I just returned from my hunt and wanted to post a picture. I have had cameras up for months, date stamps were correct. Just wanted the guys who decided opening day was just to long to wait to know they should really look for trail cams when you are doing illegal things. This was taken on the 2nd and I have 12 photos of them. also save the responses on maybe they were bear hunters, or deer hunters, they both had very clear bugles around their necks. I know some will be mad I'm jumping to conclusions on photos, but If I were a fish and game officer and found two guys hiking out the day before the season, with bows and bugles they could/would be nailed for hunting out of season. so my conclusion is based off of that. and don't worry this photo wouldn't cause any sort of arrest, I just want to frustrate and expose people who poach (or attempt to). The only bonus is that they didn't get anything based from the photos I got of them walking back to the truck with all their arrows in the quiver.

While I agree with your assessment that they were most likely elk hunting, before the season opener, I bugled a couple of times, before the season opener, while deer hunting. I bugled because I've never learned how and wanted to practice, and because I figured it'd help me figure out if any elk were in the area, even though it didn't help at all. There were elk in the area, I later learned, but they weren't talking at all.
The only difference is, my bugling SUCKED and my bugle was left in my backpack until I was sitting on a stump...lol
Then there's also the whole idea of using cow calls to call in a bear. This probably isn't the case, considering the visible bugle tubes, but my son swears that his cow calls, through a bugle tube, are more effective than without the tube...

I don't know that just because they have a bugle tube in a unit that is open to bear hunting and deer hunting makes them poachers. I didn't realize you cant try and locate a herd why scouting a few days before season is poaching. So many want to be internet police on here!!

Heck I was practicing my bugling while huckleberry picking, before any hunting seasons were open. Instead of my bow, I was carrying huckleberry collection bags...lol

Lol, I knew I would get strong reactions, I just think they (dfwl) would have you dead to rights if you were bugling while hunting armed with your bow. Call me out if you want, I just don't think its right. I'm not saying bugling isn't ok or calling to elk while scouting, but it's either one or the other. You can't be carrying around the weapon about to be in season, while calling for elk before the season, do you really think that would be ok in the game laws??? Im not saying they aren't good people but they are not legal. sometimes it is a mistake, but opening season dates? no. RTSPRING not just scouting, hunting. the only thing they didn't do was release an arrow. I hunted the whole season with elk calls and my bow and didn't release my arrow, does that mean i wasn't hunting? If I had a bear tag but no elk tag and got checked, would I get a ticket? YES..... I may be wrong, Which I'm sure someone will correct me. I respect all your opinions thats why I posted it.
If you all don't agree, then I believe we need to have this conversion on what is legal/ moral. lets talk.

Let's put it this way, If I'm wrong, I'll be the first to apologize , but You could also say If they weren't doing anything wrong then I might be saving them or someone else a ticket by bringing the subject up.

I've known some folks on the Queets to locate and stay with an elk herd DAYS before the opener.
I guess I would be a would-be poacher because I carry a rifle with me a day or two before deer season opens. Good story for a wana-be inter-net cop.

This should be taken down it is not right I believe to post pictures of people you don't know and accuse them of poaching> I personaly have no idea who these two are and don't care. Many people have bugeled before and after season and they are not poachers just locating elk like you are with your camera maybe your poacher

So if you are so sure it is illegal please show in the regs where it states that you can call to an animal when the season is closed. Plus I guess I was poaching this year when I was bear hunting because I used a cow call to try and call in a bear.

Nothing like scouting, just like you were going to hunt.. I just have a hard time judging someone when no PROOF is there.. Its hearsay at best! Yes there are poachers but facts are facts.

If that is the case, I apologize and removed the photo. But does anyone else believe in what I believe? I said that I am the first to stand up for what I said and believe, including when I'm wrong.... any one else have an opinion?

This is the kind of stuff that occupies a big portion of WDFW Police time, responding to junk like this then when you get something 'real' they are off messing with this crap.

Was there a good chance they were poaching? Yes, I would say there is. But at that point you had no proof of anything and we are innocent until proven guilty. Posting a pic like that and saying what you did is an anti tactic. And we as sportsman CANNOT play those games against each other.

