just when you thought it was safe to go buy a assault rifle again a Conservative (Neal Gorsuch being included) wouldn't hear MD's assault weapons ban law suit.

The Supreme Court refused Monday to hear an appeal from gun owners and dealers in Maryland challenging the state’s ban on military-style rifles and detachable magazines.

The Maryland General Assembly enacted the ban in 2013 after a gunman killed 20 children and 6 adults at an elementary school in Newtown, Conn.

The article didn’t say what the vote count was to exclude the case. The judge quoted in the article wrote the majority opinion. I wonder what the count was and how they each voted.

Still all this just sucks should never have to leave a city/state or other to practice what is supposed to be uninfringeable.

Heller affirmed that regulating access to weapons with primarily a military use was allowable so I'm not too surprised.  All rights have some type of limits associated with them and I expect something to trigger a case someday to help clarify what is allowed to be banned and what isn't as I have no doubt that will be tested in some of our favorite states.

That's why when Heller was first announced I wasn't all dancing in the streets as everyone else were. Scalia by not saying it was an absolute right and that municipalities or states had no right by majority or otherwise to regulate didn't really do us a favor. It was a compromise decision: Gave us the right but gave them the right to infringe.
