Question for BigTex or any F&W Enforcement
« on: November 23, 2016, 02:49:12 PM »
I keep having this argument with my hunting partner and neither of us are smart enough to find it in the regulation booklet. I know it is illegal to spotlight for coyotes when there is an open season for big game. My buddy is convinced that it is illegal year-round to use a caliber that is legal for big game while spotlighting for coyotes. If you know the answer to this please help a guy out and post a link with the regulation or copy and paste that section of the regulation into a reply, also please tell me the page number of the regulation.

There is no regulation limiting your choice of coyote caliber outside of modern furearm deer or elk season.  Not a leo, but im right.  Only reg limiting caliber is that its illegal to use a .24cal or larger during mod deer or elk, unless you have a valid deer, elk, coug, bear, moose, sheep or goat tag good for that place and time.

Your friend has incorrect information.

WAC 232-12-242 Hunting restrictions.

(1) It is unlawful to hunt wildlife during any modern firearm deer or elk season with any firearm 240 caliber or larger, or containing slugs or buckshot, unless the hunter has a valid license, permits and tags for modern firearm deer or elk seasons are in his or her possession.

(a) This subsection does not apply to people hunting bear, cougar, mountain goat, mountain sheep, or turkey.

(b) A violation of this subsection is punishable under RCW 77.15.410 or 77.15.430, depending on the circumstances of the violation.

(2)(a) It is unlawful to hunt any wildlife at night or wild animals, except rabbits and hares, with dogs (hounds) during the month of October or November during the dates established for eastern and western Washington modern firearm deer or elk general seasons. During the modern firearm deer and elk general seasons the hunting hours are one-half hour before sunrise to one-half hour after sunset. A violation of this subsection is punishable under RCW 77.15.430, Unlawful hunting of wild animals—Penalty.

(b) It is unlawful to use hounds to hunt black bear, cougar (EXCEPT as pursuant to RCW 77.15.245), coyote, and bobcat year-round. A violation of this subsection is punishable under RCW 77.15.410, Unlawful hunting of big game—Penalty, or RCW 77.15.430, depending on the circumstances of the violation.

Tell him thats ridiculous.  His .22-250 is a legal cougar caliber, and cougs are big game and xannot be hunted at night, so how does his rationalization fit that?  Your friend needs to spend more time reading the regs, and less time guessing what they might be.

Are you saying it's illegal to use .24 caliber or larger when hunting coyote during elk and deer during modern firearm seasons unless you have a live tag for big game that you are hunting and is legal to hunt that game at that place and time?
