killzelk...are you a hunter? i haven't seen a post you've made on here that was about your hunting ventures. most of which are anti-wdfw, anti-master hunter and anti-a lot of stuff...but no hunting posts or anything positive for that matter. what do you suppose the right thing to do is in this possible trespassing and/or poaching  situation?

Jackelope, good question IMHO, just checked Killzelks post history and a bit strange.....almost exclusively in Hunting Activism...hmmmmm.....not that there is anything wrong with it...but still a bit strange since most members post in many many different areas it seems....

I follow several meetings and and organization in Washington state I am at the Capital right now for Fish & Wildlife Commission Meeting took the day off to be here hope all of you are here also to voice what is important to all of us. I am not a Lawyer so I am not sure what the right thing to do is in this possible trespassing and/or poaching  situation? I have shared several of my adventures in the Chat forum. I don't live on the site I work 24/7 wish I could spend more time on the site with all.

call wdfw and report it to the enforcement division if you think it is poaching. you can go to their website and email them too...
you don't need to be a lawyer...especially if someone broke the law.

Hey killselk it was a pleasure to meet you at the meeting, it's to bad more people don't show up and try to make a difference.The new director was very concerned about this matter,and i got mark in touch with him today.He assured me he would make sure this person,would be prosecuted to the fullest extent of the law.That's all a guy can ask for B Barnes keeping public lands public.

Should have went to his house mixed 1 gal of gas with 3 gal of diesel.  Grab a funnel and a knife.  Role that elk on its back, open it up dump the mixture on the inside. Dump some down it throat.  Up its ass.  All over the out side and lite that thing up. 

Cops show up...  Tell them this dude shot it.  You are having a BBQ and offer them if they want some when it is done.   Be sure the cops make the dummies knotch their tag.

Sir, I have worked in law enforcement for many years and have written many hunting/fishing tickets. Because of this I want to explain some mistakes you made, as well as the penalties for the crimes you listed..

#1 Shooting before hunting hours... It is a misdemeanor with a fine of $150 bail forfeiture

#2  No hunter Orange on when this took place... In this incident no officer or prosecutor would charge this person with this offense because it is not even a crime, it is an infraction with a $87 fine. Charging someone in this incident with this offense would be like charging a person who is in jail for murder for going through a stop sign..it just wont happen..

#3  Shooting from road / Discharging firearm from roadway...It is a midemeanor with a fine of $250 bail forfeiture

#4  Discharging firearm 500 it from business or resident...Believe it or not this is not a actual offense, it is an ethical violation not a law violation. UNLESS this ocurred in a WDFW Safety Area which are often at WDFW Pheasant Release Sites

#5  Trespassing with a firearm equals Criminal trespass witch is a felony.. Criminal Trespass is not a felony. In this incident the person could be charged with 2nd degree Criminal Tresspass which is a mandatory court appearance and is a misdemeanor.


So after all the person is looking at a $400 bail forfeiture (which means you can pay without seeing a judge, just like a traffic ticket). And depending on the person's criminal history the judge might assess a couple hundred dollar fine (maybe $500). But if this person has a clean history the judge would likely give a deferred sentence which is basically probation for a year and no fine

I'm surprised they didn't get a ticket for trespassing.  Isn't that a no tresspassing sign right behind where they are gutting the elk?  Or were they still on the public right-of-way of the highway?

Also, where exactly is this?  Maybe I should sit there next year waiting for an elk.  Hell, I'd be off the road if I shot the elk.......that way I wouldn't get the shooting from the road ticket.
