firearm private sale question

got a question aboutselling a firearm,     ok, lets say iwant to sell my rifle, i put an add in the local paper, and a guy came over to buy it,    do i need to make the transfer through an FFl holder or can i just write out a bill of sale to cover my a$$ just in case he is a phyco?   is there any special requirement on private firearm sales?

No as long as you can verify that he is a state resident.  It is called a "face to face" sale.  The only time you need an FFL to get involved is when you are shipping a firearm to another state.  Currently there are no federal or WA state laws requiring you to do anything other than confirm his residency of the state of WA.

You dont have to do a bill of sale, but if your that worried about it just write something up stating "I john smith, did sell my (insert firearm), serial #(xxxxxxxx) to Joe Shmoe on (dated).  Then have you both sign it.

Some guys get antsy about it and if they do just tell them "sorry, no sale".  Its good to bring it up in the first converstations that you would be looking to have some kind of paper trail.  But 90% of the guys out there wont give a rip.

I have bought and sold a number of firearms from out of state on personal purchases.  There are alot of misconceptions out there regarding personal firearm sales.  Even when puchasing one outside the state and having one sent in.

why does it matter if the guy buying the gun is from out of state? if you are doing a face to face with a guy from another state in washington, you are not transferring across state lines, so why the need to confirm residence??

this is not a challenge, an honest question is all. i've never heard this before.

The resident status is news to me. I've bought and sold a bunch of rifles in face to face deals, never asked for ID and I have never been asked for ID.

Gentleman, I stand corrected.  After re-reading everything TECHNICALLY all you have to do is exhance $ for fire arm. IF you want to be sure it's a washington resident. Check ID.  IF you want to be sure the person can own a firearm. ask for CPL.

Sorry for causing any confusion.

You do not have to go to an FFL.  If you just want to cover your a$$ from any dirtbags then instead of a bill of sale you can go to the Dept of Licensing web site and get a firearms private disposition/transfer form and fill it out with the purchaser of your firearm. You don't have to turn this form in just keep it for your records but if you really want to cover yourself there is an address that you can mail that form to. The form is for handguns but you can easily use it for rifles.  Here is the link.      http://www.dol.wa.gov/forms/652004.pdf
