18-21 Handgun Laws

Hey guys this is my first post on here, and I'm sure this has been touched but I figured I might as well just post. This is also the first forum I am apart of. So here's my question:

I am currently 18, going to be 19 in July. Is there any way I am able to possess a handgun before I am 21, I know I am not allowed to purchase one or ammunition. But is there any law against owning one? Say someone 21 or older purchased one and "gifted" it to me. All I want is a handgun to carry/have when I'm out in the woods. I want to do a lot more walking/hiking around rather than just cruising logging roads. But it is a hassle to bring a rifle or shotgun with me. I like having a gun with me for those just in case scenarios. I know Washington is an open carry and 21 is the legal age for a Concealed Carry Permit... but could I have an unloaded handgun in a vehicle in open sight in the woods with me when driving, and be able to carry it when I'm walking?

I never had a problem before when I was under age and carrying in open sight and left it out in the open while driving.  And I been pulled over to get checked by game warden and he said nothing about it as long as all weapons was unloaded he didn't care

This is another important section:

RCW 9.41.240
Possession of pistol by person from eighteen to twenty-one.
Unless an exception under RCW 9.41.042, 9.41.050, or 9.41.060 applies,
a person at least eighteen years of age, but less than twentyone
years of age, may possess a pistol only:
(1) In the person’s place of abode;
(2) At the person’s fixed place of business; or
(3) On real property under his or her control.


So the answer to your question is yes, you can have a handgun while doing any kind of recreational activity in the outdoors.

Doesn't RCW 9.41.060 remove the restrictions regarding concealed carry and having a  loaded pistol in a vehicle? I would say that it is legal to carry a pistol concealed and loaded from the time you left home until you returned from your lawful outdoor recreational activity whether it be something requiring a license or not; such as hunting or hiking.

Awesome! Thanks a bunch for the feedback guys, I really appreciate it. Looks like I will be on the hunt for a handgun. I know it's all person opinions, but I believe a .40 would be a good caliber choice?

 A couple of things...sounds like you have a good grasp of what is right but wanted to emphasize a few things that have already been said but, in this day and age anything may get blown out of proportion if the wrong person gets involved.

Show your best intention is to be as safe/law abiding as possible.
 
One is to be aware of RCW 9.41.050
Carrying firearms. (2)(a) A person shall not carry or place a loaded pistol in any vehicle unless the person has a license to carry a concealed pistol.

Don't want you to get in any trouble at a gas pump fill up or stopped for a tail light, or whatever the innocuous situation is, and have to spend the $ to undo a situation for an over zealous LEO. A pound of prevention is worth $. If on the blacktop I would recommend having all the bases covered so there is no misunderstanding.  A cheap $30 bulldog box is a good investment for your unloaded pistol.

(3)(a) A person at least eighteen years of age who is in possession of an unloaded pistol shall not leave the unloaded pistol in a vehicle unless the unloaded pistol is locked within the vehicle and concealed from view from outside the vehicle.

If you get training it will go a Long way. Pistols are a horse of a different color when it come to proficiency.
 
AND caliber.. if its your first pistol... 22 caliber is the best trainer....but if your stuck on a centerfire. 
 
Look at what you want to use it for. Hunting..then what size of game - or general plinking?
If its for defense - try to take classes.

Short of it- a 40 isn't the best. They are all cool but semi-autos in general will break the bank to shoot.

To recommend a caliber without a reference for its use is entertaining but probably not too helpful- oh well..too late.

The 40 - have 2 of em BTW- and I am not recoil sensitive but most people including myself can shoot a 9mm better- faster and cheaper. You want more power shoot 9mm +P. The 40's are cool and fun but snappy and harder to keep on target esp. with +p loads.

If you have an opportunity to try several out a head of time, shoot as many as you can. Training classes are good for that and usually have loaners.

I prefer my 45 ACP for a number of reasons - maybe bias - BUT for the boonies- I would recommend a Ruger Blackhawk in 45 Long Colt - they make a 'convertible' giving you the ability to shoot 45ACP if that is your druthers and it is safe and rugged.

Sweet thing about it is, if you get froggy and want to take on bear/buffalo or whatever can buy HEAVY loads for it that will humble you.
Have a 44mag (had a 41 mag which I wish I still had) and a 45 Colt. The 45 Colt is awesome fun shooting cowboy loads. Bear issues, load it with COR-BON or Buffalo Bore ammo.

And if you run across a Ruger Bisley you may like it even better than the Blackhawk frame.

Upgrade the grips and get a Bianchi 111 cross draw holster for bush whacking or a Guide's Choice Chest Holster from DIAMOND D.

If I was going to pick a favorite pistol out of the pile- I wouldn't want to do that...its whatever strikes you as interesting.
Loong story short - if you have 2 identical guns side by side to choose from and are stuck on getting a semi-auto for zombie's - one a 9mm & a 40 S&W- my recommendation is grab the 9mm. Holds more and you will have sooo much fun shooting it - until you turn out your pockets and wonder where the $ went for ammo.
If it is for bears- move to the next counter and get something you can use. 

There are a lot of choices but most important- be safe and enjoy.  :tup:

I know a few younger guys in that age group that take handguns with them while out hiking, fishing the back woods and camping. A couple of them have been approched by the conservation dept for a license check and nothing was said about their open carried handgun.
If you decide to partake in the handgun choice, practice with it. Get to know the gun and what the limitations are. In most cases the largest caliber you are comfortable shooting will be the best choice.

I have a friend that happend upon a meth cooking operation once while out hiking and wasn't prepared for it, his ass was in a jam for a few minutes. You never know what you'll come across when you venture off the beaten path.

Read RCW 9.41.060 which nullifies RCW 9.41.050 if you are engaged in lawful outdoor activities. Aren't the laws regarding hunting and fishing in this state a bit confusing?

Yes but - the "only if," would need explanation. Shouldn't have the need to explain.
Rather set a person up for success and alleviate 'opportunity's' for litigation to contest a transgression in the first place.

He asked if he could have an unloaded handgun in a vehicle in open sight when in the woods- no problemo'. 
 
My assumption is he will be driving a pickup & it undoubtedly would be within reach...if pulled over on the black top for any number of reasons it will cause a few tense moments.
My advise- use a bulldog lock box (or similar) on the black top and no one will question his motive. Easy way to lock it up when you go into a store. Would suck if he broke down- ran out of gas or had to leave it unattended with no way to secure it.

I had an instance years past (years & years past) and things were different. After a while taking it off was too much bother...then it became second nature to carry it. After a week in the woods I stupidly forgot (tired from sleeping on rocky ground) and went in for a meal in a restaurant with it hanging off my belt. No one cared but once I realized my mistake it was too late. Then no one batted an eye. Food was served & I was too hungry to care but didn't let it happen again.

Now days with the media hype a soccer mom may call 911 on you if she sees a firearm. Then he would have to explain..how old are you- where you going- where'd ya get it- who is it registered to- is he home- he is a work, what is his work number...see where this is going?

 Just say'n, an Ounce of prevention- shouldn't be that way but times are changing...

I only had mentioned a the .40 because my cousin, and a friend of mine, have a Smith & Wesson M&P .40 and both like the gun.  Figured I could shoot my cousins to see if I like it a familiarize myself with the gun before actually getting one.  And it would be nice for when I do turn 21, I would have a handgun for "home defense" etc.  I would love to have a revolver, but round capacity is the only downfall I can currently think of.  Haven't looked tons into all these, but I did want to make sure I could do it if I want to.  I will definitely look into a locking box, I had not thought of breaking down or going some place else to/from the woods. Again thanks a lot I really appreciate it!
