Another Poacher has been caught Red Handed Who is this guy?????


This is a Quote from the Land owner !!!!!
The guy had been hunting in the area for about a week knew the area was closed to hunting and just for some reason decided to take a shot.  Shot the cow a little before daylight, wounded it and when I confronted him he just walked away down the highway with his weapon.  I had to dispatch the animal after calling 911 and getting permission from the dispatcher.  His buddy stayed around for a little bit and then left.   I call 911 but no game warden was able to respond, so two Cowlitz County deputies responded. When they arrived the shooter and his friend had returned, wearing hunter orange and acting like they made a mistake.  The deputies started talking to him got his statement and then ticketed him for shooting from the road, and gave me a paper to write my statement.
The decision on what to write the guy up for was already made by the deputy before he even took my statement.

If you look at the law, 1.)  He had shot at an early hour, wearing no hunter orange as stated in the game law.  2.) He shot from the middle of the State Hwy.  3.) He discharged his big game rifle 225 feet from a cafe, commercial building. 4.) He shot the animal on private property, next to a not hunting o trespass sign.  5.) They both had been hunting in the are for a week and knew that the area they were shooting into was closed and had been closed and they were told it was closed by the person they were staying with, who lives on the property.

They were fined $200 for shooting from the road, and allowed to harvest the elk, this decision was made by the WDFW contact the Deputy was talking to.

what $hit they should of got like five tickets where was the land owner at to press trepassing charges and where are the poaching tickets in a closed area where are the orange violation tickets :bash: >:( :bash:

Man, that sucks!!

However, I am not a lawyer so I'm sure someone on here will correct me if I am wrong...but you could find yourself in a bit of hot water also if the individual you posted pics of here decides that he wants to pursue slander charges against you. You posted his pic without permission and then proceeded to accuse him of a crime/numerous crimes.

I am by no means saying that it did not go down exactly like you stated...I just wanted to point out that what you have done here MIGHT be grounds for slander.

I will, however, keep an eye out for this guy while I'm out and about.

This is the kind of crap,that gives all of us a bad name.What kind of lazy ass shots from the road,and violates property owner rights.As for slander this is a fact,not a mistruth people need to get in more peoples faces like this,and keep the scum bags out of the woods.

You need to take this to the prossicuting attorney   ... they can change the ticket, it's not to late...go get them!

Public photography is wide open

That’s the general rule. When you’re on public property (a street, sidewalk, city park, etc) you can take pictures of what you see. This means that you can also photograph private property as long as you’re not trespassing to get the shot.

Unfortunately, life is never that simple. There are a couple exceptions to the rule and other details you need to know.

Does the photo subject expect privacy?

Even on public property, you can’t photograph somebody who has a “reasonable expectation of privacy.” Basically, that means you can’t snap shots of people in the bathroom, a dressing room, or similar places. Ask yourself: “Would the average person expect privacy?” If so, don’t take a photo.

Along the same lines, don’t sneak photographs of people from bizarre angles. In essence, you can’t go around taking “up skirt” photographs. Even if you’re on the public sidewalk.


Slander is the oral communication of false statements that are harmful to a person's reputation. If the statements are proven to be true, it is a complete defense to a charge of slander. Oral opinions that don't contain statements of fact don't constitute slander. Slander is an act of communication that causes someone to be shamed, ridiculed, held in contempt, lowered in the estimation of the community, or to lose employment status or earnings or otherwise suffer a damaged reputation. Slander is a subcategory of defamation.

The basic elements of a claim of slander include;

   1. a defamatory statement;
   2. published to third parties; and
   3. which the speaker or publisher knew or should have known was false.

Slander is primarily covered under state law, but is subject to First Amendment guarantees of free speech. The scope of constitutional protection extends to statements of opinion on matters of public concern that do not contain or imply a provable factual assertion. If the slander unjustly accused you of a crime or reflected on your profession, the court or jury can assess the damages. For other types of slander you generally must prove some actual damage to be able to recover.

Slander of title is a common law tort involving a disparaging remark regarding ownership of property. It affects the owner's ability to transfer the property, resulting in a monetary loss.

Totally UNACCEPTABLE !!!!!!!!  At a minimum, that man ( and his buddies ) should loose his hunting rights in this state.

$200 for an elk, cheaper than buying beef.  Now everyone will be shooting them off the road in closed areas.

Bring it to an actual game warden and he can open the case and further investigate. If the things you say are true, it should be a slam dunk case for any gammie and believe me they would be happy to investigate it. You might even get some points for turning in a poacher.

Unfortunately our stinking state keeps cutting back on enforcement.  There simply are not enough officers to respond.  My guess is most of the gameys are at the hot spots like Winston and already have their hands full.  Like said before, take your case to a real WDFW officer and ask to have it investigated.  You might can get these guys for trespassing on private land with the Sheriff's Dept..
