I wonder how long before the courts strike this down. It puts an undue burden on citizens to exercise their rights and doesn't provide funding to LE to perform the class necessary to obtain a permit. The sheriff's association is also questioning the constitutionality of this initiative.

How are they legally getting so many items on an initiative? I thought when an initiative was voted on it was for one item? So showing your photo ID, every state already requires this, and more background checks, everyone already does this as well, will help right? I would say unbelievable, but anymore that is not the case.

I agree. If the voters actually paid attention and rejected these illegal initiatives, and voted out the feckless useless politicians that vote for these unconstitutional laws, we could fix a lot of what is going wrong. Not likely to change quickly. Those of us who are aware of what is going on need to help our friends, neighbors, family, and acquaintances see the need to vote correctly and spread the word.
I would like to see a penalty accessed against politicians who sponsor  and vote for blatantly unconstitutional laws. Before anyone gets all excited, I didn’t say we should do it immediately, it might be unconstitutional.

This in my mind one of the worst laws ever too be brought against 2A. And you can bet Ferguson and Ensely are rubbing their hands together wanting to bring it to WA.

Ya have to get pi%#&* off at anyone who thinks this is a good idea. Being nice ,nice isn’t going to get any where the folks that push these laws don’t care if you are nice or not they are in our face trying to disarm us and smiles and soft talk is not going to deter them. I believe a law suit can be filed once the it actually becomes law.  I read that it has now been delayed a short time.  A little off subject but remeber 1639 for 4 years ago here in WA.  Part of that was for annual background checks for those with semi auto rifles and pistols.  It was put in the back burner because wsp couldn't afford to do it.  Well it is coming off the back burner.  I know a couple of guys I work with in OR and WA that want to move to ID just on the border.  Close enough to a degional office so it isn't a bad commute.

Right now a judge put a 10 hold on the law so I think that isn't true anymore.  I also don't think alot of people know there is a hold on it.

I'm an Oregon resident again as of last year, after prior 8 years in WA, 2 in ID before that, and almost 40 in Oregon before that. 

The writing was on the wall as soon as the measure was approved to be placed on the ballot.  So I began stocking up on guns and magazines all summer and fall.  I'm shocked the measure only passed by 32,000 votes.  And even more shocked when looking at vote tallies that over a quarter of a million Republicans in rural Oregon didn't even vote this year.     It's a mail in vote, and is ridiculously easy to do.  It is so frustrating.


The NRA pointed out to the Secretary of State back in June that the specific statute listed in the bill for enforcement on the 10 magazine limit doesn't actually exist in Oregon law.  The response is the legislature will have to fix it after it becomes law....they had months to fix it prior to ballots being printed.   So frustrating the SoS allowed voters to view a ballot measure that can't even be enforced with it's current wording.


The gun buying began en masse in the weeks leading up to election day.  And then increased dramatically after the law passed.   As of last Friday there were over 32,000 people in the backlog check queue.   There are guys in the queue that bought their guns two weeks before election day that wouldn't even get their guns due to a law that hadn't even been voted on.   People are going backwards in the queue every time a CHL holder applies to buy a new gun.  Thankfully I'm one of the rare instant approval guys, so was able to keep amassing guns without having to get stuck in the queue. I sat down and decided what all firearms I would want some day, as I have no plan to ever apply for a permit to exercise my constitutional right, and bought what I could find off my list.  The upside is I have a really nice arsenal now.   


The Oregon AG argued in front of the federal judge that the permit process would be in place on December 8th.  The OSP and Sherrif's association filed a complaint with the judge that wasn't truthful, which required the AG's office to amend their statement in writing to the judge.  So the permit process has a stay issued by the federal judge for 30 days.   But she wouldn't stay the magazine limit, even though the enforcement statute referenced in the ballot measure doesn't actually exist.   She was ready for the attorneys, and frankly the attorneys arguing to overturn the bill are not very good attorneys.  The judge stumped them at every turn.   


A state judge in Harney County has staid the entire bill citing the Oregon constitution.  But the Oregon AG is doing an emergency appeal to the voter-elected supreme court of Oregon.  They are likely to overrule the county judge.   But we shall see.


For now everything is frozen.  Online retailers stopped all magazine shipments last week.  FFLs had stated before the stay order that they won't sell guns to anybody except the instant approval folks.  Now that the stay order on the permit process is in place, the OSP should be resuming clearing all the background checks.   I don't know if FFLs have resumed selling firearms again or not, I'm talking to my FFL this afternoon on another matter so will see.   It's such a poorly written law, even the people that wrote it want it modified so their precious law can withstand court challenges.....


Oregon is home and is where my family is so am not moving again.  I've bought enough guns and magazines for my lifetime.  So am good.  It will take years for this ballot measure to get appealed to the Supreme Court.  Hopefully the folks trying to overturn it hire better attorneys.....

I'm kind of shocked the liberal Oregon Supreme Court just denied the state Attorney General's request to intervene against the temporary stay order from the Harney County judge.  I thought for sure they'd step in on emergency request.  Sounds like they will let that judge play out the next two weeks of review.   So the entire measure is temporarily halted at the state level from being implemented pending the next hearing.   Unfortunately there is still confusion at stores and FFLs on what this all means as midnight tonight is when the law was supposed to kick in.  All >10 round magazine sales had already been blocked.  I'm assuming this means OSP will resume trying to clear the huge backlog (>36K) of background checks while the implementation of the measure is on temporary hold.  But doesn't sound like any FFLs are changing their policy regarding >10 round magazines or new gun sales.  As nobody knows how long the temporary hold on implementation of the law will last.

Beyond the magazine capacity this law seems to just do everything an ffl already does ? Once for the permit and again through the ffl? Besides Oregon not being able to process the permits for a long time. What did the voters think the bill was accomplishing? I understand it adds bureaucracy and problems and will take a long time to implement. It’s a nightmare for the Oregon gun buyer. But what did the voters think was the benefit of 2 background checks etc. ? I read the bill before it was passed but not recently so I might be missing something.
