HB 2526: Reducing Residency Requirement from 90 days to 30 days

HB 2526 which has large bipartisan support would reduce the WDFW licensing requirement to establish residency from 90 days to 30 days.

The bill has it's first hearing today.

I think it should be 1 full year unless your are stationed here for military purposes.
For military, 1 day would be plenty!

 Much easier argument for refugees to claim residency when they can first point to fishing and hunting license requirements and say, "if I can get a fishing /hunting license after 30 days, why not permanent residency?" Etc etc etc.

I am not sure of the justification of this bill. Like I said, it does have both Democrat and Republican support. But I do know some states do have a 6 month requirement....

HP is spot on WRT the agenda behind such an initiative.  Residency should be pushed out to minimum of 6 months. Military members who can show PCS orders should be able to buy resident license from day 1.

Washington State residency definition
Persons are considered residents of this state for sales and use tax purposes if they take actions which indicate that they intend to live in this state on more than a temporary or transient basis. A person may be considered a resident of this state even though the person is a resident of another state.


The Department of Revenue presumes that a person is a resident of this state if he or she does any of the following:

    Maintains a residence in Washington for personal use;
    Lives in a motor home or vessel which is not permanently attached to any property if the person previously lived in this state and does not have a permanent residence in any other state;
    Is registered to vote in this state;
    Receives benefits under one of Washington's public assistance programs;
    Has a state professional or business license in this state;
    Is attending school in this state and paying tuition as a Washington resident or is a custodial parent with a child attending a public school in this state;
    Uses a Washington address for federal or state taxes;
    Has a Washington State driver's license; or
    Claims Washington as a residence for obtaining a hunting or fishing license, eligibility to hold public office or for judicial actions.

Persons may rebut the presumption of residency if they provide other facts which show that they do not intend to reside in this state on either a temporary or permanent basis. A Washington resident who intends to move at a future date, however, will be considered a Washington resident.

I think it's fine. I seriously doubt anyone would rent an apartment for 30 days just to get in-state licensing. On the other hand, if you have to wait 90 days, it could screw up someone's whole year if they don't time the move right.

I doubt it will affect too many people, either way.

We already have an ID you can't use to access Department of Defense installations, and TSA is about to ban it.

Might as well let them get it sooner, they can't use it anywhere.

Fyi this is just for WDFW licenses. It does not change residency definitions in other laws. So no impact on college tuitions

I see the logic.

A hunter moves to Washington. It takes him about 30 days to get settled and find a resource for hunting information. On day 45 he finds out about Hunt WA. Before day 90, he decides the hunting was better back home. Lost sale.
