So my brother hit me with the oddest question . He is a certified diver  rod and reel season starts before Spear season  in marine area 11 he wants to dive with a rod and reel and basically try and catch them :…… now is this legal ? I know wild but  can’t see why not other than he has to dispatch them and measure them I dunno any input ???!

No idea on the legality of it but I do this with my kid's kiddy pole and snorkel gear at the lake we camp at lol. Just perch & bass though.

I would imagine it’s legal but I think he should get it in writing was my opinion . Gonna have a heck of a time dispatching I dunno though

I would do it, there is nothing in the regulations that says the rod and reel have to be above water.  I've seen it done, but not up here.

Really far, only in one direction though.  It would be interesting if a seal nabbed your fish, best to have a knife handy.

A diver buddy of mine use to do this (jigs without hooks as he did not want to keep anything).  He targeted Rockfish.  He found they miss the bait at least half of the time, with some species being much worse than others (I want to say tiger rockfish had an abysmal success rate!)

I believe what’s makes spear fishing regs different is the fact you’re using a spear. Not because you are in the water. Should be perfectly legal.
