EMERGENCY RULE AS APPROVED APRIL 26, 2013
WAC 232-36-05100B Killing wildlife causing private property damage

Notwithstanding the provisions of WAC 232-36-051:
1) An owner of domestic animals, including livestock, the owner's immediate family member, the agent of an owner, or the owner's documented employee may kill one gray wolf (Canis lupus) without a permit issued by the director, regardless of its state classification, if the wolf is attacking their domestic animals.

(a) This section applies to the area of the state where the gray wolf is not listed as endangered or threatened under the federal endangered species act.
(b) Any wolf killed under this authority must be reported to the department within twenty-four hours.

(c) The wolf carcass must be surrendered to the department.

(d) The owner of the domestic animal must grant or assist the department in gaining access to the property where the wolf was killed for the purposes of data collection or incident investigation.

(2) If the department finds that a private citizen killed a gray wolf that was not attacking a domestic animal, or that the killing was not consistent with this rule, then that person may be prosecuted for unlawful taking of endangered wildlife under RCW 77.15.120.

(3) In addition to the provisions of (1), the director may authorize additional removals under RCW 77.12.240.

  It says not a threatened species in that part of the state, but if taken in other way than how they got their paper written you will be charged with taking endangered wildlife.

Just thought it sounded funny but its a start in the right direction

The other big catch is it is only valid in areas that the wolves are not listed as endangered or threatened. So in WA it is only east of the Okanogan River

i have to agree with you duckmen, if the animal is killed in an area where it is not listed as an endangered species how can the state prosecute an inappropriate killing as "killing of endangered species"

makes you wonder sometimes  :dunno:

I get the rule it just funny how this state wants to make the rules.

No way in hell would I make use of this rule, the risk is great the reward is small.

Knowing my luck;

 I'd see a wolf chasing my livestock around and biting at them,  I'd shoot the wolf, call WDFW and they'd come to investigate.

Then by judging on how they've been in documenting other wolf kills.... it would just be my luck they'd say my livestock was in no danger and this wolf was just wandering my property and I put it down needlessly and whack me with some serious fines and penalties and get my name splattered in the local paper.

So what I'm saying is I DO NOT TRUST WDFW enough to make use of this rule.

Unless you take a video of the wolf watching your livestock, then picking one cow out, then attacking it, then killing it, then eating a portion of it, then dropping its scat next to it, then taking a nap on top of it, your probably still in deep doo-doo.    :chuckle:
