He makes a great point. The right pre-exists the constitution. Perhaps it shouldn't even have been placed in the bill of rights. Scalia was interesting and a lot of people forget his decisions where he struck down 4th amendment search and seizure practices. Many of those decision would be labeled decidedly liberal by today's standards.
