Wasn't there something with the previous background checks  that if it didnt come back within 3 days then the FFL could legally transfer it to you ( or something like that ) ?

Has anyone had the 10dys pass without the background check being completed and ask for and get the gun? Because per the law the ffl can give it to you....but will they?

Wife ended up having hers expire and went in and redid it again.  Store policy was not to give the gun after the 10 days without a pass.  So it went 30 days.  Problem was either the agency doing the background or the store.  Paper work got jacked up somewhere

Please explain. So... if your doing a private sale/transfer, who holds the firearm until the background check is completed? The seller is paid and holding the firearm doesn't seam right. The FFL doing the back ground check? I'm confused.  :dunno:

Ask the FFL what his preference is
Ive held my gun I just paid for until the FFL says your good to go and Ive had other FFLs hold it behind the counter
I have also had the transfers done while I hold mine (as seller) and then after background done buyer exchange funds and me hand him gun

FBI is still responsible for the background checks.  The store can still do background checks (FBI) on rifles and shotguns.  The local county or city law enforcement is the vehicle to perform background checks (FBI) for semi's and handguns.  I think the reason for that is the medical records check (question 4).
