Legal Question

I have a legal question, so where do I turn, but to all the legal experts on here. LOL

I was listening to a deer story the other day and the person was describing how they got their deer.   It was spotted at over a mile away.  THey made a go at it guided by their dad with Cell phones.   He sat and watched the deer with the spotter and talked them right into it.  I think that used to be a thing, where you couldn't do that with 2 way radios.  Of course I am dating myself, are there even two way radios anymore.   Anyhow, do cell phones fall under that rule, did that rule disappear? Seems to me impossible to prosecute even if it was.   

I didnt say a thing, but I was curious.

Pretty sure in Washington and Idaho its legal to hunt that way but under P&Y and B&C they cant be entered in the books. They consider it Not Fair Chase. There was a couple of guys out of Boise that did that with success and entered some nice bucks in P&Y. I had words for them that they did not like  LOL

I think thats the same as using a drone to spot, or should be.

Haven’t heard it being illegal here. But I know it’s illegal to transmit the location of game to others with the intent to hunt them in Montana. Some years before we find an unused channel we  hear lots of coded talk over the radios, whole bunch  of whilmas down below you, a few bambams  and one Fred on the south end Of them. Or replace with heifers, steers, and big angus bull… you get the idea. Even where it is illegal they still get around it

I thought at one point it was illegal in this state.  There is a wac that states something along the line of radios / telemetry is illegal.  I guess I need to see what the definition of telemetry is for purposes of hunting are.

I believe the WAC you are referring to is 220-414-010.

I'm not aware of any legal restriction in Washington against the use of two way radios, phones, or other communication devices while hunting.

Hunting equipment restrictions.
(1) It is unlawful to hunt all big game with the aid of infrared night vision equipment or with laser sights (not to include range finders) capable of projecting a beam onto the target, while in possession or control of a firearm, bow and arrow, or crossbow.
(2) It is unlawful to use radio-telemetry equipment to locate and hunt wildlife with transmitters attached to them.

I remember a hunt years ago that my Dad guided me into a single quail that had flushed and he watched land.  We had the little Motorola 2 way radios and I managed to walk right in and dropped the bird.  After we got back together, my Dad said "Now that didn't seem too sporting did it?"  I agreed.  This has stuck with me since then and I've never tried it again.

As far as I know not illegal here but I do think it’s against pope and young rules.

I always had it in my head that the radio thing was illegal for some reason

Not legal in Iowa - brother radioed me to pick him up on the other side of field but he got a lift with his buck from a farmer.   Gamey wanted to ticket him for use of radios, gun not in case in vehicle, farmer no orange on when assisting him loading meat in truck,  field processing,  etc.  Different world there!

Yeah , I'm sure 100% of the animals entered into B&C and P&Y are all legally taken
