Yes unfortunately states can enforce heavier but thankfully can’t fall below the federal laws. Good conversation with out smoke screens with hands waving in the air with cups and saucers flying into walls and windows from others speaking in metaphor of course. None the less huge differences in punishment especially when it comes to a bird that absolutely has no season in our state that should cause no type of confusion.
Penalties can be different per state but states can’t say there is going to be a 24/7/365 day waterfowl season without bag limits with shooting times around the clock. Big game for the most part has no federal jurisdiction because they don’t travel across state lines and or into other countries for the most part like migratory birds do. If someone harms a little humming bird then that person also committed a federal crime and states can enforce their laws as well.

I hit a hummingbird while riding a motorcycle once, watched it fly right into my helmet. Are you saying I should have called that in?
