Here are the RCW code sections(Douglas Co) for open range, trespass, restraint and notification of restraint. One is for animals at large in an open range, and the others for trespassing animals and restraint. I bolded the important bits and highlighted the Section titles.

16.24.090
Animals at large — Limitations — Defense.

"Except as provided in chapter 16.24 RCW, a person who owns or has possession, charge, or control of horses, mules, donkeys, cattle, goats, sheep or swine shall not negligently allow them to run at large at any time or within any territory. It shall not be necessary for any person to fence against such animals, and it shall be no defense to any action or proceedings brought pursuant to this chapter or chapter 16.04 RCW that the party injured by or restraining such animals did not have his or her lands enclosed by a lawful fence: PROVIDED, That such animals may be driven upon the highways while in charge of sufficient attendants."

The PROVIDED statement is the tricky one, it says that if there is a road nearby, they should use the road and be properly attended, etc. The main point is, that you cannot use the defense "they don't have a fence" and you CANNOT under any circumstances allow them to negligently run at large.

Trespassing animals — Restraint — Damages and costs.


"Any person suffering damage done by any horses, mules, donkeys, cattle, goats, sheep, swine, or any such animals, which shall either trespass upon any land enclosed by lawful fence as provided in chapter 16.60RCW or trespass while running at large in violation of chapter 16.24 RCW may retain and keep in custody such offending animals until the owner or person having possession of such animals shall pay such damage and costs, or until good and sufficient security be given for the same."


RCW 16.04.015
Damages, liability.

Except as provided under RCW 16.04.100, whenever any animals trespass as provided in RCW 16.04.010, the owner or person having possession of such animal shall be liable for all damages the owner or occupant may sustain by reason of such trespass.


RCW 16.04.020
Notice of restraint — Owner known.

Whenever any animals are restrained as provided in RCW 16.04.010, the person restraining such animals shall within twenty-four hours thereafter notify in writing the owner, or person in whose custody the same was at the time the trespass was committed, of the seizure of such animals, and the probable amount of the damages sustained: PROVIDED, He or she knows to whom such animals belong.

Hahaha! It's just one of those things. Really screwed with setting a couple friends up to go at some of those bucks with a bow.

Free range = SOL. Were they ?

Free range my AZZ, read the RCW's. Private property is private property, I don't even have to have it fenced. If I wanted to be a jerk, I could hold the owners  liable.  I could hold the live stock until the damages are settled.

It's free range around my house and I have to fence MY property to keep the cows OUT.
I couldn't care less about what anybody says..............

Allot of the RCW's differ from county to county. Most of Douglas Co is free range, the RCW's are still written to hold live stock owners liable for damages. It's all a balancing act, cattle and live stock need to be moved. Fences don't always hold them in and gates do get left open, most often not by the property owners. Everyone just keeps a eye out and usually there are no major problems.

I came home from work one day and had a buttload of cows eating the new grass around the house...........oh man was I pissed. I had to put 4 strand barbwire up to make the owners liable. Came home another day and those rascals were in my yard again, they jumped a 4 foot fence. I called the landowner and told him his cow were in my yard and told him to keep his cows away from my house. Never had another problem with the cows. I've never seen a 1000 lb cow jump over a 4 strand fence before, quite impressed.
I couldn't care less about what anybody says..............

I have problems with range cattle and the wild horses, campmeat probably knows were this is.
With the cows,horses and bears i cant keep the deer regular until nov/dec. to about may.

Snohomish county sheriff told us we could shoot the marauding dogs that were running up and down our pasture fence (on our property) chasing our sheep.  We asked the deputy to let the dog's owner know that.  They got an invisible fence about a week later.  It really cut down on the dog crap around the pasture too.
Such is life in the West and the further West the more the such.

That's a nice deer in the first pic, but boy he sure looks nervous.  I suppose I would be too if I knew there was a marauding band of rapin' horses roaming the area with ninja like stealth  :chuckle:

Life on the rez. Range area . Fence them out. Lots of cattle and horses out here so I have to keep a hot wire around the farm.

State Brand inspector can help you identify at least 2 of those.... send the owner a bill

I have over 200 pics of horse asses, assorted brands and #No's.
I'd call the brand inspector and give him a handful of the pics or as many as he wants.
If the previous owner of those horses, and out of protection of their brand, should have supplied the current owner with a certificate of permit to release the horse to it's new owner.  Certificate more commonly known in the horse world as a brand release.  It actually is a state law with a few different options on what the seller of the livestock can do to free up the branded animal for transfer.
I'd venture to guess that a handful of brand checks, the inspector contacting the ranch who possesses the brand, providing the picture of the horse with the brand, will turn up who the current owner is.
