I would try to stop him first, but definitly a shooter. Never would take a shot at a briskly walking deer let alone at 40 yds.

Look at his back legs they are planted he may have his front leg lifted because he is either alerted, or getting ready to walk.  As for passthrough with an arrow there I wouldnt be concerned with a rifle that would be a different story.  Hard to make the call looking at a picture if he is indeed getting ready to walk, and stationary I would drop him.

I voted pass because that isn't the buck I'm after.
If it was the buck I wanted to shoot though, I would be at full draw and give him a bleat. As soon as he stopped it would be on it's way

Would go with the safety.  The guy on the other side of the hill is going to shoot at the same time you do and both of you will get hit with the stray arrow.

I said I would shoot mostly based on the size of the buck, but I wouldn't shoot at a "briskly walking" target. Try to stop it or let it pass but I would certainly continue to give chase if he made it over the ridge!
