I will generally wait until the bucks are hard horned before I take a shot, but if that guy is at 40yds in full velvet, I suppose I will shoot a velvet buck :)

For $100,000 in guide fees, and 862 trail cameras in the back of my truck, I'm sure I could figure out exactly what day the buck becomes hard horned lest another day go by where he risks a collision with an 18 wheeler, lions, indians, or poaching.
