So I CAN'T kill them? They are an endangered squirrel?

This is in Thurston County. It could be either but to me it doesn't look at all like a Western Grey. But Bowhunter45 says it is. Everyone else said Eastern. Looks like Bowhunter got out-voted. Maybe I need to shoot one so I can get a close up look.