If there was a WDFW agent watching them he would have remained hidden and waited for them to actually break a law. Such as calling in and shooting an elk out of season. Until that was done there wouldn't have been any violation. Not saying he wouldn't end up making contact and seeing if he could get them for something but without releasing an arrow at an elk I don't see a violation.

I think by definition poaching is killing an animal illegally, so by that same definition these guys are not poachers until they have killed something illegally.

I was carring a bugle and my bow before the elk opener. deer was open and I figured if a big buck showed up i'd drill him . we stalked a palibid but that ended up being a two point and I've whistled them with a bugle when they looked spoked , it works . go up to the clockum and see how many locals go up and bugle elk in the rut it's nuts and I'd bet a bunch of those boys have a gun in there truck . If they where stalking in and going to full draw then I'd say they had ill intent . :twocents:

I was once told by a WDFW warden that the way the law reads hunting is considering in pursuit of a big game animal. He told me he could have ticketed me because I was doing a deer drive without a valid rifle deer tag. I archery hunt had already tagged out that year. He said technically he could write a ticket for scouting, taking pictures anything he wanted if you were doing it without a valid tag. I went out with my uncle later that year and took a rifle to try and see if I could see a bear or cougar because I still had those tags and was ticketed for hunting deer without a valid rifle tag because I didn't have a predator. It got throw out of court but that year the guy got game warden of the year for Washington state I think he wrote over 500 tickets that year. Allen Myers was his name

Sounds like the warden was a power hungry tool that got beat up a lot in high school. Honestly if he was going to write tickets for hunters who are scouting then he doesn't belong in the position he is in.

Allen would be wrong. Taking photographs and bugling are protected, and in the the case of bugling, freedom of speech would apply.

Oh the people of Pend Oreille.. Some of them can be quite frightening lol :chuckle: Is there a chance that he was also over in the Republic area? I remember hearing stories of the locals running a doozie of a warden out of there also!?!?!

Why would you think they were poachers? As long as you got a tag in your pocket your hunting until you do something wrong right? Still a free country also why not carry your weapon ? Better to carry then leave it in your rig so some a-hole steals it and ruins your hunting season right.. there's been a bunch of stealing lately with trail cams and camps and whatever else people can get their hands on..not illegal to do that and it's a wise choice to carry anyways what if you came across a bear or a cougar and you left you weapon in your rig. People are always jumping to conclusion that someone doing something illegal when there not..my two cents.

stick with what you believe man... everyones entitled to there opinion... you can assume anything an everything you want... dont matter what anyone says....people will say what they want and "torch you" and make you feel like you dont know anything ...but it dont matter ....if you even had a clear picture of Big Foot they would still find away to talk you down.. Really? Thanks for the tip, I got a second deer tag in the clarkston deer unit. Not that I have anything to hide, but having someone look for anything at all to get you on can be a pain.

alright, First What I love is I'm castrated instantly to think a hunter carrying elk calls with a weapon the day before the season starts ISN'T poaching. to use an analogy that was already used on the post, NO you shouldn't be presumed to be a robber while carrying a side arm into a store (them with their bow), but You walk in with a ski mask and the side arm, people are going to start assuming your going to rob them (them with the bugle and the bow). Even though in court you wouldn't be proven guilty unless you did. But if a cop stopped you on the way in and arrested you, you would have some explaining to do. I'm so sorry my cameras didn't take the surveillance of them harvesting an animal that would satisfy everyone on here. Next time I'll try that, I'm not saying its RIGHT that they WERE HUNTING ELK but it was enough to make a person on a hunter forum with his peers assume they were. and use my free speech to say so.

