Looks to me like those are two different bears, one has really large ears while the one on the bottom has tiny ears and a bigger head. The bottom bear looks like a pretty good bear.

I had the same situation two years ago.  The advice from the Game Warden I spoke to was to not hunt the area.  There is no distance or timeframe stipulated by the laws or regualtions.  However if your site is under the watchful eye of the Dept and you end up killing a bear that was influenced by your baiting, then they can charge you with illegally baiting for bears.  I had a friend who was baiting for deer and had an absolute toad of a bear take over the bait station.  He ended up pulling everything, doesn't hunt bear and had no desire to start.  I wanted to hunt the area with predator calls.  Probably could have done it without any problems but I wanted to make sure, Game Warden recommended I not hunt the area, so I didn't.

If you intentionatlly hunt bear on an active bait site problems but if there's no bait its not a bait site that would be my awnser.I know you can't hunt waterfowl on a corn field after its been cut for like ten days I think.give it a couple weeks and take the bear hell probly move on iff there's no food
