Maybe you need to post the land better! Seems like a lot of guys think it's public land. Can't just complain and not have it posted properly or gated off.

:chuckle: Who's responsibility is it? I'm not going to get into a long drawn out discussion but just to let you know, it's your responsibility to know where the property lines are! ;)

And FYI, it's posted very well, and how many apple orchards do you see on public land?

It's your responsibility to post correctly. It's their responsibility to know where they are hunting. I use to hunt an old orchard near Winthrop. 100% public land. Obviously if someone can drive their car in its not gated/posted well enough. Just letting you know! Take someone to court and don't have your land posted you'll probably lose.

Actually a lot of orchards are on state land depending on where you live, the state leases the land to orchard farmers so you can hunt on it. This is not an excuse for the trespassers if your hunting you should know exactly what is private vs public and their is no excuse for not knowing.

Duckslayer,

I suggest you read the trespassing while hunting RCW. Landowners are not required to post their land.
You're completely off in assuming this.
If you aint hunting, you aint livin'

Well he's kinda half right. It is someone else's responsibility to know property lines to avoid trespassing not the land owners. However, there is almost no legal recourse for a trespasser entering vaguely or poorly posted land. Even well posted land can result in nothing more than a slap on the wrist. Every state has there own set of trespassing laws as well as appropriate signage for maximum legal recourse. IIRC there is a small yellow sign our state uses for an immediate none disputable 500$ fine. That would be the one to find! Also, a verbal "stay off my land" can result in a criminal trespass and misdemeanor for the trespasser. There are other routes and cercumstances involved with any trespass of course.

I'm not talking about the legality of this issue, it's the fact that if someone wants people to stop trespassing then the land should be well posted. But who knows maybe it is. Obviously there is a road open with no chain or gate across if there's a car on the property. However if I ever have any question about public or private I just don't hunt it. Part of the reason why I stick to wilderness units. Don't have to worry about it...

Are you high dude? The orchard rows are not roads, lets say these morons in the car were to have some cosmic reason as to what led them to believe the road into the orchard was public land, driving through the orchard ripping someone's income off the tree with there roof rack would be an obvious sign you are doing something not right. I am dumbfounded at that photo.... :bash: :bash: :bash:

FYI, looks like the guy on the right in the first pic is the guy in the 3rd pic....MORONS!! and brought a youth along for the crime.... :bash: :bash: unreal!!!
Just tend your own and live.

Yeah, same guy in pic 1+3. He must not care if his pic is taken trespassing??

And, no way is the landowner at fault for anything here. Come on, man...

Not in Washington you won't. Read the laws. Know the laws better. It is your personal responsibility to know where you are at all times. It is your responsibility to know if you're on someone else's land in Washington.

I love the look on that guy's face in the first picture. It's like he just saw the camera and realizes that he was "caught."  :chuckle:

Is that a beer the other guy is carrying?

I guarantee you he didnt pack that beer can out.

Amazes me that anybody is dumb enough to trespass and hunt anymore, with the much stricter rules recently put into effect, and the fact that just about everybody has trail cameras now.  Not to mention modern mapping tools like the hunt on x chips make it so damn easy to find public land and stay off private.

Don't know em, and where I grew up snitches get stitches. :chuckle: Jokes aside in Washington state it doesn't have to be posted or fenced to be considered trespassing. It is the hunters responsibility to know the land boundaries. That guy in the woodland camo looks 3 sheets to the wind. Lol
