I have been asking WDFW to clarify handgun hunting rules between the firearm restriction zones and the rest of the state for a bit now without luck. While I think this case is reasonably straight forward (I hope) there are some inconsistencies that it’s not clear to me which takes precedence.

What's unclear for you?

PBush509, what is your question around pistol vs SBR on the same platform? I'm missing some information that would help me understand why there is a grey area to you.


I should have clarified more. It is more with more with pistol brace federal case being remanded and send back to the original court. I feel like this is potentially too vague as a decision has not been made yet and depending on the WDFW person that potentially would see me out and about could say I am using an SBR vs an AR pistol. But I may also be confusing other states laws about hunting and barrel length. I was double and triple checking to make sure barrel length minimums weren’t a thing for WA. Where it isn’t for hunting anymore. So I believe I am in the clear.

My understanding is, it tells us what type of weapon + caliber  we can use, which means other types are not allowed.

I am not a lawyer, but my friends that are like to point out the importance of language that inclusive or exclusive as well as the intentional inclusion and exclusion of subjects (in this case action types and barrel lengths).

I should run this by them, but with the word "May" not being exclusive I would interpreted as a recommendation from the department, but not a rule/law. 

On the inclusion/exclusion of topics, my understanding is that in law, if something is left off lawyers/courts assume it is intentional by lawmakers and thereby not regulated in the law. So that would mean no other actions (other than semi and revolver) are regulated even if the word "May" was replaced with "Must".

There is also a good chance that the regs are written incorrectly from what the actual law is, sometimes I think we forget the game regs are a highly summarized version of the actual laws/rules.

I guess I should clarify more. It was moreso for the entirety pistol brace rule being remanded and whether or not WDFW or game warden happens to see me out if my odds would be better with an SBR or just slapping a pistol brace on a normal lower when I hunt. But I might just be overthinking it.

Washington state never changed their rules about braces. I hunted with a braced pistol yesterday.
