Actually it is legal as long as the point originates less than 4 inches above the base of the antler, as per the hunting pamphlet.
"Spike Bull Antler Restrictions: Bull elk taken in spike-only game management units (GMUs) must have at least one antler with no branches originating more than 4 inches above where the antler attaches to the skull."Looking at the photo, the elk does not appear to have a branch originating more than four inches from the skull, particularly on its right side antler. That would make it a legal spike.