so to evolve the debate (which clearly I am out numbered with :chuckle:) I called the dept of fish and wildlife and talked to a enforcement agent. TECHNICALLY they were not doing anything illegal if they had a valid tag in their pocket. BUT He said that it would have to depend on what was said in the interview of the hunters. If they had a bear tag or deer tag, they would be ok to carry the bows but they would have to articulate "very, very Well why they are carrying those bugles" he said that he only needs the preponderant of evidence (that's 50.1%) to write them a ticket/ arrest them. NOT innocent until proven guilty. He said most likely They were hunting probably for ELK and He would/ could have cited them for it if they met them walking out. He claimed it may not stick in court because thats where the innocence is presumed but walking with a weapon and calls for a season that is so close to opening would likely lead to him citing them. Most cases without a Killed animal is hard to prove in court.
He made an analogy that if I was hunting elk with my bow and I had it in my front seat, but I had a rifle in the back. I had a bear tag(any weapon) and an archery elk tag, He couldn't do anything. But he would warn me I need to decide if I am hunting Bear or elk because If I stepped out of the truck with both I would be nailed.

Castrated, really? You must have a very small set then. You'll probably want to put on your big boy pants the next time you create a whole story from a picture off one of your cams and post it in here. I suggest a couple small red potatoes stuffed correctly will give a better impression. :dunno:
Look, you are jumping to conclusions whether you like it or not, or want to admit it or not. You assume these guys are poaching but you really have no idea. They could be deer hunting and elk scouting, listening for responses. That's precisely why in a court of law they need actual proof, not conjecture about what they might be doing or want to do.
I don't have a problem with someone like you making a mistake. I do have a problem when someone like you can't admit that they've jumped the gun or might be wrong. The truth is you have no idea what those guys were doing unless you see them poach a bull. That's it and there's nothing else. You pulled the plug too soon and don't want to fess up to it. Don't be surprised when people call you out for it. I've done it, too.

I've often wondered about the "harassment" wording, in the regulations. Could calling, out of season, be considered animal harassment? I've heard, though I know not the accuracy of the statement, that's it's illegal to call turkeys, out of season, and falls under the animal harassment portion of the regs.

If those guys did not have bear tags and/or archery deer tags, then I would think there's no doubt they'd be in trouble. Although, maybe they were grouse hunting? :)
WDFW enforcement officers have a tough job for sure. I'm sure there's a whole lot of rules that are commonly violated, but in most cases nothing will ever come if it, because the would-be poachers are not successful. Or even if they are, what's the likely hood of there actually being a warden in the area to catch them?

So if someone sees you out in the woods with a rifle when there isn't any season going on, we can safely assume you're out poaching and not target shooting?
You got "castrated instantly" because you plastered someone's face on the internet hoping to see them get lynched based on your own erroneous conclusions.
And here's another little tip, warden's interpretations of the laws are just that, interpretations (i.e. each one differs and each one sees things differently). In fact the warden you talked to, might cite those guys one day and not the next, given the exact same scenario, including whatever is said.

I'm a photographer so this idea is somewhat near and dear to my heart. In the public, including on top of a mountain in a National forest, a person has no, what the law refers to as "reasonable expectation of privacy." If you want an expectation of privacy, stay in your home and remember to keep your curtains drawn. If someone is standing on the public sidewalk and photographs you in your home, through your window, the photographer is in the right. As long as on public property, with very few exceptions (military bases, some airport properties, some bridges) anyone can photograph anything.

Buck: I concede that I was wrong to assume they were attempting to poach based off just the picture: thus I apologized and removed the photo. But that doesn't change that I interpreted the law correctly. I may have jumped the gun on posting the pic but not on the assumption they were prob up to no good. Maybe, maybe not. I said I could be wrong. I presented the belief I had and many of you presented yours. what I can't believe is how many of you act like these guys couldn't have possibly been up to no good.

In law, it is always about interpretations. so....whats your point? Every supreme court decision is almost always 5-4 so even the highest court debating our oldest framework doesn't agree. I somewhat agree with you. But I dont see any problem with trailcams if they were clearly marked with a bright colored flag and the owners full name and contact information, as well as the date it was hung and the date its coming down. Kinda like some states manage bear baits. without that information, everyone of them is litter as far as i'm concerned.

I believe you understand that you have no hard evidence these guys were poaching, and should not have posted the picture. I found this out my self when I posted a picture of a man poaching clams, although my picture caught the poacher with evidence in hand.

