FFL / background check / serial number question
« on: October 23, 2020, 06:32:05 AM »

A wife asked me if the government has a database of who owns guns. I didn’t have a good answer..... when you buy a gun and the store submits the background check, is that linked to the specific firearm you are buying? Or is the background check separate from the purchase? Another scenario is if you and a friend go to a FFL to trade firearms with each other, is the FFL required to report the names and serial numbers and names to an agency?

Just curious, not planning any nefarious actions, geez.

I know the gun shops keep the transfer paperwork on file (indefinitely). That’s what I was told last week when we transferred an “assault weapon”  :chuckle: .   They also required my 1639 compliance training document for the first time ever.   Oh yeah and you now have to check a box giving up your medical records privacy for mental health.  That’s right.....now they have access to your private medical records and history.

With the above being said....if you think they aren’t watching and keeping records, your wrong.  Big brother is watching always.

That is the reason all recent sales, purchase's and trades have been done in driveways and or kitchen tables.

It is my understanding that prior to the whole "AW" and i1639 compliance stuff the shops would keep records and they'd stay in house.

Now they report pretty much everything to the state

When you would submit the background check it was pretty much asking the feds is this person legally able to own this type of firearm.. handgun, rifle, other. That's all that would matter. The feds could care less what specific serial number it was to associate it to you and therefore have a database.

More strict states are definitely trying to create one (CA) but they are the ones who are pushing the agenda to implement them within their borders. The feds could care less.

Now if you get on the feds radar for whatever reason then they'd probably visit the shop that submitted your background check and then go directly to the shop to get the rest of the info as far as which specific firearm you bought etc etc.

I reserve the right to be 10000% incorrect but this has been my understanding talking to LGS that I frequent over the years.

Also the NFA is a sham

And that is definitely a federal database for the extra spooky guns and ATTACHMENTS THAT ARE NOT FIREARMS.

To the best of my knowledge, WA has a database containing handgun purchases legally made through an FFL, but I don't think that list contains any long guns or shotguns.

When I renewed my CPL one year, they accidentally gave me back all the paperwork which included a full background check.  In that check was a list of handguns I have purchased in WA going back to the 90's.  I don't know how far back the database goes as that was my first handgun purchase so it likely goes back further.

I believe this has changed to include "ALL" semi automatic firearms now.  This goes along with the 10 day minimum wait period and additional paperwork....your ruger 10-22 is now an assault weapon and they now treat it like pistols previously.   This may be incorrect, but that is the impression I get.  Oh and you CPL only allows you to carry now and does not waive a wait period.

All true statements forgot about the whole pistol process. But again at the state level

The information submitted via a NICS check only notes long gun/hand gun.  No serial number or firearm information on that.  The PTA and the one for semi auto rifle does call out the firearm specifics and serial number.  The electronic 4473 also has the firearm specifics and serial number.

Clear enough?
