I think the morale of the story is that you fellas absolutely LOVE to have the baiting is illegal discussion!!!

Im shocked when a fishing story doesnt bring up a big fight about baiting bears...lol

          hey, I caught a steelhead this weekend!  REALLY? WHAT DID YA USE FOR BAIT? ummm I used a sand shrimp! WELL,
          JUST REMEMBER ITS ILLEGAL TO BAIT BEARS!!!   WTF??  lol

I know we like the bait fight but good god how many times do we gotta have the same discussion? I bet BTKR and KillBilly have had to quote the bear baiting regs 600 times...lol 

Any way, I saw a small bear...no where near bait...not near a trail camera...I didnt shoot it...I maybe should have...  thats the story! ;)

Well I have never hunted before so this whole bait thing is new to me...I wasn't doing it when it was legal I read the laws and interpreted them best I could....this discussion I thought was pretty darned informative other than a couple posts.......it is worth talking about before you are standing there with a dead animal and a gamey asking questions.....I prefer to not screw up because I hadn't thought to interpret something a different way.  I have all kinds of my own rules and ethics that are mine and have nothing to do with the laws....but learning the laws and how they might be interpreted is extremely important to me.....

thanks for starting this Longtat even if it got hijacked and went sideways.....

I know this thread needs to end but baiting for the sole purpose of taking pictures or viewing bears is not illegal.  Asking a F&W agent or any cop for that matter about laws only gets you the "I would or wouldn't cite you or arrest you".  I am of course only going off of the baiting for purpose of hunting RCW,  there may be something else in regards to feeding wildlife.

RCW 77.15.240 states: (d) As used in this subsection, "bait" means a substance placed, exposed, deposited, distributed, scattered, or otherwise used for the purpose of attracting black bears to an area where one or more persons hunt or intend to hunt them.  The first paragraph of the RCW does say "attract", however, subsection D further clarifies that the intent to hunt is required to be in violation.  In my opinion no gray area in this RCW.

You have to intend to hunt the bear(s) that are being baited.  A photographer that does not hunt has nothing to worry about.  A hunter on the other hand would have a harder time proving beyond a reasonable doubt that s/he had no intention to hunt the bear(s).

Thats awesome, I didn't see that post about pulling the cam and bait.  Must have been in the trailcam thread.   If that bear in the picture gets killed by the person that  owned the trailcam I would have to say it would be a violation of the RCW.

You baited a bear to your cam then stated your intent to hunt said bear.  I haven't seen anything too brutal said about it at all.  I think people were letting you know that you probably shouldn't hunt that bear, maybe a good idea to just not hunt capitol forest at all while bear is open this year.  I would say you are fine at this point but an agent may say you are already in violation of the RCW, being out there "loaded for bear" as they say may compound things.

Sounds like you and Cat were on top of things.  Sorry this thread got out of hand but I did find it educational.  BTW If I ever post anything on here that is legally questionable I would really like it if someone would point it out to me (politely if possible).  That doesnt sound like that  was the case here just a little misunderstanding.  We all try to stay within the law but they are also very confusing sometimes and not all the info you need is in the hunting regs. 

You should have shot that bear.   :chuckle:  I bet a little bear veal is sounding pretty tasty about now.  Save the second tag for a trophy.

i read this thread and it sounds like people have the internet badges in full force over the baiting issue :bdid: way to go tat on findin a bear!!! even if you didnt shoot it. i am looking for my first this year. bought an idaho tag and a WA tag. hopefully i get a good shot at one between the two!!

easy Miles! easy!   no one is hunting anywhere near the old cam site! You like to get people riled up on here...so do I but in a much different manner! Your not friends with catwithboost and where me and and cat both come from...calling someone a poacher is fighting words! When someone like killbilly teases him...  or BTKR, Iceman, or boneaddict teases me about killing milk suckers...theres no issue! but even calling someone thats not your buddy a poacher jokingly can cause real problems!  as iceman said, cat is a stand up guy!


You take it easy there big guy, I don't ever remember using the word "poacher".  

There's obviously some shady *censored* going down though, and that's only obvious.  When he blatantly posts, "I've found him, pulled the bait and now it's just a matter of being there at the right time"   there IS a problem.   In the end someone else will ultimately decide right from wrong...
Before the season started I was pm'd by 2 mods on this board saying that what I was doing is not legal. So I have never sat on the spot that I had my cam. Yes I was in the same part of the state. But not on the spot my cam was at. I do not have any interest in lossing my rights to hunt for a bear or any other animal. This is only my second year hunting bear and 3rd year hunting at all since I was 18yrs old and I am 38 now. I still have a lot to learn and did not now what I was doing was wrong. Then found out it was and that was the end of it. Take it how you want!!!

Thats all I needed to hear,  obviously I was not aware that you had been informed anything by PM.  Was never trying to imply anything just trying to give my opinion on that bear possibly getting you in trouble.  Trying to be helpful, guess it might not have come across that way.  Basically,  was saying if you shoot that bear and they want to make a case out of it you could be in for a long one.  Personally I wish you could blast it since you put in the work to locate it, I could care less if bait brought it into the cam and you wanted to hunt it.  But how I feel about certain laws doesn't matter to those who enforce them.  At least thats the impression I get when they throw me in the back of the car.