That's ridiculous. You think we shouldn't have a call for an animal that isn't in season? When I'm deer hunting I cow call to cover my movements. I use a deer call when predator hunting. My elk diaphragms also make turkey calls. Crow calls make Turkey's shock gobble. As far as the guys on your camera, could they have been upto no good? Yes. But I think the majority of folks on here are like me and would rather give someone the benefit of the doubt until there is more evidence.

I'm with blrman I do the same thing. I have a bugle, coyote calls, cow calls and a few more ,from the time bear starts trough my muzzleloader season. I always have a rifle in hand. Its nice to know were the elk are at before my hunt starts. I am not a poacher, and I'm glad your not a judge.

I'll be out deer hunting, in the same area I was elk hunting in, starting tomorrow. At times I'll have my camera with me, along with my bow. I'll also probably have my elk bugle with me and use it. If I'm able to bugle another bull in, as I was able to the other day, I have every intention of shooting it...with my camera!

Having worked 15 hunting seasons alongside game wardens, most of them are pretty darned good at getting the truth out of people they contact. It ruffles the feathers of most honest hunters, but it does get poachers ticketed. The best wardens I've worked with have conviction rates in the high 90s-100%, they don't write tickets unless it will stand up in court. There are a few bad apples who hang paper on anyone they think may be guilty (that 50.1% preponderance previously stated). Based on my experiences working decoy operations, I believe about 40% of licensed hunters will opportunistically poach an animal, even if they didn't have any intent before an illegal animal was present.

no thanks.. ive heard some sketchy situations where a bow doesn't cut it. Ill pack ny sidearm every time I go out archery hunting. When you can shoot twelve arrows in under 3 seconds ill consider ditching my pistol.

I think there is some truth to this. I would be willing to bet at 30 yards I could hit a smaller target with my bow than my 9mm. But as 10th said I can't shoot enough arrows fast enough to stop a charging threat.

40% of road hunters during daylight hours - real hunters are already in the woods gettin er done :tup:
All I'm saying is your 40% might be skewed due to the "wardens" knowing when and where to target to maximize results.

I dont see tgat you have time with a bow if being charged or attacked. A pistol should be carried. I know coach didnt but I sure as hell do anytime I am in the woods!

At the last second he heard something over his right shoulder and turned to look just as the cat jumped on him. The cat ended up glancing off of him and basically took most of his ear and left some nice scars on his face. When the cat landed in front of him he was face to face with it. The cat lunged at him and he turned away as he half drew his bow (and without aiming) let the arrow go. Only by LUCK did the arrow hit the cat and save his life. Crazy story I know, but true. It always sticks in my head when i'm out in the woods.

Read a story in a hunting or other magazine about a cougar being taken by a buddy of an archery hunting duo, while the cougar was stalking up on his partner. It wasn't on the internet, so it must be true.
And raise your hand if you thought this thread was going to be a how to on poaching.

Read a story in a hunting or other magazine about a cougar being taken by a buddy of an archery hunting duo, while the cougar was stalking up on his partner. It wasn't on the internet, so it must be true.
And raise your hand if you thought this thread was going to be a how to on poaching.

Again if an archer carries his side arm is he poaching just because he has a gun , the problem is our game laws are so confuted that you need to be a Philadelphia tax lawyer or Bobcat not to be doing some thing wrong . If you don't want to carry your bow or rifle while scouting then don't . just don't assume a guy is a poacher just because he doe's . Aren't we in America where we are inisent till proven guilty ? ask rt about that bs, plus he did shoot a bear last year while scouting for elk with labs07 so it doe's happen .
The worst thing they ever did was allow a bowhunter to pack a side arm ...If I need to kill something that is attacking me I will use my bow ...that's why I bowhunt ...I do not need a side arm ...and if I was going to use it to poach I would be relying on my bow more than a pistol ...I wonder how many bowhunters do use their pistols to shoot at game :twocents:
Till the day(god forbid) you run in to a pack of wolves. You'll wish you had a side arm. I pack my pistol every time I enter the woods. I've been chased by moose,confronted by bears and a cougar. A simple warning shot is normally all it takes.

