone the benefit of the doubt until there is more evidence.

I'll be out deer hunting, in the same area I was elk hunting in, starting tomorrow.  At times I'll have my camera with me, along with my bow.  I'll also probably have my elk bugle with me and use it.  If I'm able to bugle another bull in, as I was able to the other day, I have every intention of shooting it...with my camera!

Often times I will hike into an area before the elk opener (looking for deer/Bear) and bring my bugle to try and locate a bull to hunt on the opener!!

Again if an archer carries his side arm is he poaching just because he has a gun , the problem is our game laws are so confuted that you need to be a Philadelphia tax lawyer or Bobcat not to be doing some thing wrong . If you don't want to carry your bow or rifle while scouting then don't . just don't assume a guy is a poacher just because he doe's . Aren't we in America where we are inisent  till proven guilty ? ask rt about that bs, plus he did shoot a bear last year while scouting for elk with labs07 so it doe's happen .
The worst thing they ever did was allow a bowhunter to pack a side arm ...If I need to kill something that is attacking me I will use my bow ...that's why I bowhunt ...I do not need a side arm ...and if I was going to use it to poach I would be relying on my bow more than a pistol ...I wonder how many bowhunters do use their pistols to shoot at game  :twocents:

My response to a warden would be deer is open right ? Well I have a deer tag in my pocket and I'm pre scouting for tomorrow's opener!!! Case closed .
Having worked 15 hunting seasons alongside game wardens, most of them are pretty darned good at getting the truth out of people they contact.  It ruffles the feathers of most honest hunters, but it does get poachers ticketed.  The best wardens I've worked with have conviction rates in the high 90s-100%, they don't write tickets unless it will stand up in court.  There are a few bad apples who hang paper on anyone they think may be guilty (that 50.1% preponderance previously stated).  Based on my experiences working decoy operations, I believe about 40% of licensed hunters will opportunistically poach an animal, even if they didn't have any intent before an illegal animal was present.
As long as we have the habitat, we can argue forever about who gets to kill what and when.  No habitat = no game.

I would guess very few. Beings a gunshot in the woods during archery season would raise some curiosity.

no thanks.. ive heard some sketchy situations where a bow doesn't cut it. Ill pack ny sidearm every time I go out archery hunting.  When you can shoot twelve arrows in under 3 seconds ill consider ditching my pistol.

bow hunters that carry side arms are afraid of things that go bump in the night ! with the exception of griz country . I would venture to say that most bow hunters are better with a bow than a pistol so why would they try to shoot with a side arm ?

I think there is some truth to this. I would be willing to bet at 30 yards I could hit a smaller target with my bow than my 9mm. But as 10th said I can't shoot enough arrows fast enough to stop a charging threat.

40% of road hunters during daylight hours - real hunters are already in the woods gettin er done  :tup:

All I'm saying is your 40% might be skewed due to the "wardens" knowing when and where to target to maximize results.
