300 Blkout AR Pistol for blacktails
« on: August 28, 2024, 09:36:18 AM »
I am trying to double check myself on laws with this so I avoid any issues. I am mainly trying for mule deer in central/eastern WA this year. But on the other days I am staying close to home and hunting blacktails on public land. Since 300 blackout is a .30 cal round I am okay to use the round. But the weird grey area I am seeing is within the pistol vs SBR ordeal. Can I use my AR pistol with a brace or should I use an SBR lower to ensure I am legal. I was trying to avoid bringing a 308 bolt gun due to the distances on the public land I would hunting near home. Let me know what ya'll experienced hunters think.

I believe you are legal either way.

We need to add to the nuance here.  If you're going to be hunting on public land such as Tiger Mountain, or even private land that's in a firearms restricted area, your .30 cal semiauto pistol is not a legal weapon. So, are you going to be hunting a firearms restricted area? If you're not, you're fine.

Great point dreadi

I have been asking WDFW to clarify handgun hunting rules between the firearm restriction zones and the rest of the state for a bit now without luck. While I think this case is reasonably straight forward (I hope) there are some inconsistencies that it’s not clear to me which takes precedence.

What's unclear for you?

PBush509, what is your question around pistol vs SBR on the same platform? I'm missing some information that would help me understand why there is a grey area to you.

In the general state there is a min caliber of 24 and a min barrel length of 4”, for firearm restriction zones the way I read the regs there is no barrel length restriction and caliber is dependent on action type.  40 cal min for semi auto and none for revolver. That seems odd enough to be an error, does the min barrel length from the state regs supersedes and actualy applicable here?  One might assume so, but then the caliber restriction clearly does not, so…

It’s weird enough that they wanted a pretty large caliber semi auto, but then to allow a 17 cal centerfire if you hunt with a revolver seems incoherent.

The 40 cal and semi is the minimum for firearm restriction areas. All other areas follow the 24 cal and 4 inch barrel no mater what handgun action it is. The 40 cal requirement for firearm restriction areas is so you don't use high power rifle caliber in a pistol.

Contact the sheriff where you want to go…. I think you will get a favorable response

This seems to be the most logical reasoning. Effectively this prevents the 300 BO from use. I would say they don’t actually say that .40 is the minimum, they only say that it is allowed to use .40 or larger. They don’t specify that using less than .40 isn’t allowed. So based on that logic I think you have a good point here, I would try the sheriffs office as was mentioned. The caliber is fine for hunting, it’s more or less whether you can legally shoot that weapon in a restricted area. So if your aren’t in a restricted area, then you have nothing to worry about.

I see what you're saying. It's a confusing deal with you can't take a semiauto .30 cal pistol or a .30-30 lever gun but, you can take a .30-30 revolver!

Agreed, and there are many other holes I am not sure what to do with.

What about a 30-30 lever gun that’s a mares leg?  Those are considered handguns, but they didn’t define anything for actions other than semi auto or revolver.  What about bolt action pistols?

If they are trying to keep AR pistols from hunting, we can still use 400 legend, 450 bushmaster, 450 Beowulf, etc.

I guess my point is the verbiage is not complete and it's not clear if the state rules have authority where the firearm restriction zone rules don't specify.

You bring up another great point that I actually missed initially. That word "MAY" is not exclusive, which means a 300 blackout is legal.  But again, seems more like a typo, otherwise why even write it.

Quote
Modern firearm tag holders may hunt during established modern firearm seasons with bows and arrows; crossbows; muzzleloaders; revolver-type handguns; semi-automatic handguns of .40 (10mm) caliber or larger; or shotguns, so long as the equipment and ammunition complies with department rules.

I guess my whole point here is these rules are a complete mess, and I would like something more solid than a LEO told me it was ok. Ideally I would like them to clean up this nonsense in the regs, but an email clearly writing out what is legal would do.

I should have clarified more. It is more with more with pistol brace federal case being remanded and send back to the original court. I feel like this is potentially too vague as a decision has not been made yet and depending on the WDFW person that potentially would see me out and about could say I am using an SBR vs an AR pistol. But I may also be confusing other states laws about hunting and barrel length. I was double and triple checking to make sure barrel length minimums weren’t a thing for WA. Where it isn’t for hunting anymore. So I believe I am in the clear.

I thought the feds said the arm brace was okay. As long as you follow state laws you have nothing to worry.

My understanding is, it tells us what type of weapon + caliber  we can use, which means other types are not allowed.