I haven't been confronted by lions, and tigers, and bears, but I have had some curious mice investigate my face while sleeping. In one instance, a dorito-baited ambush was successfully pulled off using .22 LR rat shot.
In another ill-conceived effort to thwart an attack, a misaimed 10 mm round impacted in the dirt next to the mouse. After we both sat there in stunned silence, he walked it off like it was nothing. After that, if I am expecting to be in the woods with these rabid beasts, I bring more gun than a 10 mm.

An arrow in a charging bear isnt going to mean much....a 44mag to the head neck or chest is going to do way more
not to mention it takes a little longer to nock and fire an arrow than it does to draw and fire a gun. and if your arrow misses youre screwed, you can keep pulling the guns trigger. and who says you get enough warning to use your bow when being attacked? things happen FAST sometimes. the guy who says hell use his bow if an animal is attacking him is high.
:yeah: I dare anyone to go on a bivy hunt in the wedge without a sidearm and feel good about that choice. Black bears, griz, wolves, cougars, and some of those people.

I was the same as you, never packed anything with me. When I was younger I lived in the woods, out by myself almost every day miles and miles from the truck at all hours - never gave it a second thought. Cougar and Bear were run by hound hunters and scared of humans, trappers worked the yotes over pretty good and deer, well the deer was 10x the current population. We didn't have a predator pit.
Most of the roads were open to vehicles. There was farms on a lot of the tillable land that now sits with young stands of timber or houses. Wolves were something in the history books. There was grizz, but they were so rare sightings was written off as a blonde black bear most likely.
Then one day I really needed a pistol - and didn't have one, what made it bad was I had kids with me who were wholly dependant on me to get them back safely.
Swore an oath under my breath to myself, to my kids and other people's kids that are with me........that I'll never be caught in that situation again.

kf hunter I hear you but 99% of guys don't need one . I had a griz take a six point bull from me while bow hunting, one of the craziest moments I've ever had in the woods , I guess I just found out the pecking order on that mountain , and really if I had a gun things coulda turned out worse for either him or I . plus if you hunt with rt he's scary enough to make bigfoot run :chuckle:

I have cow calls in my pack almost year round! I have packed my bugle tube on rifle bear hunts...am I hunting elk? nope

When I bear hunt before archery elk season, during archery elk season, and after archery elk season I have elk calls with me. And not once was I ever thinking about killing an elk.

I'll agree the % is really low that you'd ever need it.

What if I carry a foxpro with turkey sounds on it, and turkey decoys while cougar hunting (not during turkey season) and am using a 30-06 ?
Am I a would-be-poacher of turkey?

bow hunters that carry side arms are afraid of things that go bump in the night ! with the exception of griz country . I would venture to say that most bow hunters are better with a bow than a pistol so why would they try to shoot with a side arm ?

If archers aren't allowed to exercise their 2a rights just because they are bowhunting; I wonder what other activities one could come up with as well?
KF don't get wound up about the bump in the night dude , i'm cool with us having the right to carry , my point is you don't need one . I;ve spend countless hours in the woods both in the dark and light of day. the reality is a guy dosn't need a pistol inless he's in griz country / maybe we have so many wolve that wdfw demed it nessisary to pack.
Yeah you don't need one... until you REALLY need one. I may never need one in my life. But IF I do need one I want one with me not sitting at home useless...

I have only seen confronted by one bear in my hunting career and it took a Wasp in the throat at 4 steps :yike: I am still here ....LMAO !!! :archery_smiley:

I hunted Sun and Mon for mule deer in my elk country but was mostly elk scouting. I'm guilty in your book but your book is wrong. Don't be so quick to condemn. Lots of good folks out there with no intentions of poaching.

One thing to think of as well...
When you post a picture of someone doing something, but have no real facts to back anything up and make an assumption, like they are poaching (which is a crime), if one of the people in the picture happens to have seen it, and chose to, they could go after you for libel and/or slander.
Just sayin. Probably were hunting. My :twocents:.

FYI, I carry a .357 at all times archery hunting and even when fishing cause I am scared of things that go bump in the night..... :dunno:
